HomeMy WebLinkAbout19. 16-182 MARCH 22, 2016 APRIL 12, 2016 16-162 16-182 ORDINANCE FIRST READING SECOND READING (CARRIED__6-0____ LOST_______ LAID OVER_______ WITHDRAWN_______) PURPOSE: CREATE PARKING REGULATION TO PROHIBIT PARKING WITHIN 50 FEET OF A BUS STOP SIGN INITIATED BY: TRAFFIC REVIEW ADVISORY BOARD A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 27-23.1 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING NEAR BUS STOPS The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27-23.1 of the Oshkosh Municipal Code pertaining to parking prohibitions on designated streets, alleys and parking lots add the following: 23.1 PARKING PROHIBITED NEAR BUS STOPS Add Thereto: No person shall park a motor vehicle on any public street at any time within 50 feet of an authorized bus stop sign. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate signage. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #16-182 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 24-30.1 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING NEAR BUS STOPS) on April 12th, 2016. The ordinance restricts parking within 50 feet of a signed bus stop. BACKGROUND The Traffic Review Advisory Board had asked me to research what other communities do to restrict parking at bus stops. In the past each problematic bus stop location was brought before the Board individually. With an ordinance covering all bus stops, it would no longer be necessary to go through the process for each bus stop location where parked vehicles often block access to the bus stop. This ordinance would give us authority to install appropriate signage by bus stops as needs arise. ANALYSIS I researched what other communities have for parking restrictions at bus stops. There are many examples. I thought Waukesha's ordinance was the most clear and consistent. Their ordinance matches what the Traffic Review Advisory board is recommending. Historically, we have removed parking 90' preceding a bus stop sign. Daniel Becker suggested removing parking both preceding and following the bus stop sign. He said this would allow for the bus to stop at the shelter/sign and then have additional room to easily pull away. He moved to amend the item to "no person shall park within 50 feet of a bus stop sign". I believe this makes sense. Amendment passed on 3/8/16 by Traffic Review Board 6— 0 Amended item passed on 3/8/16 by Traffic Review Board 6— 0 FISCAL IMPACT The only fiscal impact of this ordinance is the cost of signage, which would come out of the Sign Department's operating budget. RECOMMENDATION I recommend the Common Council approve the addition of Section 27-23.1 parking prohibited near bus stops of the municipal code.
