PURPOSE: APPROVE CONDITIONAL USE PERMIT AND PLANNED
DEVELOPMENT AMENDMENT FOR AN OUTDOOR CEREMONY
AREA LOCATED AT 3125 SOUTH WASHBURN STREET

WHEREAS Common Council previously approved a planned development
authorizing construction of an 11,000 square foot banquet hall; and
WHEREAS the applicant desires to expand the use to include an outdoor
ceremony area to the west of the existing banquet hall.
NOW THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh that a conditional use permit to amend a previously approved planned
development for an outdoor ceremony area, per the attached, is hereby approved with
the following conditions:
1) Lot with proposed development be combined with 3125 South Washburn Street.
2) Identified pedestrian path be installed from the outdoor ceremony area to the
existing indoor banquet hall.

Commission Recommends Approval)
BACKGROUND
The area included in the request consists of two parcels totaling approximately 3.7 acres at
3125 South Washburn Street, just south of the intersection of West Waukau Avenue and
South Washburn Street. The subject site, La Sure's Banquet Hall, is bounded by a
commercial retail shopping center (Outlet Shoppes) on the north, automotive sales
(Bergstrom) on the south, Interstate 41 on the east and mini - warehouse storage on the west.
The subject site currently has an M -1 PD, Light Industrial District zoning designation with
Planned Development and Highway 41 Corridor Overlays. In 2001, a Conditional Use Permit
(CUP) /Planned Development (PD) was approved to construct an 11,000 square foot indoor
banquet hall and 77 room hotel. Over the last 15 years the hotel and banquet center have
operated within the original parameters of the original CUP /PD approval and conditions.
ANALYSIS
This request involved the issuance of a CUP /PD amendment for the expansion of the existing
banquet use and approval of a development plan for an outdoor ceremony area. The
proposed outdoor ceremony area is approximately 100' x 90' (9,000 square feet) in size.
Stone pathways run throughout the proposed development and are contained by a 6 foot tall
fence. A storage building is proposed to be located on the south, just outside of the fenced in
ceremony area, and will be 12' x 28' (336 square feet) in size. The development plan also
includes construction of an open pergola, which will be constructed of composite wood with
natural stone base and stairs, rounded pillars and wrought iron railings. A decorative seat
wall and fountain will be located west of the proposed open pergola. Vehicular access to the
development is proposed to continue from two existing driveways located on the adjacent
property, 3105 South Washburn Street, which enter from South Washburn Street and West
Waukau Avenue. To ensure cross access between 3105 and 3125 South Washburn Street
continues, the lot that contains the proposed development will be combined with 3125 South
Washburn Street. As proposed, pedestrian access is not provided from the proposed outdoor
ceremony area through the existing parking lot to the building's rear entrance. Staff is
recommending an identified pedestrian path be installed from the outdoor ceremony area to
the existing indoor banquet hall to ensure pedestrian safety. Other site improvements include
extensive landscaping throughout the proposed outdoor ceremony area. The proposed
development plan is intended to increase the business traffic and viability of the existing
banquet hall and enhance the existing vacant parcel which is currently unsightly and not
being maintained.
FISCAL IMPACT
Approval of the CUP and Development Plan will not require the expansion of city services
that are being already provided to this site.
RECOMMENDATION
The Plan Commission recommended approval of the conditional use permit/planned
development amendment at its July 5, 2016 meeting.

