PURPOSE: APPROVE CONDITIONAL USE PERMIT AND PLANNED
DEVELOPMENT FOR A LIMITED VENUE FESTIVAL SITE;

PLAN COMMISSION RECOMMENDATION: Found consistentwith Section 30-11(D) and

BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit for the planned development of a limited venue festival site that
includes substantial area for parking, camping and festival/midway use with stages and
vendors, per the attached, is hereby approved with the following conditions:
(1) The CUP/PD for the use of the site for festival and concert events expires
in 2026;
(2) Two events (CUSA and Rock USA) are allowed per calendar year not to
exceed seven days in duration for any one event;
(3) Any events over the two listed above require separate review and
approval by the Oshkosh Police and Fire Departments and the
Department of Community Development;
(4) Other than use of the site seven days prior and seven days after an event,
no open storage is permitted;
(5) Access control variance is granted to allow the driveway from South
Washburn Street to exceed 35 feet and be consistent with the submitted
site plan;
(6) Base standard modification is granted to allow the driveway located
outside of the right-of-way to remain unpaved;
(7) Mud/debris tracked from the subject property to City right-of-ways shall be
removed within 24 hours of the end of the daily event. Failure to do so
may result in the City performing the work and charging costs back to the
event organizer, property owner or both;
(8) Base standard modification to allow unpaved parking and internal drives
in accordance of the submitted plans;
(9) A Traffic, Pedestrian Safety, Security, and Lighting Plan is submitted
annually to Oshkosh Police Department for review and approval subject
to reasonable conditions of approval;

(10) A Health Plan is submittal annually to Winnebago County Health
Department for review and approval subject to reasonable conditions of
approval;
(11) All plans are submitted no later than March 15 of each year to allow the
respective agency sufficient time to complete review;
(12) The event organizer shall post a bond in an amount deemed sufficient by
City staff to ensure compliance with the plans or enter into separate
agreement(s) with the City to compensate for public costs incurred;
(13) Event grounds, including parking and camping areas be monitored for
refuse and appropriate means of continual collection as noted in the
Health Plan; and
(14) The City retains the ability to re-review the terms and conditions of the
CUP as needed to ensure public safety.

BACKGROUND
In 2006, the Country USA event was relocated from the County's Sunnyview Park grounds
on the northeast side of the City to the newly created Ford Festival Park on the City's
southwest side at the southwest corner of Ripple Road and South Washburn Street. The
property containing the festival grounds is comprised of approximately 260 acres of land
owned by multiple owners and is located in both the City of Oshkosh and Town of Nekimi
with the vast majority of the subject properties located within the Town. The Conditional Use
Permit/Planned Development request was granted on July 26, 2005, with conditions including
but not limited to a 2016 CUP /PD expiration date and mid -use review. In 2011, the petitioner
returned to the Plan Commission and Common Council for a required mid -use review
primarily to determine if any additional conditions would be needed to improve the operations
of the events. An approval for the continued use of the CUP /Planned Development was
approved on July 13, 2011 with additional conditions. It is now 2016 and the CUP /PD expires
so this request is being made to re- establish (re- issue) the CUP /PD.
ANALYSIS
Ford Festival Park is a large "festival" site with segregated areas for parking, camping, and
fairgrounds and hosts two national attractions, Country USA and Rock USA, which have
been very successful, with a permitted US Open Grass Volleyball tournament taking place
only a few years. The primary events attract daily attendance of 40,000 and 23,000 people
daily respectively with 2,500 and 2,200 rented campsites on site. The area within the City's
jurisdiction involves 64 acres out of the total 260 acres containing the main entrance, festival
grounds signage, waterfall feature, parking and campgrounds. The City's Comprehensive
Plan identifies the City area for commercial purposes and the Town area for residential uses
however the petitioner has received approvals from the Town of Nekimi and Winnebago
County for the festival site use on the town parcels with a new negotiated 10 year lease and
staff is recommending a condition be placed on this event approval to correspond with the
lease agreement expiring in 2026. The approval is for the two identified events limited to 7
days each with more intense use of the site requiring review and approval of both the Police
and Fire Departments. Access to the venue site is provided via 4 driveways with only one
located within the city which requires an access control variance be reinstated as it exceeds
the maximum driveway width. Due to concerns with tracking of mud and debris from the site
to the street as it contains unpaved internal drives and parking, a condition is recommended
that mud /debris be removed within 24 hours of the end of the event daily. The use has been
monitored by the City and County during the past 10 years and in 2011 a safety improvement
plan was implemented addressing additional lighting, reduced speed limits, caution lighting
message boards, and enhanced law enforcement in addition to shuttle /bus contracts for
transportation to the festival grounds from other locations. Conditions also require that a
"Traffic, Pedestrian Safety, Security, and Lighting Plan" and a "Health Plan" be submitted to
the Police and Health Departments on an annual basis and that the City retains the ability to
re- review the terms and conditions as needed to ensure public safety.
FISCAL IMPACT
CUSA and RUSA demand a significant amount of city services relative to having police and
fire coverage at the events for which the city is reimbursed for overtime costs.
RECOMMENDATION
The Plan Commission recommended approval of the conditional use permit/planned
development at its May 17, 2016 meeting.

