MAY 10, 2016 16-232 RESOLUTION (CARRIED___7-0____LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: APPROVE CONDITIONAL USE PERMIT/ PLANNED DEVELOPMENT FOR A COMMUNITY GARDEN; EAST SIDE OF THE 600 BLOCK OF GROVE STREET INITIATED BY: MENOMINEE SOUTH NEIGHBORDHOOD ASSOCIATION PLAN COMMISSION RECOMMENDATION: Approved with conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit/planned development to allow a community garden on the east side of the 600 Block of Grove Street, per the attached, is hereby approved with the following conditions: 1. Signage will not exceed 24 square feet in area and final location and design will be approved by the Planning Services Division. 2. Base standard modification to reduce the front yard setback from 25’ to 15’ for the installation of raised garden beds. 3. Base standard modification to reduce the rear yard setback from 25’ to 10’ for the installation of raised garden beds. 4. Community garden approval is contingent upon City of Oshkosh Common Council approval and will be required on a yearly basis. 5. Applicant is responsible for maintenance of the subject site including mowing, trimming, weeding and keeping the site as orderly as possible. 6. Any changes to the garden plan must be approved through the Planning Services Division. 7. If a compost area is to be provided, it shall be placed in such a way as to be out of sight as much as possible and be enclosed to prevent rodents. Final design/placement to be approved by the Planning Services Division. 8. Final design of structures, signage and landscaping to be approved by the Planning Services Division. 9. Applicants will be required to develop rules and procedures for garden users. Rules will have final approval by the Planning Services Division. The subject property is approximately 0.935 acres (approx. 40,739 square foot) and has been vacant since the former Mercy Hospital generator /maintenance structure that had previously been on the site was demolished. The City of Oshkosh acquired the subject property in 2015 from Winnebago County after the property was foreclosed on due to unpaid taxes. The lot is zoned R -5PD - Multiple Family Residential with a Planned Development overlay. The general area has a mix of single, two and multi - family residential uses, including the former Mercy Medical Center which is directly east of the subject property. ANALYSIS The applicant is proposing to improve a 120' by 120' section of the subject property for a neighborhood community garden with the proposed improvements located 120' south of Cleveland Avenue and 200' north of East Parkway Avenue. The proposed garden is intended to provide a community gathering space enhancing existing culture and providing a means for residents to plant sustainable food alternatives. This concept aligns closely with the City's Strategic Plan and is identified as a goal within the City's Sustainability Plan. The community garden would include 30 raised garden beds, an enclosed compost bin /refuse container, and a ground sign. All tools and water resources will be furnished by participants and not stored on the site and use would be free of charge and limited to daylight hours only. Maintenance and season cleanup will be the responsibility of the applicant. The garden beds will require a base standard modification for front and rear yard setbacks with any changes to the layout requiring approval by the Planning Services Division. The proposed signage will be setback 25 feet from the property line not to exceed 24 square feet in size also with approval by the Planning Services Division. The use of the vacant parcel will be assessed and approved on a yearly basis by the Common Council and may be terminated if not appropriately maintained or if a development plan for the subject site is approved. The community garden is a good use for the vacant parcel and is consistent with the City's Sustainability Plan. FISCAL IMPACT None anticipated other than the land now occupied by the community garden will be maintained by the neighborhood association. RECOMMENDATION The Plan Commission recommended approval of the conditional use permit/planned development at its May 3, 2016 meeting. Conditional Use Permit for a community garden use on a vacant parcel located on the east side of the 600 block of Grove Street; and B. Planned Development approval for placement of a community garden on vacant parcel located on the east side of the 600 block of Grove Street. Applicable Ordinance Provisions: Community gardens are permitted only through approval of a conditional use permit within the R- 2 Two Family Residence Zoning District. The Zoning Ordinance establishes criteria and guidelines for establishment and /or amendment of a Conditional Use Permit in Section 30 -11 (D). The site is also located within a Planned Development Overlay District, which standards are located in Section 30- 33(E)(3) of the Zoning Ordinance. The proposed improvements will be located approximately 120' south of Cleveland Avenue and 200' north of East Parkway Avenue. The applicant states in their submittal that the proposed garden is intended to provide a clean, community gathering space that not only enhances existing culture and sense of place but also provides a means for residents of the neighborhood and city to plant sustainable food alternatives. Furthermore, the applicant states that the proposed garden will also be an appropriate addition to the neighborhood as a community asset and a place of gathering which aligns closely with the City's Strategic Plan as it relates to strengthening neighborhoods, improving quality of life assets and supporting economic development. Additionally, the use of City -owned vacant lots as community gardens is identified as a goal within the City's Sustainability Plan which was approved by the Common Council on May 22, 2012 (Resolution 12 -288). The community garden, as proposed, would include approximately 30 raised garden beds which will be approximately 4' by 20' or 4' by 10' in size and extend approximately 24 to 48 inches above grade. Proposed improvements will also include a 4' by 5' enclosed compost bin and refuse container which will ensure the site is kept clean and orderly. The applicant is also proposing to install a ground sign but no plans have been submitted at this time. All