HomeMy WebLinkAbout04. 16-244 MAY 24, 2016 16-244 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE SPOT BLIGHT DESIGNATION; AUTHORIZE REDEVELOPMENT AUTHORITY TO ACCEPT DONATION OF PROPERTY AT 458 WEST 6T" AVENUE INITIATED BY: COMMUNITY DEVELOPMENT REDEVELOPMENT AUTHORITY RECOMMENDATION: Approved WHEREAS, the Redevelopment Authority of the City of Oshkosh was created to assist in the elimination and prevention of blight and blighting influences and to promote urban renewal; and WHERES, per Section 66.1333, Wisconsin Statutes, the Redevelopment Authority may spot blight and acquire blighted property without designating a boundary or adopting a redevelopment plan; and WHEREAS, Paul and Betty Ulrich have generously offered to donate to the Redevelopment Authority the property at 458 W. 6t" Avenue, and said property is not within a designated redevelopment area; and WHEREAS, the Redevelopment Authority conducted a public hearing and approved a determination that the property at 458 W. 6t" Avenue is blighted and in need of rehabilitation and blight elimination. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the property at 458 W. 6t" Avenue is hereby declared blighted pursuant to the provisions of Section 66.1333, Wisconsin Statutes. BE IT FURTHER RESOLVED by the Common Council that a comprehensive redevelopment plan is not necessary to determine the need for acquisition and redevelopment of said property. BE IT FURTHER RESOLVED that the City of Oshkosh expresses its utmost gratitude and appreciation to Paul and Betty Ulrich for their generous donation. BE IT FURTHER RESOLVED that the proper Redevelopment Authority officials are authorized and directed to accept said property donation/conveyance of land and to execute all documents necessary to consummate said transaction. ow, O.fHKOfH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: May 19, 2016 SUBJECT: Approve Spot Blight Designation; Authorize Redevelopment Authority to Accept Donation of Property at 458 West 6th Avenue (RDA recommends approval) Background The old Walleye's Pub has been closed and vacant for several years. Code Enforcement and Building Inspection staff has noted the decay and decline of the property over that time. In addition, the owner lost the liquor license for the property since the Pub was not operating. City staff has been in contact with the owner regarding the property maintenance issues, in and around the property, and the owner has offered to donate the property to the City for demolition rather than undertake extensive repairs. The City's plan would be to demolish the structure and make it available for future redevelopment. Analysis The property is located just outside the Southshore Redevelopment. City staff has served multiple code enforcement actions on the owner. The owner is unable or unwilling to correct the code violations. Staff has determined that the cost of correcting the violations would not be a feasible investment for this property. Demolition is the remaining option. Asbestos investigation and removal would be required prior to demolition. Fiscal Impact City staff estimates the demolition costs for the structure could be about $15,000 to $20,000. The cost could be reduced to only asbestos removal and landfill tipping fees of a few thousand dollars if City Public Works crews could demolish the structure when they have time available later this year. CDBG and /or blight removal funds will be used for the remaining demolition costs. Recommendation Staff recommends approval of the Spot Blight Designation and Accept the donation of property.