It should be noted that Ford Festival Park is located within two different jurisdictions with festival
activities such as the concert stages and concession stands located in the Town ofNekimi and
under Winnebago County Zoning jurisdiction. Activities located within the City are camping,
parking, and ingress /egress.

Action(s) Requested:
Starshow Presents, Inc. is requesting approval of a Conditional Use Permit /Planned Development
for a limited venue festival site (Ford Festival Park) located in the City of Oshkosh and Town of
Nekimi with ingress /egress, parking and camping uses located within the City portion of the site.
Applicable Ordinance Provisions:
Outdoor entertainment uses are permitted through a Planned Development in the M -1PD Light
Industrial District with Planned Development as regulated in Section 30 -28 of the Zoning
Ordinance. Criteria used for Conditional Use Permits are located in Section 30 -11 and criteria for
Planned Developments are located in Section 30 -33 of the Zoning Ordinance.

ANALYSIS
Ford Festival Park is a large "festival" site with segregated areas for parking, camping, and
fairgrounds where the main concert and vending activities will take place. The festival grounds
have been in operation for 10 years and have annually hosted national attractions Country USA
(country music festival) and Rock USA (classic rock music festival) with a permitted third event
taking place multiple years. Both primary events have been very successful with Country USA
attracting an average daily attendance of approximately 40,000 people with 2,500 campsites rented
on -site and Rock USA attracting an average daily attendance of approximately 23,000 with 2,200
campsites rented on -site. Both events also have about 1,000 event staff on the grounds daily.
This request involves the (re)approval of the limited "venue" festival site that includes substantial
area for parking, camping, and the "festival /midway" use with stages and vendor areas. The area
within the City's jurisdiction includes approximately 64 acres out of the total 260 acres stretching
about 1/4 mile west from Washburn Street. The area within the City of Oshkosh contains the main
entrance, festival grounds signage, entrance waterfall feature, parking and campgrounds.
The City's Comprehensive Plan identifies the area within the City for commercial purposes and
identifies areas to the west, currently in the Town, for residential development. Starshow Presents,
Inc. has worked with and received approvals from the Town of Nekimi and Winnebago County for
the limited "venue" festival site on properties not within the City limits and the event organizers
have negotiated a new 10 year lease. Staff does not feel that the use of the subject property for an
additional 10 years is going to have a long -term negative impact on the City's potential growth
into this area as the closest commercial development is about 1/4 mile away and closest residential
development is more than 1/2 mile to the north however staff is recommending a condition be
placed on the CUP/PD that it expires in 2026 to correspond with the organizers lease agreement.
As with the original CUP /PD, staff is again recommending approval of a limited number of events
at the site. Country USA and Rock USA have been and remain the main events and are the
primary reason for creation of the festival grounds. The original CUP /PD allowed a third event
that was not regularly utilized. Additionally, there have been discussions with the petitioner that