tools and water resources necessary for the proposed community garden will be furnished by the applicant or garden participants and will not be stored on the site. The applicant has indicated that there will be no fees charged for residents to use the site. Use of the lot would be limited to daylight hours only and would be permitted any day of the week. Maintenance of the proposed 120' by 120' area and adjacent terrace will be the responsibility of the applicant and will include mowing, trimming, weeding and keeping the site as orderly as possible. The applicant will also be responsible for end of season clean up and all refuse removal from the site. The proposed improvements meet all bulk and dimensional requirements with the exception of the raised garden bed locations. The proposed raised garden beds will be located within the 25 feet front yard setback and will require a base standard modification to permit them to be setback 15 feet from the front yard property line. Additionally, the proposed raised garden beds will be located within the required 25 feet rear yard setback and will require a base standard modification to permit them to be setback 10 feet from the rear property line. Staff is recommending approval of the proposed front and rear yard base standard modifications because the raised garden beds are proposed to be approximately 24 to 48 inches above grade and staff felt that the reduced setback would not cause adverse vision impacts based on the mid -block location of the community garden improvements. Staff is also recommending that any future changes to the site layout be approved by the Planning Services Division. The proposed signage will be setback 25 feet from the front property line and will not exceed 24 square feet in size. Staff is recommending that the final sign location and design be approved by the Planning Services Division. Item — CUP /PD- Community Garden- east side of the 600 block of Grove Street The use of the vacant parcel will be assessed and approved on a yearly basis by the Common Council. If the City Council, as the owner, feels the applicant is not maintaining the site in a fashion that is compatible with the neighborhood, the garden project may be terminated by the City Council. Additionally, if the Common Council approves a development plan for the subject property, all improvements will be removed from the site. Staff agrees with the applicant that this would be a good use for the vacant parcel and is consistent with the City of Oshkosh Sustainability Plan, which encourages the creation of community gardens and for residents to identify and convert vacant or city -owned land for neighborhood food plots and gardens. RECOMMENDATION /CONDITIONS Planning staff recommends approval of the Conditional Use Permit /Planned Development for a community garden as requested with the following conditions: 1. Signage will not exceed 24 square feet in area and final location and design will be approved by the Planning Services Division. 2. Base standard modification to reduce the front yard setback from 25' to 15' for the installation of raised garden beds. 3. Parking is not permitted on site. The Plan Commission approved the Conditional Use Permit /Planned Development for a community garden as requested with conditions noted. The following is the Plan Commission's discussion on this item: Ms. Williams presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. She discussed the history of the site and the land division and planned development recently approved for a portion of this lot and the size of the proposed community garden and its location on the site. She also reviewed the layout of the raised garden beds and the other features on the site such as signage, an enclosed compost bin, and refuse container. She also discussed that there would not be any storage allowed on the site and there would be no fees for use of the garden beds as well as the hours of operation and maintenance and end of season cleanup which would be the responsibility of the applicant. She also reviewed the base standard modifications necessary for the front and rear yard setbacks and that the use would be assessed and approved on an annual basis by the Common Council and that it will be discontinued if not appropriately maintained or if a development plan would be approved for the site. She also reviewed the conditions recommended for this request. Mr. Fojtik questioned if the conditions were standard for this type of request. Ms. Williams responded affirmatively. Mr. Thorns questioned if the site is not maintained, if the Common Council would have the authority to remove its use. Ms. Williams replied that it will require approval by the Council each year for its continued use. Mr. Thorns then questioned if the City would have to maintain the site during summer if the applicant fails to appropriately maintain it during the growing season. Ms. Williams responded that any maintenance issues will be addressed at the time of the annual renewal however the City would be responsible for the site if the use was discontinued mid -year as it is City owned property. Ms. Propp questioned if the neighborhood association would be in charge of this garden use. Ms. Williams stated that Benjamin Krumenauer was the applicant for this request and she was not sure who would be handling the registrations and other aspects of the garden use. Mr. Gray questioned if the area would be fenced in. Ms. Williams responded negatively. Mr. Gray then questioned if the garden beds were going to remain on the site year round. Item — CUP /PD- Community Garden- east side of the 600 block of Grove Street Ms. Williams replied that the plantings will be removed at the end of the growing season but the raised beds would remain in place. Mr. Gray questioned who would be paying for the installation of the raised beds. Ms. Williams responded that she was not aware who would be funding the project but that no request was submitted for funding to be provided by the City. Mr. Gray then questioned if the creation of community gardens would be addressed in the new Zoning Ordinance so it would no longer require approval of a planned development for this type of use. Mr. Burich indicated that going forward with the new Zoning Ordinance that community gardens will require approval