HomeMy WebLinkAbout08. 16-421AUGUST 23, 2016 16 -421 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE ACCEPTING STORM SEWER EASEMENT AT 3300 NORTH MAIN STREET INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to accept an easement to construct a storm sewer for the Fernau Avenue Watershed at 3300 North Main Street, per the attached, and to execute any and all documents necessary for purposes of same. Oshkosh MEMORANDUM TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: August 18, 2016 RE: Approve Accepting Storm Sewer Easement at 3300 North Main Street (Plan Commission Recommends Approval) BACKGROUND The subject 23.84 acre property is located on the east side of North Main Street, north of East Fernau Avenue and the Wisconsin Public Service facility is located on the subject property including parking and loading areas. The Department of Public Works is seeking approval of a storm sewer easement from Wisconsin Public Service (WPS) that will run north along the west property line and connect to an existing drainage easement. The proposed easement is necessary to construct a storm sewer as part of the storm water management plan for the Fernau Avenue Watershed. ANALYSIS The Fernau Avenue Watershed has historically experienced flooding during moderate to significant rainfall events and to reduce the impacts, the City is constructing a regional storm water detention basin adjacent to the north branch of the drainage way within the watershed. During the basin's design and related improvements, it became apparent that flow water within the watershed could be improved by enclosing a portion of the drainage way which would improve the flow of runoff through the ditch, reduce the damage to the North Main Street pavement, and reduce erosion within the drainage way. The Department of Public Works approached WPS for the easement to facilitate this new alignment and will coordinate with them to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT Other than the cost of installing the storm sewer through the easement there should be no ongoing fiscal impact due to acceptance of this easement. RECOMMENDATION The Plan Commission recommended approval of acceptance of a storm sewer easement at its August 16, 2016 meeting. RECOMMENDATIONS /CONDITIONS Staff recommends approval of the acceptance of the proposed storm sewer easement as requested. The Plan Commission approved of the acceptance of the storm sewer easement as requested. The following is the Plan Commissions discussion on this item. Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He discussed the use of the site which is occupied by Wisconsin Public Service Corporation and explained the reason for the easement request which is to improve the water runoff flow within the watershed in conjunction with the construction of the regional storm water detention basin in this vicinity. He also reviewed a map of the proposed easement area. v. There was no discussion on this item. Motion by Vajgrt to approve the acceptance of a storm sewer easement at 3300 N. Main Street. Seconded by Nollenberger. Motion carried 8 -0. Project Narrative for Accept Storm Sewer Easement; 3300 North Main Street The Department of Public Works is requesting a 30' wide easement from Wisconsin Public Service (WPS) to construct a storm sewer. The storm sewer is part of the storm water management plan for the Fernau Avenue Watershed. The easement is located along the east side of the North Main Street right -of -way. The new easement connects to an existing drainage easement along North Main Street. The approximately 880 -acre Fernau Avenue Watershed has historically experienced flooding during moderate to significant rainfall events. To reduce flooding impacts, the City is constructing a regional storm water detention basin adjacent to the north branch of the drainage way within the watershed. The basin will receive runoff from approximately 190 acres of land (Figure 1), During the design of the detention basin and related improvements, it became apparent that flow water within the watershed could be improved by enclosing a portion of the drainage way. The new alignment will improve the flow of runoff through the ditch, reduce the damage to the North Main Street pavement and reduce the erosion within the drainage way.
