PURPOSE: DESIGNATE YIELD RIGHT OF WAY INTERSECTION AT
WELLINGTON AVENUE AND MOCKINGBIRD WAY
INITIATED BY: TRAFFIC REVIEW ADVISORY BOARD
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 27A-10
OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO YIELD RIGHT OF WAY
INTERSECTIONS DESIGNATED.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 27A-10 of the Oshkosh Municipal Code pertaining to
yield right of way intersections designated is hereby amended as follows:
A-10 YIELD RIGHT OF WAY INTERSECTIONS DESIGNATED
The following intersections in the City of Oshkosh are hereby declared and
designated to be yield right of way intersections, and traffic shall yield as follows:
Wellington Avenue
Add Thereto: Wellington Avenue yields to Mockingbird Way
SECTION 2. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate signage.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh
enacted ordinance #16-239 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH
AMENDING SECTION 27A-10 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO
YIELD RIGHT OF WAY INTERSECTIONS ON MAY 10, 2016. The ordinance designates
the intersection of Wellington Avenue and Mockingbird Way as a yield right of way
intersection.

Ordinance to designate yield right of way intersection at Wellington Ave. and Mockingbird Way
BACKGROUND
At the April 12, 2016 Traffic Review Advisory Board meeting I explained this request is from the newly formed
Sawyer Creek Neighborhood Association. I explained the warrants for a yield sign are three or more right angle
accidents in a 12-month period or 5 or more in a 2-year period, 3,000 or more vehicles per day, or a severe sight
distance problem. I explained that unwarranted traffic control devices minimize the effectiveness of warranted
devices and since none of the warrants are met I cannot recommend installation of a yield sign at this location.
However, the board has recommended unwarranted signs in the past based on special circumstances.
• Julie Kiefer, of 2810 Foxtail Lane and co-chair of the Sawyer Creek Neighborhood Association Steering
Committee, stated this was the number one concern that came up at their initial meeting. She explained
that this intersection is where students cross to get to Carl Traeger School
• Mr. Herman said that he felt the city needed to support the neighborhood associations when possible
• I clarified that the yield sign would be placed on Wellington Drive
• Ordinance was recommended by the Traffic Review Advisory Board (6-0).
ANALYSIS
There was one reportable accident at this intersection in 2010. The average daily traffic count traveling on
Wellington is 181 vehicles and 469 traveling on Mockingbird. The sight lines at this intersection are adequate.
Despite this intersection not meeting any of the MUTCD criteria for a yield sign, this was the neighborhood
association's number one concern. The TRAB decided to support the neighborhood association's request.
FISCAL IMPACT
The only fiscal impact of this ordinance is the cost of signage (approximately $450), which would come out of
the Sign Department's operating budget.
RECOMMENDATION
I recommend the Common Council approve this ordinance addition to section 27A-10 yield right of way
intersections designated of the municipal code
