AUGUST 23, 2016 16 -419 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AMENDMENT TO CONDITIONAL USE PERMIT/ PLANNED DEVELOPMENT FOR UNIVERSITY RE -USE OF FORMER LINCOLN ELEMENTARY SCHOOL SITE AT 608 ALGOMA BOULEVARD INITIATED BY: UNIVERSITY OF WISCONSIN SYSTEM BOARD OF REGENTS PLAN COMMISSION RECOMMENDATION: Found consistent with Section 30 -33 Section 30- 11(D) and approved with conditions WHEREAS a Conditional Use/ Planned Development was previously approved in 2010 for reconstruction of the parking lot and Wisconsin Street driveway and amended in 2013 to extend the parking lot construction and driveway reconstruction deadlines to end of calendar year 2015; and WHEREAS the petitioner now requests to amend the previously approved parking lot construction and driveway reconstruction deadlines to the end of calendar year 2017. NOW THEREFORE BE IT RESOLVED by the Common Council of the City of Oshkosh that the amended conditional use permit for the planned development for reconstruction of the parking lot at 608 Algoma Boulevard, per the attached, is hereby approved with the following conditions. All other conditions of approval shall remain enforce. 1. Parking lot shall be reconstructed to meet current code requirements by the end of calendar year 2017. 2. Wisconsin Street driveway has "right in - right out" configuration by the end of calendar year 2017. 3. Plans for the parking lot reconstruction shall be reviewed and approved by the Plan Commission prior to any zoning permit issuance or site reconstruction commencing on the subject property. 4. UW- Oshkosh shall hold a neighborhood meeting at least 10 days before the item is scheduled for Plan Commission review and notice all adjacent property owners. 5. In January 2018, City staff is instructed to start the revocation process for the conditional use permit for use of the subject property should the site improvements not be completed by the end of calendar year 2017. Oshkosh MEMORANDUM TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: August 18, 2016 RE: Approve Amendment to Conditional Use Permit/Planned Development for University Re -Use of Former Lincoln Elementary School Site at 608 Algoma Boulevard (Plan Commission Recommends Approval) BACKGROUND The approximate 2.41 acre subject property is the site of former Lincoln Elementary School located on the north side of the Algoma Boulevard and Wisconsin Street corner. The University of Wisconsin Oshkosh received a Conditional Use Permit (CUP)/Planned Development (PD) to house the Division of Lifelong Learning and Community Engagement and the Children's Learning and Care Center in October 2010. The CUP/PD was approved by Council with conditions including that the parking lot shall be reconstructed to meet current code requirements within three years and that the Wisconsin Street driveway have a "right -in - right -out" configuration. In March of 2013 the University requested and received Common Council approval to amend the previously approved CUP/PD to include relocation of the playground to remain in the general location as it currently exists and a time extension to the end of 2015 for the conditions relating to the parking lot reconstruction and the "right -in - right -out" configuration of the Wisconsin Street driveway. ANALYSIS The University is requesting to extend the time frame of the two conditions for reconstruction of the parking lot to meet current code requirements and the "right -in - right -out" configuration of the Wisconsin Street driveway to the end of 2017. The University has submitted the project for the redevelopment of the parking lot to the State of Wisconsin as required by State Statute including the required dumpster enclosure, newly configured driveway and all improvements meeting City zoning requirements with a close out date of September, 2017. The two year extension is felt to be a reasonable request as the parking lot is currently in serviceable condition and will remain functional in the short term and staff is recommending approval of the extension of these two conditions until the end of 2017. Additional conditions are recommended to require review by the Plan Commission for the reconstruction plans prior to commencing work, a requirement for the University to hold a neighborhood meeting prior to the Plan Commission review, and the commencement of the revocation process in 2018 for the conditional use permit if the site improvements are not completed by the end of 2017. FISCAL IMPACT No additional city services or infrastructure is required to service this development. RECOMMENDATION The Plan Commission recommended approval of the amendment to a conditional use permit /planned development with conditions at its August 16, 2016 meeting. GENERAL INFORMATION Petitioner /Owner: University of Wisconsin System Board of Regents Action(s) Requested: The petitioner requests amendment of a previously approved Conditional Use/Planned Development for reconstruction of the parking lot and Wisconsin Street driveway to extend timeframe to implement improvements. Applicable Ordinance Provisions: Conditional Use Permit standards are found in Section 30 -11 of the Zoning Ordinance, Planned Development standards are found in Section 30 -33 of the Zoning Ordinance. Base standard modifications to permit installation of three ground signs and wall sign as submitted in project narrative. 6. The existing graveled parking area previously created shall be removed and the parking lot restriped to address current substandard stall and drive aisle sizes. 7. The parking lot shall be reconstructed to meet current code requirements within three years. 