PURPOSE: APPROVAL OF FINAL RESOLUTION FOR SPECIAL
ASSESSMENTS FOR STORM SEWER LATERALS / VARIOUS
LOCATIONS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, Waivers of Special Assessment Notices and Hearing under Section
66.0703(7)(b) of the Wisconsin Statutes, for public improvements and services, for the
premises described below have been signed by the property owners and accepted and
approved by the Common Council for proposed improvements as listed below, and an
initial resolution adopted April 12, 2016.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh as follows:
1. That the report of the City Manager, acting as the Board of Public Works,
pertaining to the construction of the above described public improvements, including plans
and specifications therefor, is hereby adopted and approved with the following
modifications:

2. That the action of the City Manager in advertising for bids and to carry out the
work of such improvements in accordance with the reports of the City Manager and in
accordance with the said resolution heretofore adopted, is hereby approved, ratified and
confirmed.

3. That payment for said improvements be made by assessing the cost to the
property benefited as indicated in said report, except as modified herein.
4. Assessments shown on the report represent an exercise of the police power and
have been determined on a reasonable basis and are hereby confirmed.
5. That the assessments for all projects included in said report are hereby
combined as a single assessment but any interested property owners shall be entitled to
object to each assessment separately or all assessments jointly for any purpose or
purposes.
6. That the assessments may be paid in cash, or in installments pursuant to
Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear
interest at the rate of six percent (6%) per annum on the unpaid balance. The City Clerk
shall publish an installment assessment notice in accordance with Section 66.0715(3)(e) of
the Wisconsin Statutes in the official newspaper of the City.
7. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY
NORTHWESTERN, the official newspaper of the City.
8. The City Clerk is further directed to mail a copy of this resolution to every
property owner whose name appears on the assessment roll whose post office address is
known or can with reasonable diligence be ascertained.

Subject: Assessments for Storm Sewer Laterals (New and Relay) and Surface Drains

A public hearing is scheduled for Tuesday, May 10, 2016, at 6:00 p.m. in the Common Council Chamber of the
Oshkosh City Hall to consider the improvements to your street. Staff will be available beginning at 4:45 p.m. in
Room 310 to answer questions about the project and the estimated costs. Residents may also call the
Department of Public Works Engineering Division at (920)236 -5065 to have questions answered.
The proposed improvements include: storm sewer laterals (new and relay) and surface drains and the levy of special
assessments that partially cover the cost of the improvements. Assessments are not due until the project is certified
as complete and then can be paid by any one of the plans as outlined by the City Clerk's information on payment
plan options. Based upon the City of Oshkosh assessment policy, the assessable portions of the project have been
identified and are outlined on the attached assessment worksheet(s). The final cost will not increase above the
estimated total without another public hearing. Questions in regard to payment of Special Assessments can be
answered by calling the City Clerk's office at (920)236 -5011. Questions in regard to the construction project in
general can be answered by calling the Department of Public Works Engineering Division at (920)236 -5065.
The sequence of construction has not yet been scheduled with a contractor. Residents will be notified approximately
one week before construction will begin on a particular property. All work within this contract is scheduled to be
completed by the end of August 2016.
The project construction consists of installation of storm sewers, laterals, and surface drains, as needed, to
accommodate drainage needs for the adjacent properties. If you know of any underground wires and/or piping,
(examples: invisible electric fence, conduit for exterior lighting, irrigation system, etc.) on your property near the
sidewalk and driveway, please contact the Engineering Division as soon as possible. Prior to the completion of the
project, all disturbed areas will be topsoiled, seeded, and covered with erosion mat (the property owner is
responsible for watering the newly vegetated areas). The matting placed over the seed is biodegradable; please
do not remove the mat because it serves as mulch for the new grass. Please set your lawn mower to the highest
setting when mowing the new grass areas for the first few mowings.
A Construction Access Agreement and Frequently Asked Questions handout is included with this information. If
the Construction Access Agreement is signed and returned to the City, a storm lateral will be installed onto your
property and an eight -inch (8 ") diameter drain with a slotted drain cover will be placed approximately 5' to 10' off
the sidewalk into your yard. The storm sewer lateral and drain will allow you to direct drainage and/or sump pump
hoses to this location. This drain is connected to the storm sewer system and drains directly to local streams and
lakes. The lateral is to be used for "clear water" only. "Clear water" is typically groundwater discharged by a sump