of a conditional use permit only. Mr. Thorns commented that condition 98 which makes reference to landscaping to be approved by the Planning Services Division and questioned if there was any requirement for landscaping on the site. Ms. Williams responded that the applicant did not propose any landscaping for the property. Mr. Thorns then questioned if the city does not require a landscaping plan, if condition 98 should be removed. Ms. Williams replied that the condition should remain in place in the event that the applicant chooses to install landscaping at a later date. Benjamin Krumenauer, 650 Grove Street, stated that he was the applicant for this request and explained the registration process and that the garden spaces would be available for anyone who chooses to participate and that no fees were required for its use. He further stated that the landscaping would be maintained however no formal landscaping plans were proposed other than the garden beds but they would welcome ideas for improving the lot in a partnership with the City if they wished to have additional landscaping placed on the site however they do not wish to propose any permanent features for the property. He further discussed funding for the raised beds and that they were seeking assistance with financing its construction however if that was not successful, the neighborhood association would fund the development. Mr. Thorns inquired if there was any discussion with the City Attorney regarding liability issues or any agreement to be signed in relation to the maintenance for garden plot users. He had concerns as the public would be accessing the site and his concern was if anyone would be injured on the property that the City would not be held liable. Mr. Krumenauer stated there was not any boilerplate agreement to be signed by users at this time. Mr. Burich responded that there was some type of insurance that covers this use and as it was a recreational use of the property there was no need for liability coverage for this type of use. Menominee South Neighborhood Association (MSNA) is exited to propose a series of community garden improvements that not only provide the immediate neighborhood a clean place to develop home produce but to also provide an improvement to the community as a whole. MSNA proposes the creation of temporary raised planting beds in a controlled and well maintained design. The proposed community garden improvements will be limited to the north half of the O Grove Street property (located at the NE corner of Parkway Avenue and Grove Street). The total site will be —240' long by -- -120' wide totaling 28800 sq ft or —0.66 acres in size. may include a community identification sign located within the property, and will not require any additional City services. The creation of elevated beds will be developed to promote healthy growing sites and will also create a welcome sense of community in the design. Similar efforts have been implemented in the City and County including community plots at United Way, Jefferson Street, Winnebago County Mental Health Facility and at various schools to name a few. MSNA residents view this appropriate addition to the neighborhood as a community asset and a place of gathering that aligns closely with the desires of the City of Oshkosh as outline by the city's current strategic plan. This community garden will promote the strengthening of neighborhoods, improve quality of life assets and support economic development (three of the five strategic plan elements). In short, MSNA proposes the creation of temporary raised planting beds in a controlled and well maintained design. The proposed community garden improvements will be limited to the Middle third of the O Grove Street property (located at the NE corner of Parkway Avenue and Grove Street). The total site will be -120' long by --120' wide totaling - -14400 sq It or -0.33 acres in size. Additional site plans and proposed designs are included within this narrative. The site may include a community identification sign located within the property, and will not require any additional City services. The creation of elevated beds will be developed to promote healthy growing sites and will also create a welcome sense of community in the design. The addition of a designated enclosed compost site and refuse container (managed by MSNA) will allow local residents and area travelers to properly dispose of organic and solid waste. All tools, resources, and water necessary for the proposed community garden will be furnished through partnerships within MSNA and will not require any staff or resources supplied by the City of Oshkosh. Moreover, MSNA agrees to maintain the green space within the lot (to include all green space within the designated boundaries of the proposal. Will exclude terrace from scope of proposal). Agreed upon maintenance by MSNA includes, seasonal maintenance (grass, leaves, etc), garbage maintenance and regular upkeep of the planting beds, open space, compost and garbage site, and identification sign if implemented. 7 fryOMINEESO Menominee South Neighborhood Association Proposed Conditional Use Permit MSNA Community Garden No fee or costs will be permitted to use the site and all administrative needs will maintained by MSNA. Additionally, no perceived ill - effects are expected to community residents or day to day activities. The compatibility of the proposed community garden will supplement the existing land uses and provide additional space for healthy eating and community support. The Menominee South Neighborhood Association recognizes the transient nature of the property owned by the City of Oshkosh and acknowledges that in the event the City wishes to sell or develop the property for its original intended use, then all uses related to this Conditional Use Permit will become void at a mutually agreed upon time MSNA feels that the addition of the community garden will enhance the aesthetic and community nature of the City and as such has taken the internal steps to approve the submission of this application, site descriptions, and narrative. MSNA steering committee comprised of residents within the neighborhood agreed unanimously on March 24`", 2016 at a properly posted steering committee meeting to move forward with this application and community garden process.