8. Wisconsin Street driveway have "Right in — Right out" configuration. The petitioner is requesting to extend the conditions of the previously approved CUP/PD to include: 1) Time extension to the end of calendar year 2017 for Condition 1 - "Parking lot shall be reconstructed to meet current code requirements by the end of calendar year 2015 "; and 2) Time extension to the end of calendar year 2017 for Condition 2 - "Wisconsin Street driveway has right in --- right out configuration by the end of calendar year 2015 ". The petitioner has stated in their letter dated June 22, 2016 that the University has submitted the project for the redevelopment of the parking lot to the State of Wisconsin as required by State Statute and a contractor has been selected to develop the engineering and construction plans. The parking lot improvements will include the required dumpster enclosure and a newly configured driveway and all improvements will meet City zoning requirements. Should the proposed ITEM- 608 Algona .E'xlend CUP/PA improvements not meet code requirements the petitioner will be required to submit their development plans to the Plan Commission and Common Council for review and approval. The applicant has stated that improvements will be completed by September, 2017. The two year parking lot and driveway reconstruction extension (to the end of 2017) is felt to be a reasonable request considering the overall improvements that have been done to the building and site at this time and staff is unconcerned with permitting the extension to the parking lot and driveway reconstruction/reconfiguration. The parking lot is currently in serviceable condition so it will remain functional in the short term but even with routine maintenance activities, will need reconstruction over time, so the conditions of a 2017 reconstruction date are appropriate. RECOMMENDATION /CONDITIONS Staff recommends approval of the Conditional Use/Planned Development amendment as proposed with the following conditions: 1. Parking lot shall be reconstructed to meet current code requirements by the end of calendar year 2017. 2. Wisconsin Street driveway has "right in — right out configuration by the end of calendar year 2017. The Plan Commission approved of the conditional use permit /planned development as requested with conditions noted. The following is the Plan Commissions discussion on this item. August 2, 2 016 Ms. Williams presented the item and explained the reason for the amendment to extend the timeframe for the previously approved improvements which were originally approved in 2010. She further explained that the proposal was amended in 2013 to relocate the playground area and to extend the timeframe for the parking lot reconstruction and reconfiguration of the Wisconsin Street driveway to have a right- in/right -out configuration by the end of 2015. She reviewed the site and surrounding area as well as the land use and zoning classifications in this area and stated that the University was requesting an extension for the completion of the parking lot reconstruction and the right -in /right -out configuration for the driveway until 2017. She reviewed the letter submitted by the University providing the estimated schedule for the completion of the project which indicated that the project would be closed out by September of 2017. She discussed the existing condition of the parking lot and reviewed the site plan that was previously approved. Mr. Hinz commented that this was the second extension, if approved, and questioned what would prevent the University from asking for another extension for the completion of this development. Mr. Burich stated that is a possibility, Mr. Thoms commented that the reconstruction of the parking lot is understandable however he felt that the right -in /right -out configuration for the driveway could be accomplished now. ITEM- 608 Algayn E.xlend CUP /PD Mr. Burich responded that reconfiguration really needs to be done with the overall parking lot reconstruction and that signage only is not as effective. Bernard Pitz, 617 W. Irving Avenue, stated that the University indicated that it had submitted plans to the state and that he had issues with the previous placement of the dumpster enclosure as it was in an undesirable location. He felt the site plan should reflect the location of the area for the dumpster enclosure and he also had concerns with the area on the site plan that was designated as "to be determined" as he felt the site plan should be more definitive. Ms. Williams explained that the site plan was previously approved by the Plan Commission and Common Council and that the parking lot reconstruction will have to meet code requirements regarding the placement of the dumpster enclosure and if any alterations were being requested, it would have to come back to the Plan Commission and Common Council for approval. Mr. Pitz reiterated that he needed to know where the enclosure would be located and that this should be depicted on the plans prior to receiving any approval for the extension of the timeframe. He continued to discuss the approval of the CUP/PD in 2010 that required the Wisconsin Street driveway to be right -in /right -out which was not being abided by at this point. He felt that the CUP/PD should be revoked if the University was not going to abide by the conditions of approval and they should be required to come forward with full plans to receive approval for the requested extension. Mr. Bowen commented that the Commission and Common Council approved the reconstruction plans for the site at the time the CUP/PD approval was granted in 2010. Mr. Buck stated that when the CUP/PD was approved it included a condition that the parking lot be reconstructed to meet code requirements which would regulate the placement of the dumpster enclosure by the zoning ordinance. Mr. Bowen stated that the site plan was reviewed in the past when the development was approved and it was required to meet code requirements which would address the issue. Mr. Burich added that part of meeting code requirements would relate to the placement of landscape islands, buffering, and storm water management as well as no base standard modifications being granted to allow any alterations to the ordinance without coming back to the Commission for approval of an amendment. Mr. Bowen stated that the layout for the parking lot was in the final plans presented as it currently exists and no alternation of the plans was being requested just an extension of the timeframe for completion. JoAnn Rife, Director of Planning and Construction for the University of Wisconsin - Oshkosh, 650 Witzel Avenue, stated that the overall request submitted provides a time line for the project completion and explained the process to submit the request to the state to design and plan the ITEM- 608 Algomm Extend CUP /PD reconstruction