pump or runoff from precipitation (i.e. rainfall or snow melt). Do not place pet waste, yard waste, or other waste
material into the storm sewer system. In the event conditions on the property prevent the installation of the drain
(a retaining wall, for example), a drain will not be installed. The storm sewer lateral will be stubbed underground
into the terrace area. The drain is part of your private lateral and will be yours to maintain. The drain will have a
fabric filter installed as a part of the construction. Please leave the filter in place until the grass surrounding the
drain is well established. The fabric will prevent dirt and debris from filling the pipe until the grass is established.
Commercial properties will receive a larger diameter storm sewer lateral stubbed to the property line.
If the City does not receive a signed Construction Access Agreement from you, the storm laterals will only be
provided in the City's right -of -way, typically to the terrace area between the sidewalk and curb. The 8" yard drain
will not be installed. In the event you want the lateral extended in the future, the full cost of the work will be your
responsibility.
Although terrace trees may need to be removed at specific locations, they will be preserved as much as possible.
Property owners at locations where a tree needs to be removed will receive advance notice of the removal and
replacement options. Roots and branches may be cut to allow for paving operations. Cutting and pruning will either
be done by, or under the direction of, the City Forester.
The City has implemented a way for you to receive project updates via e-mail. The updates will provide information
about access and construction progress. To receive these updates, please send a blank e-mail to contract1620-
subscribe @lists.ci.oshkosh.wi.us. You will receive an e-mail stating your subscription request has been received.
You must reply to the message within five (5) days to complete the subscription. The City will stop sending updates
upon completion of the project. If at any time you wish to unsubscribe, please send an e -mail to this address,

FREQUENTLY ASKED QUESTIONS FOR
STORM LATERAL PROJECTS
Why is a storm lateral being installed in front of my house?
Storm laterals were not installed to all properties prior to approximately the last 10 years on road reconstruction projects
within the City. Many property owners have sump pump hoses they wish to route underground to the storm sewer system;
or have experienced backyard flooding issues, and have requested to have a storm lateral installed to their property. Any
storm sewer work being completed at those properties or adjacent to those properties will have a lateral installed. The
installation of storm laterals to all adjacent properties at this time helps to avoid future site work and extra construction
costs.
Who owns and maintains storm sewer mains and storm sewer laterals?
The City owns and is responsible for maintaining the storm sewer main lines. The storm laterals are owned by the
property owner, and the property owner is responsible for maintaining the laterals that serve the property.
If I already have a storm lateral, can my lateral that is located on private property be fixed as part of this project?
No. Under the City Contract, the existing storm laterals will be relayed from the storm sewer main to a connection point
with the existing storm lateral. The location of this point will depend upon whether the Construction Access Agreement
is signed or not. If the Construction Access Agreement is signed, the connection point will be approximately five feet
(5') behind the sidewalk. If the Construction Access Agreement is not signed, the connection point will be in the right -
of -way in the terrace area between the sidewalk and the curb. All work beyond the connection point will require a
plumbing permit. If you wish to relay the remainder of your storm lateral on private property, the City will assist in the
coordination of this work.
How much does a typical storm sewer lateral cost?
Since the property owner is responsible for the maintenance of the storm sewer lateral from house or backyard to the
sewer main, a special assessment for the relaying or installation of the storm lateral will be levied against the
property. From previous City contracts, the estimated cost to relay or install one (1) storm lateral is $400, and to
install a storm lateral and storm lateral inlet is $750. This cost is for relaying or installing the storm sewer lateral and
for removal and replacement of the pavement and sidewalk that is required for the lateral construction. The cost to
remove and replace the pavement and sidewalk for the connection to the storm sewer main is paid for by the City of
Oshkosh.
How far into my property will the storm sewer laterals be installed if I sign the Construction Access A;reement?
The City will be installing a new storm lateral from the existing storm main to approximately the property line, which is
typically the house side of the sidewalk. A storm lateral is installed on every property adjacent to- the project and
includes a 6" storm lateral, or a 6" storm lateral and an 8" yard drain with a slotted cover. When the 8" yard drain is
installed, it will be placed several feet onto your private property. This yard drain is used for "clear water" only. "Clear
water" is typically groundwater discharged by a sump pump or runoff from precipitation (i.e. rainfall or snow melt). The
exact location of the yard drain will be coordinated with the property owner during construction. If we do not hear from
you on the exact location you would like it installed, the Engineer will determine the best location for the drain.

