PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to accept easements for the installation
of sidewalk, traffic/ pedestrian signals, and related equipment at the intersection of
Oshkosh Avenue and North Westfield Street, per the attached, and to execute any and
all documents necessary for purposes of same.

BACKGROUND
The subject site consists of four privately -owned properties located at the intersection of
Oshkosh Avenue and North Westfield Street. The general area consists of commercial and
residential uses.
ANALYSIS
The City is requesting acceptance of three easements for installation of sidewalk,
traffic /pedestrian signals and conduits in conjunction with the reconstruction of N. Westfield
Street. The Department of Public Works has been working with property owners adjacent to
construction projects to obtain the necessary easements to construct Americans with
Disabilities Act compliant handicap ramps and crosswalks. The easement will allow for the
installation of related equipment and will include sidewalk installation to improve the
crosswalk alignment. The Department of Public Works will work with the property owners to
have appropriate easement documents signed and recorded at the Winnebago County
Register of Deeds.
FISCAL IMPACT
No fiscal impact is anticipated resulting from accepting these easements.
RECOMMENDATION
The Plan Commission recommended approval of the acceptance of the easements at its May
17, 2016 meeting.

GENERAL INFORMATION

Actions Requested:
The City of Oshkosh is requesting acceptance of three easements for the installation of sidewalk,
traffic /pedestrian signals, and conduits.
Applicable Ordinance Provisions:

Property Location and Background Information:
The subject site consists of four privately -owned properties located at the intersection of Oshkosh
Avenue and North Westfield Street. The general area consists of commercial and residential uses.
ANALYSIS
The City's Engineering Division has been working with property owners adjacent to construction
projects to obtain easements for the installation of sidewalk, traffic /pedestrian signals, and related
equipment. These easements are necessary in order to allow the City to construct Americans with
Disabilities Act compliant handicap ramps and crosswalks.
These improvements are related to the reconstruction of N. Westfield Street. The easements are
necessary to allow for installation of poles, bases, and conduit on private property and include
sidewalk installation to improve the crosswalk alignments.
The Department of Public Works will work with the property owners to have appropriate easement
documents signed and recorded at the Winnebago County Register of Deeds.
RE COMMENDATION /CONDITIONS
Staff recommends approval of the acceptance of the proposed easements as requested.
The Plan Commission approved the acceptance of the proposed easements as requested. The
following is the Plan Commission's discussion on this item.
Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the locations
of the proposed easements. He explained the reason for the easement request which was to
construct Americans with Disabilities Act (ADA) compliant handicap ramps and crosswalks in
conjunction with the reconstruction of N. Westfield Street. He also reviewed the site plan
depicting the easement locations.
Mr. Gray questioned if the Commission could deny such a request as it was for ADA compliance.
Mr. Burich responded that if the City would not approve the acquisition of the easements, the City
would then have to acquire the property instead.
Motion by TVajgrt to approve the acceptance of easements at the intersection of Oshkosh
Avenue & N. Westfield Street.
Seconded by Gray. Motion carried 7 -0.

Accept Easements, Various Locations
The Engineering Division has worked with property owners adjacent to construction projects to obtain
easements for the installation of sidewalk, traffic /pedestrian signals and related equipment. The
easements will allow the City to construct American with Disabilities Act compliant handicap ramps and
crosswalks.
The first locations are at the intersection of Congress Ave, Summit Ave and Arboretum Dr. The handicap
ramp and crosswalk improvements were requested by the Bicycle and Pedestrian Advisory Committee.
The easements are primarily documenting'existing verbal agreements with property owners for
installation of poles, bases and conduit on private property and have been expanded to include to allow
sidewalk installation to improve the crosswalk alignments.
The second locations are at the intersection of Oshkosh Ave and Westfield St. These improvements are
related to the reconstruction of Westfield St. The easements will allow for installation of poles, bases
and conduit on private property and include sidewalk installation to improve the crosswalk alignments.