and meet the requirements of the City's code standards. She discussed the placement of the dumpster enclosure and the several considerations being evaluated at this time and the rear and side yard setbacks involved and the possibility of the University requesting a variance for the sideyard setback in the future if deemed necessary. She further stated that the architectural team was assigned last Monday and discussed the construction process involved at the state level and that the project was scheduled to be completed at the end of 2017. Mr. Thoms commented that the CUP/PD was approved in 2010 and amended in 2013 with a completion date of the end of 2015 and commented that the letter appeared to first be submitted to the state in 2016. Ms. Rife discussed the acquisition of the property from the school district and the amount of funding approved for the project in the budget which covered the interior improvements to the building only. As part of the approval process with the state, the University needed to complete the building interior and playground area first before being able to proceed with the submission of the parking lot reconstruction to prove forward in a consecutive fashion. Mr. Hinz questioned the status of the area on the site plan that is labeled "to be determined ". Ms. Rife responded that the area was gravel at one point but has been restored to green space currently and is planned for the parking lot to expand to the back of the lot when reconstructed in the future. Lori Worm, Interim Vice Chancellor of Administrative Services for the University of Wisconsin- Oshkosh, 800 Algoma Boulevard, stated that she has worked with the parking department for the state and discussed their process which involves projects being built into five and teri year planning needs and it is currently in financial planning for its completion. Mr. Hinz inquired if it would be feasible to add a condition to this request that future extensions would not be allowed for this project. Ms. Lohry commented that this situation has been poorly handled although she understood that the University was at the will of state government. She further discussed Mr. Pitz's commentary and that she passes this location frequently and the Wisconsin Street side of this intersection looks bad and has for quite some time. She would not support an extension for this development. Mr. Thorns discussed the possibility of the requested extension being granted and the project not being completed in 2017. He questioned what would happen if another extension is not allowed and what recourse the City would have. Mr. Burich responded that the City could fine the University for the violation and a lawsuit against them was another avenue however neither one of these options are good ones to get the project accomplished. The conditional use - permit could also be revoked. ITEM- 608 Algoin Evend CUPIPD Mr. Thorns stated that he was reluctant to vote in favor of this request but would support it this time however he will not support another extension in the future. Mr. Burich suggested that the conditions could be altered to remove the use of the lot for parking if compliance with the reconstruction is not met. Mr. Borsuk requested that an item be placed on a future agenda to discuss how to address conditions such as this one and what recourse the City has when conditions relating to time lines are not met. He felt a message to the Board of Regents regarding this matter was necessary and he understood, that budget restraints were an issue but the University has a responsibility to the City in this case and should complete the necessary reconstruction or lose the ability to use the site for parking purposes. He felt the Commission needed further direction on how to handle conditions for development approvals to ensure compliance in a timely fashion. Mr. Nollenberger suggested that a condition be added that the parking lot can no longer be utilized if the reconstruction and reconfiguration is not complete by 2017. Mr. Burich responded that he would like to consult with the City Attorney on this matter before adding such a condition. Mr. Borsuk discussed if the request should be laid over or allowed to move forward to the Common Council. Mr. Thoms stated that he would support a layover for the item. Motion by Vajgrt to lay over an amendment of a conditional use permitlplanned development for the university re -use of former Lincoln Elementary School site at 608 Algoma Boulevard for two weeks. Seconded by Lohry. Mr. Hinz commented that although this may not be in the purview of the PIan Commission, the University has been setting a standard of putting things off. Motion carried 7 -0. August 16, 2016 Ms. Williams presented the item and explained that this item was laid over from the August 2nd meeting to allow staff time to obtain additional direction on options to ensure compliance with recommended conditions. She reviewed the concerns discussed at this meeting and ,the current use of the site by the University as well as the subject site and surrounding area, land use, and zoning classifications in this area. She explained that the original CUP/PD was approved in 2010 with conditions and that an amendment was approved in 2013 to extend the parking lot reconstruction to the end of 2015. She further explained that the current amendment was requesting the approval of an extension for the parking lot reconstruction until the end of 2017. ITEM- 608 Algomn E.rfend CUPIPD She stated that the University was working with a consultant on the project and the delays in its completion were due to the approval process at the state level and distributed copies of the Wisconsin Department of Administration's agenda for the kickoff meeting for the parking lot reconstruction project. She also reviewed three additional conditions relating to this extension of the CUP/PD that the Plan Commission could consider which were to require the plans to be reviewed by the Plan Commission prior to reconstruction, a requirement that the University hold a neighborhood meeting prior to Plan Commission review of the plans, and to commence the revocation process for the CUP for use of the subject site if the improvements are not completed by the