GENERAL INFORMATION

Action(s) Requested:
The applicant is requesting a Conditional Use Permit (CUP)/Planned Development (PD)
Amendment to Resolution 01 -174 to allow expansion of a previously approved Planned
Development authorizing construction of an 11,000 square foot banquet hall. The applicant is
proposing an expansion of the existing banquet facility to include an outdoor ceremony area.
Applicable Ordinance Provisions:
The Zoning Ordinance establishes criteria and guidelines for establishment and /or amendment of
a Conditional Use Permit in Section 30- 11(D). The site is also located within a Planned
Development Overlay District, which standards are located in Section 30- 33(E)(3) of the Zoning
Ordinance.
Property Location and Background Information:
The subject property is located at 3125 South Washburn Street, just south of the intersection of
West Waukau Avenue and South Washburn Street. The existing lots contain approximately 3.7
acres or 164,308 square feet and have an M -1 PD, Light Industrial District zoning designation
with Planned Development and highway 41 Corridor Overlays.
On April 24, 2001, a Conditional Use Permit (CUP)/Planned Development (PD) was approved to
construct an 11,000 sq. ft. banquet hall, installation of a 13'x 3.5' wall sign on the banquet hall,
and a 0 ft. side yard setback between the proposed banquet hall and parking lot, and the hotel
and parking lot on a separate parcel to the north along South Washburn Street. The Planned
Development was approved with the following conditions:
1. A certified survey map must be used to divide the land.
2. A cross access and cross parking agreement be submitted to, and approved by, the City of Oshkosh
and recorded with the Register of Deeds.
3. No additional driveways from the public right -of -way to the subject lots be allowed without
approval by the City of Oshkosh.
4. State approval be obtained for all issues involved with constructing a building with a Oft. setback
prior to obtaining a building permit from the City of Oshkosh.
5. A revised landscape plan to address the additional developed area and parking be submitted to, and
approved by, the Dept. of Community Development.
6. No additional signs be allowed on the site unless the development plan is revised and approved by
the City of Oshkosh.
7. A 15 ft. side yard setback must be maintained on the south side of the proposed lot containing the
banquet hall and parking lot.
To date, all conditions for both Planned Development approvals have been met.

ANALYSIS
The proposed development plan is located west of the existing banquet hall located at 3125 South
Washburn Avenue. The petitioner and owner, B &B Catering, LLC, is proposing an expansion of
the existing indoor banquet facility to include an outdoor event area. The applicant has stated that
the proposed development is intended to increase the business traffic and viability of the existing
banquet hall and enhance the existing vacant parcel which is currently unsightly and not being
maintained. The proposed development will include construction of an open pergola structure
and ceremony seating area, landscaping and security lighting, perimeter fencing, storage building
and site landscaping.
Design/Layout
The proposed outdoor ceremony area is approximately 100' x 90' (9,000 square feet) in size. Stone
pathways run throughout the proposed development and are contained by a 6 foot tall fence. A
storage building is proposed to be located on the south, just outside of the fenced in ceremony

were not provided with the application submittal but will be required to meet code which will be
analyzed during the site plan review process. The open pergola will be constructed of composite
wood with natural stone base and stairs, rounded pillars and wrought iron railings. A decorative
seat wall and fountain will be located west of the proposed open pergola.
Access Narking
Vehicular access to the development is proposed to continue from two existing driveways located
on the adjacent property, 3105 South Washburn Street, which enter from South Washburn Street
and West Waukau Avenue. To ensure cross access between 3105 and 3125 South Washburn Street
continues, the lot that contains the proposed development will be combined with 3125 South
Washburn Street.
As proposed, pedestrian access is not provided from the proposed outdoor ceremony area
through the existing parking lot to the building's rear entrance. Staff is recommending pedestrian
access be installed from the outdoor ceremony area to the existing banquet hall via a protected
sidewalk and /or striping to ensure pedestrian safety.
Landscapingjighting6torm water Management
A landscape plan has been submitted with the proposal which includes a number of shrubs,
perennials and trees located throughout the proposed development. A total of 34 deciduous and
ornamental trees and 84 shrubs are proposed, while only 3 trees and 9 shrubs are required by
code.
A lighting andlor photometric plan was not included with the application material. All light
levels will be required to meet code requirements and will be further reviewed during site plan
review process.
A site grading plan, erosion control and storm water management plan was not included within
the application material and will be required to be reviewed and approved by the Department of
Public Works as part of regular site plan approval.
RECOMMENDATIONS/CONDITIONS
Staff recommends approval of the Planned Development for expansion of the existing banquet
facility to include an outdoor ceremony area, with the following conditions:
1) Lot with proposed development be combined with 3125 South Washburn Street.
2) Identified pedestrian path be installed from the outdoor ceremony area to the existing
indoor banquet hall.
The Plan Commission approved the Planned Development for expansion of the existing banquet
facility to include an outdoor ceremony area as requested with conditions. The following is the
Plan Commissions discussion on this item.
Ms. Williams stated the applicant is requesting a conditional use permit and planned

