On July 8, 1998, the City of Oshkosh Boazd of Appeals approved a variance for the above referenced
proper[y to allow for a 20' front yazd setback .
The decision of the Board was fi(ed in the Planning Services Office of the Department of Community
Development on July 9, 1998. Per Section 30-6(C)(3) and (4) of the Ciry of Oshkosh Zoning Oidinance,
your variance will expire on January 8, 1998 unless you have obtained a permit for the activiTy allowed
by the variance. If you fail [o get a pennit by this date, you must reapply for a variance if you intend to
go ahead with the activity allowed by the variance.
Building permits may be obtained from the Inspection Services Division in Room 205 at the Oshkosh
City Hall between 730 - 830 AM and 1230 - 1:30 PM, Monday thru Friday, or call (920) 236-5050 for
an appoin[ment.

C. R. Meyer & Sons, applicant for Banner Packaging, owner, requests a variance for a 20' fron[ yard
setback.
Mr. Bluemke explained the application for the variance to the boazd with mention of Chamco also having
reviewed the property and granted a vaziance for the pazking bt addition.
Pete LaCount; representative from C.R. Meyer, introduced Jokm Dennis; Banner Packaging Manager, and
Ken Krause; Architect.
Mr. LaCounf reiterated that Chamco had reviewed the vaziance request and given their approval for a
variance. He stated the use of landscaping to screen the new pazking area, as mentioned in [he Staff Report,
was accepiatile to the owrter.
Chairman Krueger asked what was across ihe street from the proposed parking lot addition. Mr. LaCo�nt
stated Packer would be located across the street. Verification was made using the map as posted.
Discussion continued on the landscaping that would be used to xreen the pazking lot regazding the densiTy
needed and the potential of it posing a haffic hazard.
Tom Oswald, Partner of Warehousing of Wisconsin, stated he had no prob(em with the proposed pazking
bt addition, and gave his support of the variance request.
Motion by Dahl to approve the variance for a 20' froat yard setback with the condition that
Iandscaping be approved by the Depactment of Community Development Seconded by
Husman. Motion carried 4-0. �
Finding of the Fact: Mr. Dahl stated there were no other alternatives for the placement of the pazking lot
expansion as the eicisting s[ructure and lot were built out to the limit, He also noted
it was one of the most appealing industrial settings he has seen.
There being no fiuther business, the meeting adjoumed.

C. R. Meyer & Sons, applicant for Banner Packaging, owner, reques[s a variance for a 20' front yard
setback whereas Section 3030 (B) (1) requires a 30' front yazd setback.
The general area is chazacterized by indushial land uses in the City's North Industrial Pazk. The .
subject property is zoned M-3 General Industrial District.

In reviewing a variance request, the following questions should be addressed:
Is there an unusuel or unique characteristic about the subject property which
creates a hardship?
Is the hardship self-created?
Is the variance being requested the least possible needed to remove any
hardship?
Will granting of the variance have a considerable adverse impact on the
neighboring properties?
The applicant is pcoposing to construct an addition to an existiug pazking lot, and is requesting a
variance for a 20' fron[ yard setback in order to add an additional 21 parking stalls. The stalls are being
added to replace the 19 pazking stalls Ihat will be lost ro a new office addi[ion. As proposed there will
be 234 pazking spaces on site. Wi[h 260 employees on the largest shifr the on site parking exceeds the
Ordinance requirement of I space for every 2 employees. However, [he owners study of their pazking
needs indicates that any lost pazking would make shift changes difficult. The employees at Banner
report in staggered shifts and the study illustrates that all 234 pazking spaces are �eeded.
The cunent site is almost totally built out so there aze few al[ernatives to the location for the proposed
pazking lot addition. The vaziance appears to be the least possible needed and granting the vaziance
would not appeaz to have a negative impact on neighboring properties. The current front yard setback
consists of a bermed grass area Consideration could be given ro adding a condition to the vaziance, if
the variance were granted, requiring [hat the becros be landscaped with low level shrubs to help screen
the new pazking area.
Based on this information, staff recommends approval of the variance.
