PURPOSE: APPROVE ENGINEERING SERVICES WITH CH2M HILL
ENGINEERS, INC. FOR LEAD SERVICE LINE REPLACEMENT
PROGRAM ENGINEERING ASSISTANCE ($77,380.00)

BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized to enter into and take those steps necessary to
implement an appropriate professional services agreement with CH2M HILL Engineers,
Inc. for Lead Service Line Replacement Program engineering assistance ($77,380.00)

RE: Approve Engineering Services Agreement for Lead Service Line Replacement Program
Engineering Assistance / CH2M HILL Engineers, Inc. (CH2M) ($77,380)
BACKGROUND
There are several thousand lead service lines (LSL's) located on both public and private property within the City of
Oshkosh. The Lead and Copper Rule (LCR) within the Safe Drinking Water Act requires that samples taken at
customers' taps have less than 15 parts per billion lead. In order to comply with the LCR, the City controls LSL
corrosion with the addition of a phosphate -based corrosion inhibitor and a pH adjustment chemical at the water
treatment plant.
Changes in LCR sampling procedures and elevated lead levels occurring in Flint, Michigan have driven regulators
and municipalities across the country to revisit LCR compliance and LSL replacements. The Wisconsin Department
of Natural Resources allocated $14.5 million of their Fiscal Year 2017 Safe Drinking Water Loan Program Principal
Forgiveness funds for municipalities to use for replacing LSL's on private property for projects that result in full
LSL replacements. The City applied for funding and received $500,000 for LSL replacement in Fiscal Year 2017.
The City will apply for Fiscal Year 2018 funding, as well. In addition to this funding, the City is reviewing the
Municipal Code for updates relating to LSL's and developing a City-wide approach to LSL replacement.
ANALYSIS
CH2M was asked to provide a proposal for the services discussed below due to their experience with the City's
Water Utility and their experience in assisting other municipalities in the preparation of LSL Replacement
Programs. The services covered in this agreement will include LSL replacement program analysis, preparation of
program cost estimates, preparation of draft program policy and public education materials, and providing
assistance and recommendations to the City regarding the LSL replacement program.
FISCAL IMPACT
This agreement is for $77,380. The 2016 CIP Miscellaneous Lead Service Replacements Budget includes $250,000
for activities related to the replacement of lead services.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature,
including engineering services, may be procured without the use of formal, sealed quotes. I have reviewed this
agreement and in accordance with Section 12 -16 of the Code, I am hereby recommending the Common Council
approve the award of this engineering services agreement.