development review of a proposed outdoor ceremony area behind Lasure's Banquet
Hall at 3725 S. Washburn Avenue. Phase I of the proposed outdoor ceremony area is
about 100' x 900' in size. Stone pathways run throughout the development and are
contained by a 6 ft. tall fence. A storage building is proposed to be located on the south.
An open pergola will be constructed of composite wood. It appears parking will be
provided behind Lasure's and the adjacent Hotel. Future phases may include an open
sided /covered reception area and parking lot expansion. Pedestrian access is not being
provided. However, staff is recommending pedestrian access be installed from the
outdoor ceremony area to the existing Banquet Hall. A landscape plan has been
submitted which exceeds the requirements of the Ordinance.
Mr. Thorns stated 2 access points are shown — one off Waukau and one off Washburn.
Ms. Williams stated existing access will not be changed so there will not be any changes
to the cross access agreement.
Mr. Thorns inquired about compliance with storm water management requirements.
There does not appear to be any additional parking lot proposed; only pedestrian traffic.
Mr. Steve Gohde, Department of Public Works, stated storm water management will be
reviewed at the time site plans are submitted for review. He seemed to recall an existing
bio -swale that could serve this site.
Ms. Lohry inquired about the capacity and if the development could be used for other
than ceremonies. Possible concerns with noise, lights, etc. for the adjacent residential
properties.
Ms. William stated the applicant has indicated a capacity of 250 and that the area would
be used for wedding ceremonies and receptions.
Mr. Burich stated staff can monitor the site and if additional activities occur, a decision
can be made if additional reviews/approval is required,
Mr. Bob Heisler, from LaSure's, stated at this time, the use will be strictly for the banquet
hall and only for ceremonies.
Motion by Nollenberger to move approval of a conditional use permit for the planned
development of an expansion of the existing banquet facility to include an outdoor
ceremony area with the following conditions:
1) Lot with proposed development be combined with 3125 S. Washburn Street.
2) Identified pedestrian path be installed from the outdoor ceremony area to the existing
indoor banquet hall.

NARRATIVE (Note: This applies to the submitted general application and the submitted planned
development review application.)
This proposed project is to increase the business traffic and viability of LaSure's existing banquet
hall. Numerous wedding ceremonies and receptions are being done in outdoor facilities which is
limiting the use of the existing banquet facility. With the creation of an outdoor ceremony area
this is anticipated to again increase the use of the existing banquet facility. When the outdoor
banquet facility is added, this will possibly allow multiple events to occur if the need would arise.
The area being proposed for this development is currently a vacant parcel which is currently
unsightly and not being maintained, Development of this parcel will clean up the existing
conditions and be more visually appealing to the adjoining properties.
The use of the proposed structures would primarily be on the weekends, but some week day
events may occur on occasion. The first phase will create a large fenced and well landscaped
area with a pergola ceremony structure. Also in the first phase will be a small enclosed storage
building for storage of movable furnishings and lawn maintenance equipment. In a future phase,
an open sided /covered receptions area with toilet facilities will be created along with additional
parking for this new facility to allow simultaneous events with the current banquet facility. This new
outdoor area would be used from approximately late April to mid - October. This area would not
be used in winter.
The new area is being designed to accommodate approximately 250 guests, but many events
would likely be fewer. For the first phase of development (open ceremony area), the existing
banquet facility parking area would be used since no concurrent events would take place.
Surrounding land uses are retail (outlet mall) to the North, mini - storage units to the West, car
dealerships to the South and the existing Hotel /Banquet Hall /Hwy 41 to the East. This development
would not create any adverse effects on any of the adjoining properties. This use is compatible
with the current adjoining activities in this area. With the first phase of development, no additional
traffic should be created than current uses. With the second phase, there could be additional
traffic volume, but with this facility used primarily on weekends this should not cause any additional
traffic issues on the adjoining streets.
