HomeMy WebLinkAbout16-574 DECEMBER 19, 2016 16-574 ORDINANCE FIRST READING (CARRIED 7-0 LOST_______ LAID OVER_______ WITHDRAWN_______) PURPOSE: WAIVE BIDDING REQUIREMENTS AND AUTHORIZE THE PURCHASE/RENTAL OF EQUIPMENT, MATERIALS, SUPPLIES AND/OR CONTRACTUAL SERVICES TO ASSIST THE DEPARTMENT OF PUBLIC WORKS IN THE PERFORMANCE OF FOUNDATION REMOVAL AND SITE PREPARATION WORK AT 1118 S. MAIN STREET (FORMER BUCKSTAFF PROPERTY) (Staff Recommends Waiving the Rules and Adopting on First Reading) INITIATED BY: CITY ADMINISTRATION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH WAIVING BIDDING REQUIREMENTS AND AUTHORIZING THE PURCHASE/RENTAL OF EQUIPMENT, MATERIALS, SUPPLIES AND/OR CONTRACTUAL SERVICES TO ASSIST THE DEPARTMENT OF PUBLIC WORKS IN THE PERFORMANCE OF FOUNDATION REMOVAL AND SITE PREPARATION WORK AT 1118 S. MAIN STREET (FORMER BUCKSTAFF PROPERTY) WHEREAS, the City of Oshkosh Municipal Code section 12-10 generally requires that all purchases of equipment, materials, supplies and contractual services in excess of $25,000.00 be competitively bid and purchases of lesser amounts be formally competitively quoted; and WHEREAS, the City of Oshkosh requested bids for the removal of foundations for property to be acquired by the City of Oshkosh located at 1118 S. Main Street (the Former Buckstaff property); and WHEREAS, only one bid was received and the Council has determined that the acceptance of this bid was not in the best interest of the City and has authorized the performance of this work directly by the City; and WHEREAS, due to the need to complete this work in a timely manner and the potential for additional work during this time of year pertaining to snow removal and similar work necessitated by weather and seasonal conditions it may be necessary to procure additional equipment, materials, supplies and/or contractual services to assist the DECEMBER 19, 2016 16-574 ORDINANCE FIRST READING CONT’D Department of Public Works with work associated with demolition and site preparation work for the property located at 1118 S. Main Street (the former Buckstaff property) and/or to assist the Department of Public Works by assisting in other areas such as snow hauling when city staff is performing the demolition and site preparation work; and WHEREAS, it is necessary to protect the health, safety and welfare of the residents of the City of Oshkosh by ensuring that such work is completed timely and efficiently; and WHEREAS, the weather dependent nature of these activities and needs makes traditional procurement through bids or formal quotations impractical and unreasonable. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That the appropriate city officials are hereby authorized upon approval of the Board of Public Works (the City Manager) to waive the formal bidding and quote requirements provided within Chapter 12 of the City of Oshkosh Municipal Code and to purchase and/or rent equipment, materials, supplies and/or contractual services to assist the Department of Public Works in the Performance of Foundation Removal and Site preparation work at 1118 S. Main Street (the former Buckstaff property) and/or to assist the Department of Public Works by assisting in other areas such as snow hauling when city staff is performing the demolition and site preparation work. The Board of Public Works (the City Manager) is hereby directed to provide a report to the Council of any purchases made under the authority granted within this ordinance and to notify the Council upon completion of the demolition site preparation project. SECTION 2. This ordinance shall be in full force and effect from and after its passage, and publication. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #16-574 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH WAIVING BIDDING REQUIREMENTS AND AUTHORIZING THE PURCHASE/RENTAL OF EQUIPMENT, MATERIALS, SUPPLIES AND/OR CONTRACTUAL SERVICES TO ASSIST THE DEPARTMENT OF PUBLIC WORKS IN THE PERFORMANCE OF FOUNDATION REMOVAL AND SITE PREPARATION WORK AT 1118 S. MAIN STREET (FORMER BUCKSTAFF PROPERTY) on December 19, 2016. This ordinance authorizes city staff, upon approval of the Board of Public Works (the City Manager), to waive the formal bidding and quote requirements provided DECEMBER 19, 2016 16-574 ORDINANCE FIRST READING CONT’D within Chapter 12 of the City of Oshkosh Municipal Code and to purchase and/or rent equipment, materials, supplies and/or contractual services to assist the Department of Public Works in the Performance of Foundation Removal and Site preparation work at 1118 S.
