HomeMy WebLinkAbout31. 16-212APRIL 26, 2016 16-212 RESOLUTION (CARRIED___7-0___ LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: APPROVE WAIVER THROUGH JUNE 30, 2016 OF ORDINANCE SECTION 4-5 REQUIRED USE OF ALCOHOL BEVERAGE LICENSE TH FOR MATTHEW VIENOLA (Post 1908) 129 W 17 AVENUE INITIATED BY: MATTHEW VIENOLA (Applicant) WHEREAS, the City of Oshkosh Municipal Code section 4-5(A) provides that failure to complete the requirements for issuance of a license and/or failure to conduct a license- related business on a premises for which a license has been issued for a period of one year is a violation of the municipal ordinances and may be grounds for revocation of an alcohol beverage license; and WHEREAS, Matthew Vienola has expressed continued interest in maintaining the th license for property located at 129 W. 17 Avenue for future redevelopment of this property as mixed use development; and WHEREAS, the applicant has taken and continues to take reasonable steps toward the development of the property. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that Matthew Vienola is hereby granted a waiver from the provisions of Section 4- 5(A) of the City of Oshkosh Municipal Code until June 30, 2016 for property located at 129 W. th 17 Avenue in the City of Oshkosh, Winnebago County, Wisconsin. Vienola 4520 Country Cfub Rd Oshlcosh, WI 54902 920-579-0532 Apri15, 2016 Dear City of Oshlcosh Council Members, [ am writing in response to the letter that I received from the City Clerlc regarding the property and liquor license far the address of 129 W.17th Avenue currently Post 1908 formerly known as Timbuktu and VFW Post. As you are aware of the former owner Gayle Savka transferred the liquor license into my name with the purchase of the property. The remodel of the Jocicey Club on Gruenwald Street in Oshlcosh was included in the agreement between Gail and myself for the purchase of the Timbuktu property. We were to rebuild the Jocicey Club and help the business to be successfully running prior to our planned redevelopment of the property on 17�h Avenue. Due to unforeseen circumstances related ta the condition af the building, the Jocicey Club, our original plan of 3 months became an 8-month project, which brought us into December. Therefore the Post 1908 redevelopment praject was delayed due to winter building challenges for a project of this size. During our projec� at fihe Jocicey Club we were also redeveloping Chester V's and continuing the improvements at The Beachcomber. In light of the time frames and amount of worlc, the Post 1908 project was pushed forward to begin the summer of 2016 with a completion goal of late 2016. A lack of liquor license at the praperty would halt the redevelopment plans that were submitted to you in spring of 2015. In the plans that were provided you will be able to visualize that when finished Post 1908 will be a mixed-use development with residential and commercial use.
