MAY 10, 2016 16-233 RESOLUTION (CARRIED___7-0__LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE SUBMITTING MUNICIPAL FLOOD CONTROL GRANT PROGRAM APPLICATION INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to submit a grant application for a Municipal Flood Control Grant project for the North Main Street Area Wet Detention Basin. WHEREAS, the City of Oshkosh is qualified, willing, and able to carry out all activities described in the state grant application; and, WHEREAS, by this resolution the Common Council for the City of Oshkosh is declaring its intent to conduct the Municipal Flood Control Grant project described in the application; and, WHEREAS, the City of Oshkosh will allow employees from the Department of Natural Resources access to inspect grant project sites; and, WHEREAS, the City of Oshkosh will maintain records documenting all expenditures made during the Municipal Flood Control Grant project; and, WHEREAS, the City of Oshkosh will submit a final report to the Department which describes all Municipal Flood Control Grant project activities, achievements, and data collected, and documentation of the project costs. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper city officials are hereby authorized and directed to submit an appropriate request for funds and available assistance from the Wisconsin Department of Natural Resources under the Municipal Flood Control Grant Program in accordance with state rules for the program for the North Main Street Area Wet Detention Basin Project; and, BE IT FURTHER RESOLVED that the Director of the Department of Public Works, on behalf of the City of Oshkosh, is hereby authorized to sign documents, and take necessary action to undertake, direct, and complete an approved flood control project. Rabe, Director of Public Works RE: Approve Submitting Municipal Flood Control Grant Program Application BACKGROUND The Wisconsin Department of Natural Resources administers the Municipal Flood Control Grant Program. This program offers financial assistance to local units of government for implementing strategies to reduce the risk of flood damage to properties. These strategies can include the acquisition of property, demolition of flood -prone structures, flood proofing structures, and construction of practices that reduce flood elevations (such as detention basins). The City of Oshkosh has previously received $1,330,000 in grants under this program for the acquisition of land, and the construction of flood -risk reduction projects. ANALYSIS Based upon the current Capital Improvement Program schedule and budgets, this grant application will assist the City of Oshkosh in constructing North Main Street Area Wet Detention Basin project within the Libbey - Nicolet Watersheds. FISCAL IMPACT The approval of this resolution allows staff to submit the grant application, which if awarded, will reduce the City cost of the project. The grant program reimburses municipalities 50% of their costs. No single grant recipient is allowed to receive greater than 20% of the overall state budget for this program. In this case, the maximum grant amount would be $380,000. The following points need to be addressed in your project description and property management plan.If some of the issues are not applicable,please indicate they are not and explain why. Some sections may require more detail than others,depending on the type of project. 1.Primary goals of the project: Provide a concise statement explaining the benefits of the project and why the site should be a flood control project: This project is identified as City of Oshkosh Contract 16-01 Libbey-Nicolet Watershed North Main Street Area Wet Detention Basin.The project,as shown on Figure 1,consists of construction of a wet detention basin on an approximately 6.5 acre site,an adjacent dry detention basin on a 4.7 acre site,and connections to existing storm sewers.The overall project area is 11.2 acres.This project was analyzed an d recommended as a major component of Alternative 12A in the Libbey/Nicolet Watersheds Study(AECOM, 2011). The goal of the Libbey/Nicolet Watersheds Study was to generally reduce flooding throughout the Libber Nicolet watershed area,to specifically reduce flooding along Jackson Street during the 10 year event,to improve water quality,and to make the roadway usable for emergency vehicles during the 100 year event. Twelve alternatives were analyzed and Alternative 12A was chosen because of its ability to eliminate Jackson Street Flooding during the 25 year event,water quality benefits,cost-effectiveness,and the reduced number of necessary detention basins.This alternative recommends three basins within the Libbey-Nicolet Watershed area.The City will construct a 6 acre wet and a 4 acre dry detention basin on City-owned land in the Libbev-Nicolet Watershed north of Bacon Avenue,between N Main Street and Jackson Street.Figure 1 shows the proposed wet and dry detention basins. The wet detention basin will be 12.5 feet deep and provide 33.8 acre-ft of storage between elevations 757 and 749.5 feet.The dry detention basin will be 7.5 feet deep and provide 16.7 acre-ft of storage between elevations 757 and 749.5 feet. The storm sewer network will drain into the basin from N.Main St and Jackson St via a 38"by 60"storm sewer inlet to the wet detention basin and a 5'by 8'box to the dry detention basin.The wet detention basin outlet will drain into the N.Main Street storm sewer south of the inlet.The dry detention basin will connect to the storm sewer system from Jackson St.,Geneva St.,and Comet St.A 60"diameter pipe will connect the two basins.This project will also upgrade existing storm sewer pipes in the area. Sheet 0-1 of the construction drawings of Alternative 12A is attached showing