an additional three or more unknown events are desired but are yet to be established. Staff feels
that additional festivals /events over the two known, with unknown details, will require additional
analysis and potentially site improvements or operational modifications. As such, staff is
recommending that only two events including Country USA and Rock be approved for use on the
site per year and the duration of the events be limited to no longer than 7 days each. As the events
at the festival grounds can be a very large scale and potentially create a significant impact on the
City and County's ability to provide service (primarily police and fire /EMS service) to not just the
event itself but the city as a whole, staff believes giving carte blanche for additional events without
knowing what they will be is not supportable and therefore recommends that any events over the
two listed require separate review and approval of both the Police and Fire Departments based on
considerations such as the type of event, timing, size /expected attendance, staffing requirements,
and availability of equipment (lighting, squads, barriers, fire equipment, rescue equipment, etc).
Access to the venue site comes from 4 driveways, three on Ripple Road and one on South
Washburn Street. Washburn Street is the only drive located within the city limits and serves as the
primary access point for parking of non - campers. As originally approved and constructed, this 100
foot wide entrance exceeds the maximum driveway width of 35 feet so an Access Control
Variance must be reinstated within the new Planned Development, as it was originally in 2006.
Additionally, driveway paving is limited to only the approach /apron to the festival grounds so the
remainder of the entrance drive and driveway are gravel surfaced, again requiring a base standard
modification. The City has historically been concerned with tracking of mud and debris from the
site to the street, especially when substantial rain events have taken place and staff recommends
including the condition that all mud and debris tracked from the subject property to City right -of-
ways be removed within 24 hours of the end of the daily event and failure to do so may result in
the City performing the work and charging associated costs back to the event organizer, property
owner, or both. The other accesses to the site involve a main point of ingress /egress for camping
traffic and two others for entertainers and staff for the festival event. These accesses are under
jurisdiction of the Town of Nekimi and Winnebago County.
The areas used as parking and camping on the site are seeded similar to other festival grounds such
as the County Park and due to the limited use nature of the site, is not unusual. If it was the
petitioner's desire to more actively utilize the site for weekly or monthly concert type or large
scale venues, staff would recommend areas of hard surfacing. A base standard modification is
again needed to allow unpaved parking surfaces.
During the 10 years of operation, the use has been monitored by the City and County. At the 2011
mid -use review, five years after initial establishment, several concerns were identified as
problematic and multiple meetings took place between City and County staff and the operators of
the festivals where agreement was reached to implement a safety improvement plan that includes:
(1) Providing additional lighting on South Washburn Street along the frontage of the festival
grounds property to increase visibility and safety to pedestrians and motorists;
(2) Temporarily reduce speed limits to 25 mph to help calm traffic by simply covering existing
signs or putting up new ones during events;
(3) Caution lighting in the form of temporary message boards are utilized to help inform
motorists of the speed limit and to designate that pedestrians will be present; and
(4) Enhanced law enforcement presence to be used as pedestrian and traffic regulators.

Additionally, the event organizers have worked with local campgrounds and "satellite" parking
lots on shuttling/bus contracts to the festival grounds and they have also implemented a "safety
band" program charging an additional fee for event goers who choose to park off -site rather than
on the grounds themselves.
Other items that were added to the original CUP /Planned Development in 2011 included the
annual preparation of a "Traffic, Pedestrian Safety, Security, and Lighting Plan ", a "Health Plan ",
bond being posted to ensure compliance with the plans, event grounds be monitored for refuse
collection, stipulation that dirt and debris tracked onto right -of -way be removed, and that the City
retain the ability to re- review the terms and conditions of the CUP /PD as needed to ensure public
safety.
Staff is once again recommending approval of the CUP /PD for the site and is incorporating all of
the needed base standard modifications and previous conditions of approval within the
recommendation of this CUP /PD approval.
RE COMMENDATION /CONDITIONS
Staff recommends a finding that the CUP/PD find the request for a limited venue festival site is
consistent with Section 30 -11(D) of the Zoning Ordinance and the request be approved with the
following conditions:
(1) The CUP /PD for the use of the site for festival and concert events expires in 2026;
(2) Two events (CUSA and Rock USA) are allowed per calendar year not to exceed
seven days in duration for any one event;
(3) Any events over the two listed above require separate review and approval by the

The Plan Commission approved the CUP/PD for a limited venue festival site as requested with
conditions noted. The following is the Plan Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the land use and
zoning classifications in this area. He discussed the history of the site and reviewed the area that is
within the City's jurisdiction and within the Town /County's jurisdiction. He explained that the
site has had a conditional use permit approved for this use which was due to expire this year and
discussed the festival events included in this approval. He discussed the City's Comprehensive
Plan that recommends commercial use for the City portion of the site and residential use for the
portion located within the Town and that the petitioner had recently negotiated a new 10 -year lease
for the continued use of the property for this purpose. He explained that the approval of the
CUP/PD would also be a ten -year time frame and would be limited to the two established events
and any additional events would require separate review and approval of both the Police and Fire
Departments and the Department of Community Development based on considerations such as the
type of event and other aspects relating to it to ensure the City would be able to provide the
necessary services to support the event. He discussed the accesses to the site and the uses that
would occur on the City's portion of the site and the various conditions added over the years of
operation and review. He also reviewed the conditions recommended for this request as well as
the site plan of the layout of the festival grounds.
Mr. Nollenberger questioned what the purpose was for the ten year expiration of the CUP /PD.
Mr. Buck responded that it coincides with the lease agreement the petitioner negotiated for the use
of the site with the property owners and the City may also need to address this use in the future if
development would occur in this area.
Mr. Gray questioned who the respective agencies that were referenced in condition 911 who would
be reviewing the necessary annual plans required to be submitted.
Mr. Buck responded that the agencies that review the annual plans would be the Oshkosh Police
Department, the Winnebago County Health Department and the Department of Community
Development.
Mr. Gray commented that he felt that condition 914 relating to the City's ability to re- review the
terms and conditions was too vague as it did not provide a time frame and it states that it was to
ensure public safety and he felt it should not be related to public safety only.
Mr. Burich responded that we already have a 10 year history on the site and that we probably don't
need another shorter term re- review because there are other conditions in place to address the
safety issues. Also since the CUP /PD has an expiration date of 2026 therefore it was not necessary
to include a date in this condition.

