Board of Zoning appeals P�inutes September 2 , 1981 Meeting Page Two P�r. Weigert said that there are two buildings here , connected by a common wall. One is used for apartments now, while the other still remains essentially the same as it was . They would like to retain the ballrooms historical elements. They have not made any final parking arrangements as of yet , but will continue to work on it . It is possible that some of the local businesses would make a commitment to provide some parking. Lynne Webster, 3843 Red Oak Court , stated that she is a member of the City' s Landmarks Commission , and it is their desire that this variance be granted so that the historical significance of this building may be retained. Unless this variance is granted, the ballroom will probably be turned into apartments . Mrs. Weisheipl stated that all her customers will be told not to use Mrs . Ratzburg' s driveway, and will be told where to park. They will continue to look for parking to meet the City' s requirements . She stated that she understood she would have to come back before the Board if she cannot provide adequate parking. Mrs . Hintz stated that Mrs . Weisheipl will be prevented from getting a building permit to fix up this building until she can provide adequate parking. Mr. LaLond made a motion to approve the variance requests as stated in the Agenda. Mr. Goldthwaite seconded the motion. Motion carried 5-0 . II . Appeal of Steven Schmidt , Agent for Francis Spellman , owner of 1713 W. New York CSpellman ' s Marina) . Mr. Rosenquist explained that the owner wishes to erect a building within the Floodplain , without elevating or floodproofing the building. Mr. Spellman stated that they wish to move a building from Merritt Street to his Marina property. Said building would be used for repairs and storage and would be aligned with the other buildings on his property along W. New York. A 0 ' setback from the iJeF� York Street property line exists from the other existing buildings , and would also exist from the new building, whereas a 25 ' setback is required. However, there are no other homes or buildings along this street which would be affected by this setback. Mr. LaLond made a motion to approve this variance request . Mrs. Hintz seconded the motion. Motion carried 5-0 . III . ppeal of Jean Lincoln, owner of 501 Otter Avenue , proposes to convert a garage area into a bathroom facility. : Mr. Rosenquist explained that variance request should be changed from that shown on the Agenda. A variance from the sideyard setbacl: is . not required, but a 1 ' rear yard setback exists , whereas a 13 ' rear : yard setback is required. Board of Zoning Appeals Minutes September 2 , 1981 Meeting Page Three Mrs. Lincoln explained that her paraplegic husband will be returning home soon and will need access to bathroom facilities. The rear end of the garage is the only area of the home that would accommodate these requirements , and there would still be sufficient space for their small car to be parked in the front . Mr. Goldthwaite made a motion to approve this variance request as amended from the Agenda. Mr. LaLond seconded the motion. Motion carried 5-0 . IV. Appeal of Terry Kulibert , owner of 447 Boyd Street , proposes to erect a 12 ' X 3 ' illuminated wall sign in the R-2 District . A maximum of 1 sq. ft. is allowed for a wall sign in this district . Mr. Rosenquist stated that the Agenda should be changed to read that Mr. Kulibert is the agent for St. P�ary' s Congregation, the owners. _ Mr. Kulibert explained that he operates the bowling alley in the basement of the St. Mary' s parish and needs this sign for identification. New people coming to the alley have problems finding it, and he will be having new leagues start soon. Mr. Miller asked why this large a sign was needed. The bowling alley has been there for many years and has been heavily used. Mrs. Hintz stated that an illuminated sign should not be needed, and a 1' X 1 ' sign in the door should be sufficient to identify this bowling alley. She stated that the parishioners of St. Mary' s would probably object to this large , illuminated sign hanging on their parish, if they were informed about it . Harold Rusch, 448 Boyd Street , objected to this large, lighted sign, because it would shine in his windows at night and would be offensive on the parish building. He stated that the bowling alley is not hard to direct people to for the first time and has never needed a sign before. Mrs. Alda Evenson, 450 Boyd Street , objected to this sign for the same reasons as Mr. Rusch. Mr. Rusch said that he represented another neighbor , Mrs . Meyer, of 446 Boyd Street , who also objected to this variance request. Mr. LaLond made a motion to approve this variance request. Mrs . Hintz seconded the motion. Motion was denied 5-0. V. Appeal of James McCartney, owner of 1102 Bowen Street , proposes to keep a 6 ' high fence between the house and the front property line, whereas a 4 ' high fence is the maximum allowed.
