PURPOSE: RECEIVE AND FILE A PETITION FOR DIRECT LEGISLATION TO
REDUCE THE FORFEITURE FOR POSSESSION OF CANNABIS
(MARIJUANA) TO $25
INITIATED BY: CITY ADMINISTRATION
WHEREAS, petitions for direct legislation seeking to reduce the forfeiture for
possession of cannabis (marijuana) to $25 were received by the Office of the City Clerk on
Friday, November 4, 2016; and
WHEREAS, the City Clerk has reviewed the petitions and determined that there
were four separate petitions filed all seeking to reduce the forfeiture amount for first
offense possession of marijuana to $25 and that the petitions contained 1399 valid (plus 17
correctable signatures), 6 valid (plus 2 correctable signatures), 1560 valid (plus 25
correctable signatures) and 964 valid (plus 50 correctable signatures) signatures for each
version of the petition;
WHEREAS, the four petitions contain a combined total of 3,929 valid signatures for
all petitions received, plus 94 correctable signatures for all four versions of the petition; and
WHEREAS, State statutes require 3643 valid signatures for a direct legislation
petition; and
WHEREAS, none of the individual petitions separately contain sufficient valid
signatures even if all fixable signatures were to be corrected in accordance with the statutes;
and
WHEREAS, each petition seeks to repeal an existing ordinance in the City of
Oshkosh Municipal Code already regulating the penalty for first offense possession of
marijuana and establishing the base forfeiture for such offense as $125 and is therefore not a
proper subject for direct legislation.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to receive and place the
petition(s) for direct legislation on file and to take no further action thereon.
