MEMORANDUM TO: Honorable Mayor and Members of the Common Council FROM: John Zarate Chief Building Official DATE: December 6, 2016 RE: Approve Amendment to Weights and Measures Division Fee Schedule BACKGROUND The City of Oshkosh Weights and Measures Program had been a division of the City Health Department; however since 2011, when the City Health Department merged with Winnebago County, the City contracted with the State of Wisconsin to perform the duties of a Sealer. Due to inefficiencies not all businesses have been registered for a Commercial Weighing and Measuring License and subsequently inspected. As a result, in March, 2016, the City of Oshkosh Inspections Services Division hired a Sealer for its Weights and Measures Program. The City is under contract with the State of Wisconsin to perform retail motor fuel device (RMFD) inspections (gas pumps) until July 1, 2017. ANALYSIS When the City contracted with the State of Wisconsin to perform the duties of a Sealer, City Weights and Measures fees were reduced by half. To offset the hiring of a City Sealer and office staff, the Weights and Measures fee schedule requires an adjustment to reflect the fees that were charged prior to contracting with the State of Wisconsin. A survey of weights and measures fees of communities in the Fox Valley was completed and the proposed fees were found to be consistent with those communities. FISCAL IMPACT The Weights and Measures Division is an Enterprise Fund and has no direct impact on general revenues or the general fund. However, the increase in the Weights and Measures Division Fee Schedule would offset the personnel costs of the Sealer, Weights and Measures Code Enforcement Clerk, and the office equipment used to perform inspections. The fee increase would also offset the expense of the 2017 contract with State of Wisconsin for RMFD inspections. RECOMMENDATION Staff recommends that City Council approves the amendment to the Weights and Measures Division Fee Schedule.