end of 2017. She also discussed that the option to revoke the use of the parking lot immediately which was not an option as it would be considered a breach of contract with the established use of the site. Mr. Thoms requested a more detailed explanation of the three additional conditions. Ms. Williams explained that the first condition to review and approve the plans prior to commencing reconstruction on the site was to address concerns relating to the parking lot design as it would be required to meet code standards. The Plan Commission`s review prior to moving forward with the reconstruction would assure that if code requirements could not be met that base standard modifications could be considered if necessary. The second condition to hold a neighborhood meeting was due to the fact that the University property is directly adjacent to residential properties and the purpose of the meeting was to consult with the neighboring property owners and provide additional information to the residents regarding the layout and design. The third condition was addressing the revocation of the CUP for the use of the subject site should the reconstruction not be completed by the end of 2017 to ensure compliance in a timely fashion. Mr. Thoms inquired if these conditions were discussed with the petitioner. Ms. Williams responded that the conditions were reviewed with JoAnn Rife and seemed to be acceptable. Mr. Borsuk questioned that the final outcome could be that the site would be taken out of use by the last condition if compliance was not met by the end of 2017. Ms. Williams responded that would come through a revocation process. Andrew Leavitt, 1423 Congress Avenue, Chancellor for the University of Wisconsin - Oshkosh, stated that he regretted how this has been handled and offered his apologies that the work could not be completed on time and assured the Commission that the project would be completed by the extended timeline and that the University was amendable to the conditions offered to allow this extension. Ms. Propp inquired if the building was fully reconstructed for its purpose on the interior. ITEM- 608 Algormr E.dend CUPIPD Mr. Leavitt discussed the interior renovations to the structure which are complete and that the reconstruction of the parking lot was the last step in the process, Mr. Borsuk questioned if there was something in place to prevent these delays or some internal process that was missed that caused it. Mr. Leavitt explained that the University has gone through extensive building on campus recently and a new Chancellor was in place and he was embarrassed by this inaction. JoAnn Rife, Director of Planning and Construction, 650 Witzel Avenue, discussed the overall process of approvals and construction plans and that the project had been submitted to the State. She further explained that an architectural team needed to be gotten on board and the funding approved for the project however the funds initially approved were not enough to complete the interior renovations and discussed the next two phases submitted to the State for approval. She stated that the projects must be completed in order and discussed the time line for the State Building Commission which does not meet on a regular schedule and that meetings have been more sporadic causing further delays in the process. Mr, Burich commented that concerns have been raised regarding the location of the dumpster enclosures and questioned if this feature will be depicted on the plans when they are submitted to the Conunission for review. He further discussed the area where they have been located and that they have been recently moved and questioned if there were intentions to move them back to their previous location when the new school year commences. Ms. Rife responded that the dumpster enclosures needed to be located where they will not be in the way of the operation of the facility but that they would remain at their current location during the upcoming school year. Bernard Pitz, 617 E. Irving Avenue, stated that he owns rental property across Wisconsin Street and has complained numerous times about the location of the dumpster enclosures. He further stated that the University claimed that plans have been submitted to the State however they do not show the future expansion area of the playground and another area that is depicted as "to be determined ". He stated that he objected in 2010 to the location of the driveway on Wisconsin Street and further discussed the location of the playground which was relocated from its initial area and he felt that the driveway entrance could be moved to access Union Avenue rather than Wisconsin Street. He continued to discuss the right -in /right -out configuration of the driveway access which is not being adhered to by either staff or visitors to the site and that the Planning Services office indicated that the University would lose their approved planned development if this condition was not complied with. He stated that he had no objection to the parking lot itself however he did have issues with the location of the dumpster enclosures where they previously were as he felt there was no need to have them at this location and that he had to go to the Common Council to have the matter addressed. He continued with discussion on the noise generated from the use of the dumpsters and stated that this was irresponsible action on the part of the University. ITEM- 608 Algoma E. \lend CUPIPD 8 Mr. Nollenberger stated that he felt that the University addressed the situation satisfactorily and he would support the amendment with the additional three conditions discussed. Motion by Nollenberger to approve an amendment to a conditional use permit/planned development for the university re -use of former Lincoln Elementary School site at 608 Algoma Boulevard with the following conditions: 1. Parking lot shall be reconstructed to meet current code requirements by the end of calendar year 2017. 2. Wisconsin Street driveway has "right in — right out configuration by the end of calendar year 2017. 3. Plans for the parking lot reconstruction shall be reviewed and approved by the Plan Commission prior to any zoning permit issuance or site reconstruction commencing on the subject property. d.