What can I do with my new storm lateral?
If you have a sump pump hose that drains water into your yard, you will be able to re -route the hose to discharge into the
new 8" storm sewer yard drain. You can also hire a plumber to bury your sump pump hose and connect it to the storm
sewer and storm lateral inlet the City provides. If you experience backyard flooding, you may be able to hire a plumber
to install additional yard drains or drain tile in your rear yard, and route these systems into your new storm lateral. If you
wish to extend the storm lateral into your private property as mentioned above, the City can assist in the coordination of
this work.
How are storm laterals installed if I do not sign the Construction AccessAereement?
If the City does not receive a signed Construction Access Agreement from you, the storm laterals will only be provided
in the City's right -of -way, typically to the terrace area between the sidewalk and curb. Then in the future, if the lateral
is to be extended to the home or backyard, the property owner would be responsible for obtaining a permit to work
in the right -of -way and would also be responsible for all costs associated with the removal and replacement of any
disturbed area within the right -of -way, including pavement and sidewalk. If the Construction Access Agreement is
not signed and returned, the City will also not have the ability to install the 8" yard drain.
Why is a Construction Access AQreement needed for the installation of Sidewalk and Grading?
Sidewalk squares will need to be removed for the installation of the new or relayed laterals. When sidewalk is replaced,
a form needs to be placed at the back side of the sidewalk, which in turn encroaches onto your private property. The
concrete walk that is to be removed and replaced will be done so at no cost to the property owner. Also, any reseeding
on private property cannot be completed without a signed Construction Access Agreement.
How far into my property will the Contractor be doing work?
Typically, the street right -of -way is located approximately at the back of the sidewalk. A storm lateral is installed on
every property adjacent to the project and includes a 6" storm lateral, or a 6" storm lateral and an 8" yard drain with a
slotted cover. When the 8" yard drain is installed, it will be placed anywhere from five feet (5') to a maximum of ten
feet (10') into your private property depending upon the terrain and slope of your lot. The width of the trench will be
approximately four feet (4') wide, centered on the lateral location. The exact location of the yard drain will be coordinated
with you, the property owner, during construction. If we do not hear from you on the exact location you would like it
installed, the Engineer will determine the best location for the drain.
Once all storm sewer main and laterals are installed, the trenches in the street or terrace will be graded and patched and
any concrete sidewalk that was removed or damaged due the construction will be replaced, if the Construction Access
Agreement was signed and returned. If the Construction Access Agreement is not returned, the Contractor will not
have access to your property and the concrete sidewalk can only be patched.
Any disturbed turf areas will have 6" of topsoil placed, fertilized, seeded, and an erosion mat installed. The property
owner will be responsible for the watering of the newly - placed grass seed. A door hanger regarding the watering
instructions will be distributed at a later date.

INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its police
power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special
assessments upon property within the following described areas for benefits conferred
upon such property by improving the following:
Storm Sewer Laterals:
1405 Bismarck Avenue
1013 Washington Avenue
1021 Washington Avenue
2245 Allerton Drive
739 W. 19th Avenue
220 W. Smith Avenue
2. The total amount assessed against such district shall not exceed the total cost of
the improvements and the amount assessed against any parcel shall not be greater than
the benefits accrued thereto from said improvements.
3. The assessments against any parcel may be paid according to the provisions of
Section 25 -83 through 25 -89 of the Oshkosh Municipal Code.
4. The governing body determines that the improvements constitute an exercise of
the police power for the health, safety, and general welfare of the municipality and its
inhabitants.
5. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the proposed work or improvements.
(c) An estimate as to each parcel of property within the assessment district
of:
(1) The assessment of benefits to be levied for each improvement.
(2) The damages to be awarded for property taken or damages by
each improvement.

(3) The net amount of benefits over damages or the net amount of
damages over benefits for each improvement.
(4) The total assessment against each parcel
Upon completion of such report, the Board of Public Works is directed to file a copy thereof
in the City Clerk's Office for public inspection.
6. Upon receiving the report of the Board of Public Works, the City Clerk is directed
to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of
the Wisconsin Statutes. The hearing shall be held before the Common Council at the
Council Chambers, Room 406 in the City Hall at a time set by the Clerk in accordance with
the Wisconsin Statutes. The assessment against any parcel may be paid in cash, paid
with the first property tax installment, or in ten (10) installments if the total amount of the
assessment is greater than five hundred dollars ($500.00) or fifteen (15) installments if the
total amount of the assessment is greater than one thousand dollars ($1000.00).
7. The installation of said street improvements shall be accomplished according to
the provisions of Section 25 -3 through 25 -11 of the Oshkosh Municipal Code.

assessment (sheet #5) against your property or properties. A statement of the same is on file
in the office of the City Clerk. Once Contract No. 16 -20 is certified as complete by the Public
Works Department, the final amount (quantities and costs) of the special assessment against
your property or properties will be mailed to you. At that time you will also receive the
paperwork to select a payment choice for the special assessments. PAYMENT CHOICE OR
PAYMENT IS NOT ACCEPTED AT THIS TIME.
THE PAYMENT OPTIONS SHEET YOU WILL RECEIVE AFTER THE CONTRACT IS
CERTIFIED AS COMPLETE WILL HAVE THE FOLLOWING OPTIONS:
INVOICE - PAYMENT WITHIN 30 DAYS
If you choose this option, the City of Oshkosh will then send you a special assessment invoice
and you must make payment within thirty days of that notice.
If the payment is not made within thirty days after receiving the special assessment invoice,
6% interest accrues from the date of notification.
If after making this selection, the property owner fails to make payment to the City Treasurer;
the entire amount including interest will be placed on the next property tax bill.
TOTAL ASSESSMENT ON NEXT TAX BILL IN FULL
Property owners may elect to pay 100% of the assessment on the next designated real estate
property tax bill, without interest. The total amount of the assessment will be included on and
payable in conjunction with the next designated property tax bill.
TEN ANNUAL INSTALLMENT PAYMENTS ON PROPERTY TAX BILL (ASSESSMENT

The amount of the assessment will be placed on the property tax bill with interest at 6% on the
