HomeMy WebLinkAbout07. 16-420AUGUST 23, 2016 16 -420 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE ACCEPTING RIGHT OF WAY EASEMENT AT 627 BAYSHORE DRIVE INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to accept a right of way easement to improve access to the boat launch at 627 Bayshore Drive, per the attached, and to execute any and all documents necessary for purposes of same. Oshkosh MEMORANDUM TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: August 18, 2016 RE: Approve Accepting Right -of -Way Easement at 627 Bay Shore Drive (Plan Commission Recommends Approval) BACKGROUND The subject site consists of a commercial property located at the end of Mill Street, west side of the Mill Street Boat Launch, and the general area consists of residential and commercial uses. The City of Oshkosh is requesting acceptance of a right -of -way easement to improve access to the boat launch located at the end of Mill Street. ANALYSIS Mill Street is included in the 2016 Capital Improvement Program for reconstruction and during the design the property owners of the subject property offered to grant an easement to improve the access to the boat launch. The proposed 10 foot wide right -of -way easement will run 62 feet along Mill Street and allow for a larger cul- de -sac bulb to be constructed which will improve the ability of vehicles to turn around without reversing. This easement will allow for curb and gutter, pavement, signage, snow storage, and any other typical right -of -way use to occur in this area. The Department of Public Works will work with the property owner to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT Acceptance of the easement will not have a fiscal impact on the provision of city services in this area as those services are already being provided to the area. RECOMMENDATION The Plan Commission recommended approval of acceptance of a right -of -way easement at its August 16, 2016 meeting. RECOMMENDATION /CONDITIONS Staff recommends approval of the acceptance of the proposed easement as requested. The Plan Commission approved of the acceptance of the easement as requested. The following is the Plan Commission's discussion on this item. Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He explained that Mill Street was scheduled for reconstruction in 2016 and that the proposed easement would allow for a larger cul -de -sac bulb to be constructed which would improve access to the boat launch. He also reviewed a map depicting the proposed easement area. Mr. Borsuk commented that he recalled that there were some issues regarding the driveway access in this location and questioned if it has been resolved. Steve Gohde, Assistant Director of Public Works, responded that there were some concerns related to the loading docks which have since been addressed and that they were still working through some other issues related to this easement placement. Mr. Bowen arrived at 4:02 pm. Motion by Nollenberger to approve the acceptance of a right -of -way easement at 627 Bay Shore Drive. Seconded by Vajgrt. Motion carried 8 -0.
