BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to grant Wisconsin Public Service
Corporation and AT &T, a utility easement within the existing State Street parking lot, per
the attached, and the proper City officials are hereby authorized and directed to execute
any and all documents necessary for purposes of same.

Northeast Corner of State Street and Waugoo Avenue (Plan Commission Recommends
Approval)
BACKGROUND
The subject property is a City -owned public parking lot containing 79 parking stalls generally located
at the northeast corner of State Street and Waugoo Avenue. The parking lot is located south of 105
Washington Avenue, the site of the Fraternal Reserve Association Building which is currently being
rehabilitated by Discovery Properties, LLC from a commercial office to a multi- family residential
luxury apartment building. The general area is predominantly mixed -use with retail, service,
institutional and residential uses surrounding the subject site. The subject site has a C -3DO Central
Commercial District zoning designation with a Downtown Overlay.
ANALYSIS
The proposed easement is needed to properly address service needs for 105 Washington Avenue as it
has been determined that services must be fed from the Waugoo Avenue facilities and nun
underground through the City parking lot rather than within the public right -of -way. The proposed
easement would be located along the eastern edge of the parking lot varying in width beginning from
Waugoo Avenue heading north, then heading west along the northern edge of the property and then
heading north to 105 Washington Avenue. The properties are located within Tax Increment
Financing District #30 which was approved by the Common Council on August 23, 2016 and was
created to assist in the redevelopment of 105 Washington Avenue. City staff has been working with
Wisconsin Public Service and AT &T to prepare easement documents which will be recorded at the
Winnebago County Register of Deeds.
FISCAL IMPACT
There will be no fiscal impact requiring any public service provision due to the granting of this
easement.
RECOMMENDATION
The Plan Commission recommended approval of granting a utility easement at its September 6, 2016
meeting.

GENERAL INFORMATION
Petitioner: Wisconsin Public Service Corporation

Action Requested:
The City of Oshkosh requests the granting of a private easement through the State Street parking
lot to allow for additional electric service to be provided to 105 Washington Avenue,
Applicable Ordinance Provisions: N/A
Property Location and Type:
The subject property is a City -owned public parking lot containing 79 parking stalls generally
located at the northeast corner of State Street and Waugoo Avenue. The parking lot is located
south of 105 Washington Avenue, the site of the Fraternal Reserve Association Building which is
currently being rehabilitated by Discovery Properties, LLC from a commercial office to a multi-
family residential luxury apartment building.
The general area is predominantly mixed -use with retail, service, institutional and residential uses
surrounding the subject site. The subject site has a C -3DO Central Commercial District zoning
designation with a Downtown Overlay.
Analysis:
The proposed easement is needed to properly address electrical service needs for 105 Washington
Avenue. Wisconsin Public Service determined to power the building, service must be fed from
Waugoo Avenue facilities. As a cost saving measure, Wisconsin Public Service proposed to run
underground lines through the City parking lot versus staying within public right -of -way.
The proposed easement is located along the eastern edge of the parking lot varying in width,
beginning from Waugoo Avenue heading north, the easement will be eight feet wide, narrows to
three feet heading west along the northern edge of the property, then widens to six feet heading
north to 105 Washington Avenue.
Both properties (as well as 300 -302 State Street) are located within Tax Increment Financing District
#30 approved by the Common Council on August 23, 2016. TID #30 was created to assist in the
redevelopment of 105 Washington Avenue, which includes the City's disposition of about two -
thirds of the parking lot to Discovery Properties. Discovery Properties is proposing to construct
three multi -car garage structures to be used by tenants of 105 Washington Avenue. Once the land
transfer is complete, the City will no longer have interest in the utility easement.
The Department of Public Works and City Attorney has been working with Wisconsin Public
Service to prepare easement documents which will be signed and recorded at the Winnebago
County Register of Deeds.
RECOMMENDATIONICONDITIONS
Staff recommends approval of the granting of the proposed utility easement as requested.
The Plan Commission approved of the granting of the utility easement as requested. The
following is the Plan Conu- ission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area and the zoning
classifications in this area and stated that the subject site was within a city owned parking lot. He
discussed the rehabilitation of 105 Washington Avenue and reviewed a map depicting the
proposed easement area. He explained the reason for the easement request which is to provide
services to 105 Washington Avenue such as Wisconsin Public Service Corporation, AT &T, Time
Warner and other private utility providers. He further stated that this area was included within
the Tax Increment Financing District #30 recently approved by the Common Council.
Mr. Burich added that this was the first step in implementing the TIF project plan which also
includes a land disposition to the developer of a portion of the State Street parking lot. The
proposed easement is a short -term easement only as once the land transfer is complete the City
will no longer have interest in the utility easement. Mr. Burich. further explained that the easement
was necessary as the developer needs to get power to the structure as soon as possible. The land
disposition would be presented to the Commission at a later date once other details are worked
out.
Mr. Borsuk questioned if all the utilities would be placed underground.
Mr. Burich responded affirmatively.
Motion by Vajgrt to approve granting a utility easement at the State Street parking lot located at the
northeast corner of State Street and Waugoo Avenue.
Seconded by Nollenberger. Motion carried 7 -0.