detailed project limits. The benefits of this project include elimination of flooding along Jackson Street up to the 25 year event by providing storage and improving stormwater quality. Total storage provided by this project will be 50.5 acre-ft(81,500 cubic yards). Over 100 homes in the Libbev-Nicolet Watershed will see reduced flooding during the 100 year event upon full build of Alternative 12A. See XPSWMM 2d output to compare existing conditions flood extents,Figure 2,with proposed conditions flood extents,Figure 3.Alternative 12A also assumes new and upgraded storm sewers along N.Main St.,Jefferson St.,Mt.Vernon St.,Ashland St., W. Linwood Ave.,Jackson St.,Viola Ave.,and W.Gruenwald Ave.The total estimated construction cost of the project will be$4,940,000 and the maximum$380,000 is requested by the City of Oshkosh as allowed by the grant program.If more funding becomes available,the City of Oshkosh requests additional grant funding. 2.Description of the site: Indicate the size of the project and describe the natural features of the land;provide information about natural communities,land cover,species,topography,water resources,and special features.If the project includes a number of parcels of land,indicate the number of parcels with legal description to be acquired with this grant: The project is located within the Libbey Watershed,just south of the border of the Nicolet watershed. The parcels included in this project are 9159591800, 9159591700,and 91519591500.The existing conditions of the site are shown on Figures 4 and 5 as well as in the attached photographs(Figures 6-10).Both sites are currently a mixture of woodland and undeveloped grassland. Soils within the project area are classified as Silt Loam and Silt Clay Loam.The majority of the area is classified as hydrologic soil group D with the southeast corner classified as C/D.The Libbey and Nicolet Watersheds comprise areas of approximately 490 acres and 240 acres,respectively.The general flow pattern is from west to east. The City of Oshkosh owns the aforementioned parcels. According to the Winnebago County, Wisconsin,Natural Hazards Mitigation Plan:2015-2019,there have been 5 presidential disaster declarations since 1990. 1990-Flooding and tornadoes(FEMA-874-DR) 1993 -Flooding,severe storm,tornadoes(FEMA-994-DR) 2001 -Flooding(FEMA-1369-DR) 2004-Severe Storms,icing,wind,flooding(FEMA-1526-DR) 2008-Severe storms,tornadoes,flooding(FEMA-1768-DR) Describe existing conditions,present threats,current uses,surrounding land use, and provide a five year history of past uses for each property: Over the past 5 years,the two parcels remained a mixture of woodland and grassland,with no structures present. 3.Existing structures: Describe flood related damage of existing structures on each property to be acquired with this grant: Not applicable. Indicate in detail the flood control benefit of the removal of structures if applicable for the project for each property: Not applicable. Identify other groups or management units that will be involved,their relationship to the proposal and their levels of financial support: The project was initiated and will be funded by the City of Oshkosh.No other management units will be involved.This project is a recommended part of the approved Libbey/Nicolet Watersheds Study(AECOM, 2011)and thus shows that the project is supported by the community and has the support of the City Council and the Storm Water Utility citizen advisory committee. 6.Public access: Public access is required under section NR 199.10(2)(c)Wis.Adm. Code which prohibits closing the purchased property to the public except where the DNR has determined that closure is necessary to protect wild animals,plants or other natural features.Describe how the public will be able to access the site.If no public access is planned,explain why not: Not applicable. 7.Property transactions: No grant may be awarded to acquire property through the"Power of Eminent Domain."Describe the procedure used to acquire property from willing seller: Not applicable. Describe a plan to meet this requirement: Describe open space uses for this property to maintain open space and flood control: The site will be planted with native vegetation and maintained as a natural open space by the City Storm Water Utility. Vegetative buffers shall be established and maintained along lakes,ponds,wetlands,marshes,rivers, streams,and ditches.Department best management practices shall be employed to the greatest extent possible for the project.Whenever possible,the area of the vegetative buffer shall extend at least 75 feet from each edge of the surface water or wetland.There may be no activity that adversely affects the natural flow of surface or underground waters within the area of the easement. (see NR 199.08(b)e)Indicate your plan to meet this requirement: A native vegetative buffer shall be established around the entire perimeter of the wet detention basin. Identify what ongoing maintenance activities will be needed(such as trash removal,surveillance, vehicle/visitor control,exotic species removal,controlled burning,etc.): After the basins are built,the properties will be maintained as designed with the cleaning out of sediment as necessary.All necessary soil stabilization,erosion control,and vegetation restoration has been designed into the construction documents. The City of Oshkosh Public Works Department will keep a watchful eye on the outlet structure of the basin after substantial rain events to look for and clean out any debris that may be clogging the outlet structure. The City has an on-going maintenance program that monitors all of the City's storm facilities for invasive vegetation and that also carries out management activities to maintain a healthy vegetation.
