The petitioner submitted the 56-9890 applieation form including 5 additional pages of supporting documents and
plans.
Reviewer's Comments:
1. The exis[ing building to the soufh of the proposed building is ofnon-combustible conshuctian. The north wall
oC lfiis building is a purtial height existing masonry wall that will be veclieelly modifieA to c�eate a 4 hour fice
wa0 ([o separe[e the exis[ing building ftom Ihe pcoposed sPo�age buildiug). A[ plan review, extendiug lhia wall
to create "wiugs" (and aehiave the necassary 44 feet total wall length for the l l lineal feet of doo� openiugs)
was discussed. To the west, a prnate railroad spur would prohibi[ extending the masonry wall; b Ihe east,
extending Ihe wing wall would require new foundation work and potemially interfere with the functioning ot
the existing loading dock. Elimination of the walk dour was also diswssed, but is impractical for Ihe funetion
of �he area.
2. It was noted by �he petitioner that the previous code calculated Ihe maximum percentage of allowable openings
by the gross area of the ftrewall (and not ihe lineal feet ofwall). The new code imposes a moro res4ictive
requirement upon o masonry wall, which in ihis case is partially existing.

3. It is understood thet lhe loading dock acea wlll opetate such thet it dou not significau[ly con�ib�[e to P�e load
or spread of fire and smoke between the two buildings. The typical use would be understood ro involve placing
t6e kailer at the loading dock [o be loaded (unhookiug it 6om Iha hecto[), �en ceettaching and moviug Iha
hailet when fully loaded. An open area (wi[h sloped asphal[) will further separate lhe loading dock parking
area from Ihe new building, creating a setback behveen Ihe proposed building eud parked hailers.
4. The locel flre chief, by lettec (da[eA lanuary 13, 2003) cecommends approval of Ihe pefition with �he
understending thet the exis[ing sprinkler system be extended ro protect Ihe Gre wall on [he new conswcdon
side of [he fire wall. Mc Franz nores thet i[ is his understanding that an antifineze extension pcoviding one row
of sprinkler coverage could achieve this.
5. As Ihe City of Oshkosh is a certified municipality and will perfonn any required automatic fire suppression
review, ihis office will defar detemiination ofthe most suitable sprinklor heed type nnd piacement to the City of
Oshkosh. However, [he placement of heads �o create a water cur[ain at Ihe openings would be expected to
provide the best protection, unless there are pmctical field conditions or other wnstraints thnt prevent lhis.

RE: FIRE DEPARTMENT POSITION STATEMENT, 3350 MOSER ST.
DeazMr. Valdovinos,
We recommend that this variance be granted with condi[ions and allow Ihe opening in the
fire division wall.
The first condition is based on the fact that they are exceeding the allowable opening size
and it is leading to a combustible wood-frame building in[ended for wood palate s[orage.
With these conditions we would prefer that the entire addition be sprinklered. However, I
understand the owner does no[ wish to do so and under the code does not have ro. We do
recommend [hat the sprinkler system be extended ro protect the fire division wall on the
side of the new construction as well. Since this new addition will no[ be heated we
believe this could be done with an anti-freeze system ex[ension providing one row of
sprinkler coverage to the fire divisiou wall.
