PURPOSE: APPROVE SPECIAL EVENT / OSHKOSH SAWDUST DAYS /
UTILIZE MENOMINEE PARK FOR THEIR OSHKOSH SAWDUST
DAYS FESTIVAL AND 5K WALK-RUN / JUNE 30 THROUGH JULY 4,
2016
INITIATED BY: CITY ADMINISTRATION
WHEREAS, the City of Oshkosh has received a special event application from
Oshkosh Sawdust Days, Inc. (Ellen Schmidt) to utilize Menominee Park for their Oshkosh
Sawdust Days event on Thursday, June 30, 2016 through Monday, July 4, 2016; and
WHEREAS, Oshkosh Sawdust Days Inc., through their application, has requested to
allow camping, overnight parking, glass bottles, and domesticated animals in the park; and
WHEREAS, Oshkosh Sawdust Days Inc. requested that beer sales and amplified
music at Oshkosh Sawdust Days be extended to 11:00 p.m.; and
WHEREAS, the City of Oshkosh has adopted a noise ordinance and the regulation of
noise is generally more stringent between the hours of 10:00 p.m. and 7:00 a.m. and
amplified music is generally prohibited after 10:00 p.m. within city parks; and
WHEREAS, in making this determination whether to waive the requirements of the
noise ordinance the Council is to consider:
(1) the hardship to the applicant, the community, and other persons of not
granting the variance;
(2) the adverse impact on health, safety, and welfare of persons owning,
residing, or occupying property in the surrounding area and the public in
general;
(3) the adverse effect on surrounding property;
(4) whether the circumstance, hardship, or situation to be addressed by the
proposed variance is unique, and not applicable generally to other
circumstances;
(5) whether the person or entity seeking the variance is otherwise in
compliance with all applicable ordinances, regulations and statutes; and
(6) any other adverse impacts of granting the variance.
WHEREAS, the Council has consider the above factors and determined that a noise
variance is appropriate in this case and presents no significant adverse impacts upon the
surrounding properties or community.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh
that approval is granted to Oshkosh Sawdust Days, Inc. (Ellen Schmidt) to utilize Menominee
Park (part of the boat launch area, Kiwanis shelter, gazebo, and two small shelters near the
volley ball courts) for their Oshkosh Sawdust Days Festival on the following dates:
Thursday, June 30, 2016, from 4:00 p.m. to 11:00 p.m.
Friday, June 31, 2016, from 12:00 p.m. to 11:00 p.m.
Saturday, July 1, 2016 from 12:00 p.m. to 11:00 p.m.
Sunday, July 3, 2016, from 12:00 p.m. to 11:00 p.m.
Monday, July 4, 2016, from 10:00 a.m. to 11:00 p.m.
to utilize city Streets (Hazel Street, Menominee Drive, and E. Murdock Avenue) on July 4, 2016,
from 10:00 a.m. to 11:30 a.m. for their 5K Walk/Fun Run in accordance with the municipal code
and the attached application, with the following exceptions/conditions:
A. An exception to the provisions of 19-4(B) to allow Sawdust Days participants to
camp in the Historical Village area.
B. An exception to the provisions of 19-4(C)(3) of the City of Oshkosh Municipal
Code is granted to allow persons in the park until 12:00 a.m.
C. An exception to the provisions of 19-4(H) to allow Sawdust Days re-enactors to
have glass bottles in the park with Sawdust Days taking responsibility for any
clean-up issues.
D. An exception to the provisions of 6-6 of the City of Oshkosh Municipal Code to
allow animals for this event (petting zoo and pony rides from Cassidy’s Critters).
E. An exception to the provisions of 19-4(D) to allow Sawdust Days participants dogs
in the vendors camping areas with Sawdust Days taking responsibility to confirm
current rabies vaccination & providing appropriate identification bands or tags as
approved by the Winnebago County health Department & Oshkosh Police
Department.
F. An exception to the provisions of 19-4(A)(3) of the City of Oshkosh Municipal
Code is granted to allow amplified sound until 11:00 p.m.
BE IT FURTHER RESOLVED that as a condition of approval, the Event Organizer shall
pay the City’s actual costs for extraordinary services.
