MAIN, LLC PLAN COMMISSION RECOMMENDATION: Found consistent with Standards set forth in Section 30-11(D) of the Zoning Ordinance and approved w/conditions WHEREAS, the applicant desires to install a hand painted sign, greater than 32 square feet, to be placed higher than 18 feet above grade and above the second floor window sill at 531 North Main Street; and WHEREAS, the Plan Commission recommends approval of the above requested exception to the provisions of the Downtown Overlay District NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit is hereby approved under Section 30-11 of the Oshkosh Zoning Ordinance for an exception to the provisions of the Downtown Overlay District as noted above. The three -story brick building is historically known as the Frank Percey Gun and Fur House which is now the location of the Dealersocket business. It was designed for Frank Percey's business by local architect E.E. Stevens and constructed in 1900 and 1907. Originally, the first floor was used for the sale of guns and ammunition and the upper floors were for the preparation and shipping of raw furs. It is a commercial vernacular building and has consistently been used for retail or service uses. The building has been sensitively maintained over the last 100 -plus years and is considered a pivotal structure within the National and State Register of Historic Places - North Main Street Historic District (Listed in 1996). ANALYSIS The petitioner is requesting approval for the Dealersocket sign on the east side of the south fagade of the subject property that is painted onto the building fagade and exceeds the maximum size and height requirements for signage in the Downtown Overlay. The sign consists of four foot high lettering running 30 feet vertically with a black border extending vertically 45 feet to the top of the structure and was intended to be consistent with the historical signage that had existed on this building in the early 1900's. Staff believes that the proposed signage is consistent with the conditional use permit standards as it will help to preserve and restore the unique quality of the historic building. The proposal has also been reviewed by the Oshkosh Landmarks Commission and has been recommended for approval as it is historically accurate and will add to the historical character of the structure. FISCAL IMPACT Approval of the signage as proposed will require no provision of city services and thus will no fiscal impact. RECOMMENDATION The Plan Commission recommended approval of the conditional use permit at its June 21, 2016 meeting. Main, LLC Action(s) Requested: The applicant is requesting approval of a conditional use permit for an exception to the signage standards of the Downtown Overlay District to allow a hand painted sign, greater than 32 square feet in size, to be placed higher than 18 feet above grade and above the second floor window sill. Applicable Ordinance Provisions: Zoning Ordinance Section 30- 27(D)(3)(f) states that signs hand painted on the building elevations in the Downtown Overlay will be allowed only with the approval of the Plan Commission and Common Council. Section 30- 27(D)(6) restricts wall signage in the Downtown Overlay to a maximum size of five percent (5 %) of the total square footage of the building fagade or thirty -two (32) square feet, whichever is less. The Zoning Ordinance establishes criteria and guidelines for establishment and /or amendment of a Conditional Use Permit in Section 30- 11(D). The sign consists of roughly 4 foot high lettering running about 30 feet vertically (120 square feet total), with a black border running vertically about 45 feet to the top of the building on the east side of the south facade. In their application, the petitioner states that the sign was intended to be consistent with the historical signage that had existed on this building and was designed to match the sign that had been on the same facade for Percey's Fur House in the early 1900's. The petitioner also notes that the sign location is advantageous as it is highly visible for north bound traffic on Main Street. The application includes an advertisement with a rendering of the subject building as well as a photograph (attached) that depicts the signage that has historically been located on the south side facade. The proposed sign is very similar to that which is depicted in the historical rendering (also shown on a historical photo found by staff), which runs the height of the building on the east side of the facade. Additionally, the historical photograph in the application includes a sign in the same general area on the facade which is also located near the top of the building. Because the sign is consistent with the history of the building, staff believes that the proposal meets the criteria for an exception to the Downtown Overlay Standards as the sign will help to preserve and restore the unique quality of the historic building and enhance the character and appearance of the historic business district. The Oshkosh Landmarks Commission has reviewed the proposal and feels that the sign is historically accurate and will not detract from, but add to, the historical character of the building. RECOMMENDATION /CONDITIONS Staff recommends a finding that the proposed conditional use permit request for an exception to the signage standards of the Downtown Overlay District is consistent with Section 30 -11(D) of the Zoning Ordinance and be approved as proposed. The Plan Commission approved of the conditional use permit as requested. The following is the Plan Commission's discussion on this item. Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He discussed the history of the site and reviewed a photo of the sign which he stated was consistent with the historical sign that was in the same location on the building when it was originally constructed. He reviewed a photo of the building from the 1920's depicting the original signage on the structure and stated that the Landmarks Commission had reviewed and recommended approval of the signage as it is historically accurate. Main Street. Seconded by Propp. Ms. Propp commented that she liked the look of the new signage. Mr. Hinz agreed however he would have preferred to see the vertical lettering on the current sign to be more similar to the original historical lettering of the original signage. Motion carried 6 -0.
