UTILIZE CITY STREETS & OPERA HOUSE SQUARE FOR CHALK
WALK SEPTEMBER 10, 2016
INITIATED BY: PARKS DEPARTMENT
WHEREAS, the Common Council of the City of Oshkosh previously approved the
Chalk Walk event with conditions including clean -up following the event utilizing a
combination of a sidewalk sweeper and low power powerwashing; and
WHEREAS, the organizers are evaluating additional options for cleanup and have
requested the City to modify the condition to allow additional options as approved by the
Department of Public Works.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that Resolution 15 -262 granting approval to the BID Marketing Consortium to
utilize the 300 block of N. Main Street, Market Street and Opera House Square, on Saturday,
September 10, 2016, for their Downtown Oshkosh Chalk Walk is hereby amended to delete
Condition A pertaining to clean up and replace Condition A with the following:
A. Clean up to be completed as approved by the City of Oshkosh
Department of Public Works.
BE IT FURTHER RESOLVED that all other approvals and conditions pertaining
to Resolution 15 -262 and this Event remain in effect.

Utilize City Streets & Opera House Square for Chalk Walk September 10, 2016
BACKGROUND - The Common Council has previously approved a special event application for the Business
Improvement District (BID) Marketing Consortium for a Chalk Walk to be held along Main Street and Opera
House Square in Downtown Oshkosh. During this event artists use chalk to create art work on the sidewalks and
pavement in the downtown area.
The City of Oshkosh is subject to a stormwater discharge permit issued by the Wisconsin Department of Natural
Resources (WDNR) which regulates runoff into the stormwater system and which would prohibit the
introduction of other waste materials such as the chalk used in this case into the system. In order to meet the
requirements of the stormwater permit, the chalk from the event must be cleaned up so that it does not enter into
the stormwater system.
When the event was approved by Council, the applicant anticipated using a combination of a sidewalk sweeper
and low power power- washing to complete clean up. Since the approval the applicant has identified other
potential options for clean-up and is requesting an amendment to their permit to allow for use of one of these
alternative options should an option be identified that meets the requirements and is more efficient or less costly
for the event organizer.
ANALYSIS - The condition for cleanup is a requirement of the City's storm water permit and compliance with
the City's goal is compliance with the permit. The particular means of complying identified in the original
approval is not required and if the applicant is able to comply with the requirements in a more efficient or cost
effective way so long as the requirements are met, staff recommends approval of the request. The City's interests
are protected by the requirement that any method of cleanup is approved by the Department of Public Works.
FISCAL IMPACT - There is no anticipated fiscal impact to approval of this amendment.
RECOMMENDATION - Staff recommends approval of the Resolution to allow the applicant to explore
alternative methods of cleanup for their event.