Existing and proposed use mf the property:
Country USA and Rock USA have been operating on the property for the last 10 years very successfully.
Storshovx Presents Inc, which runs both festivals, has a long history of working with local government to
address any issues which arise in a fast and satisfying manner. 3tarshovvPresents Inc. operates Country
USA which has an average daily attendance of 40,000 people with an average of 2,500 campsites being
rented on the site. Rock USA has a daily attendance of 23,000 people with an average of 2,200
campsites. In the area this CUP encompasses, we have campsites and a parking operation which can
park O,0OU cars daily. We would continue to use the property in the same fashion as we have described
above with no plans of making any changes in the foreseeable future to this area. Country USA and
Rock USA are national attractions which draw people from all over our country and others.

The main entrance ofFord Festival Park, where the festivals are held, b blacktop per the conditions
which were listed in our prior CUP. VVe have significant oi0naQeon our property directing vehicle and
pedestrian traffic to keep as much traffic off of the main roads as possible. VVe would continue touse
the infrastructure and si8naAe currently in place through our next CUP. VVeof course will take any
recommendations from the City of Oshkosh and evaluate how we can make the festival experience
better for all involved.
Projected number of residents, employees, daily customers:
Country USA has a daily attendance of approximately 40,000 people per day, while Rock USA has a daily
attendance of approximately 23,000 people per day. We estimate we have another 1,000 employees
and contract staff on the grounds each day of the festival.
Proposed amount mf dwelling units, floor area, landscape area, and parking area expressed in square
feet and acreage tm the nearest one-hundredth mfenacre:
The property located in the City of Oshkosh is about 63 acres which has camping and parking operations
located within the acreage. There ioo significant waterfall with a pond and landscaping at the entrance
to the property where pedestrians and vehicles enter our festival grounds. There are nopermanent
structures on the property within the City of Oshkosh and nothing is planned in the foreseeable future.
Effects onadjoining properties to include: noise, hours of operation, glare, odor, fumes, vibration, etc.
The actual festival is held in the Town of Nekimi and we are under restrictions on hours of operation for
our music with Winnebago County and the Town ofNekinni. VVe are made aware of concerns involving
noise from our concerts and address them in the best way xve are able to. We have no control over the
sound system for the national acts we bring to all of our customers who come to the festival due to
contract language. We have worked on speaker placement on our festival site to assist with this for
several years now. A large part of the music traveling from our site has to do with wind speed and
direction which vve have no control over. VVe work closely with Law Enforcement Officials towork to

address any issues that arise with our festivals. VVe make every attempt to deal with all complaints from
customers, neighbors and City staff.
Compatibility mfthe proposed use with adjacent and other properties in the area:
The use of the property for Parking Operations and Camping operations has been very compatible with
the other properties in the area. There have been nn problems raised with our operation impacting
other operations. VVe bring a significant amount of tourists to the area who patronize the local
businesses frequently.
Traffic generation (anticipated number of customers, deliveries, employee shift changes, etc):
We have a large influx of traffic during the evening hours of our events due to the national acts that are
playing on our stages. We have worked closely with the Oshkosh Police Department, Oshkosh Public
Works, City Planning, Winnebago County Sheriff as well as Officials with the Town of Nekimi to make our
event as safe os possible for those attending. VVe have a number of people who choose to park inother
parking lots off of our property and walk into our festival site which has made us evaluate the safety of
those walking. We have added significant lighting on Washburn Ave., added several Police Officers to
patrol and worked with the City of Oshkosh and Public works to change the speed limit on Washburn all
for the safety of those attending our events. We have added electric sign boards on Washburn to
remind people of pedestrians and the lower speed limit. VVe have worked with local campgrounds on
shuttling contracts to our property. VVe have also implemented a "Safety Band" which costs people who
choose not to park in the safest location (our property) an additional $5.00 to buy the band which is
provided free of charge for up to 6 people who are paying for parking on our property. All ofthese
items were implemented to make sure safety is a top priority for our customers.
We have contingency plans in place and work with the Oshkosh Police Department on our satellite
parking operations should our parking not be sufficient to handle parking on any given day. We also
have contracted bus service in place to handle transportation from the predetermined sites to the
festival so safety isa primary focus for usin many ways.
