SEPTEMBER 13, 2016 16 -450 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE LANDFILL TIPPING FEES WITH WASTE MANAGEMENT OF WISCONSIN FOR DISPOSAL OF CONTAMINATED SOIL FROM MARION ROAD WATER TOWER RECPLACEMENT ($50,825.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to enter into and take those steps necessary to implement an appropriate agreement with Waste Management for tipping fees for the disposal of contaminated soil from the Marion Road Water Tower replacement project: Waste Management - Wisconsin W132 N10487 Grant Drive Germantown, WI 53022 Removal of Contaminated sludge /liquids from vault area $1,325.00 Transportation of drums to treatment facility $350.00 Disposal /Retorting of contaminated materials (Liquid Waste) $1,500.00 /drum Disposal /Retorting of contaminated materials (Soil Waste) $1,500.00 /drum Disposal of contaminated materials $155.00 /drum (includes drum, transportation, and WI generator tax) Mini- excavator, hazardous waste operator, and site management supplies $2,600.00 Estimated Total: $50,825.00 Money for this purpose is hereby appropriated from: Acct. No. 541 - 1810 - 1799 -00000 Water Utility - Construction in Progress City f� Oshkosh MEMORANDUM TO: Honorable Mayor and Members of the mon Council FROM: James Rabe, Director of Public Works DATE: September 8, 2016 RE: Agreement for Disposal of Contaminated Soil from Marion Road Water Tower Replacement / Waste Management - Wisconsin (estimated $50,825) BACKGROUND While performing the environmental investigations for the Marion Road Water Tower Reconstruction project, AECOM Technical Services, Inc. ( AECOM) discovered items that required removal and disposal that were not covered under the general landfill disposal agreement approved at the March 8, 2016 Common Council meeting. These items included lead -based paint on some surfaces and some mercury contamination in an underground vault. The materials discovered pose no risk to the City's drinking water supply, but require special handling to dispose. ANALYSIS AECOM negotiated with Waste Management - Wisconsin to secure the City a favorable price to dispose of these materials in accordance with all applicable regulations. FISCAL IMPACT The estimated total disposal cost for these contaminated soils is approximately $50,825. The total cost will be based on the actual quantities hauled to the landfill. Funds for these services are budgeted as part of the construction project and are available in the Property Improvement section of the CIP. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature may be procured without the use of formal, sealed quotes. I have reviewed this agreement and in accordance with Section 12 -16 of the Code, I am hereby recommending that the Common Council approve this agreement.
