HomeMy WebLinkAbout51. 16-164MARCH 22, 2016 16-164 RESOLUTION (CARRIED___7-0____ LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: AMEND 2016 CAPITAL IMPROVEMENT PROGRAM (CIP) AND APPROVE PURCHASE OF TACTICAL RESPONSE RESCUE VEHICLE PURSUANT TO USED OR SURPLUS EQUIPMENT EXCEPTION (SECTION 12-13) FOR POLICE DEPARTMENT FROM WINNEBAGO COUNTY ($49,026.00) INITIATED BY: PURCHASING DEPARTMENT WHEREAS, the City of Oshkosh has been offered Winnebago County’s Bearcat tactical response rescue vehicle that they were intending to trade-in for a new, similar vehicle, and this vehicle is appropriate for use by the Police Department for the protection of its officers, other rescue personnel, and the public; and WHEREAS, the amount requested by Winnebago County is the proposed trade-in value of $49,026.00 that they were offered by a dealer or vendor, with this amount being less than the cost of purchasing a similar vehicle directly from dealers or vendors, regardless of whether the vehicle is new or used; and WHEREAS, the Oshkosh Municipal Code contains an exception from bidding requirements in Section 13-12 which exempts surplus or excess equipment from the formal competitive bidding processes. WHEREAS, the 2016 Capital Improvements Program Budget contained contingency funds which may be used for the purchase of this vehicle; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the offer by Winnebago County for the purchase of the tactical response rescue vehicle is hereby accepted and the proper City officials are hereby authorized and directed to enter into an appropriate agreement for the purpose of same, all according to plans, specifications, and bid on file. BE IT FURTHER RESOLVED that the 2016 Capital Improvement Program Budget be amended to transfer sufficient funds from the Contingency Fund to the Equipment Fund for Motor Vehicles to purchase the tactical response rescue vehicle. Box 1130 Oshkosh, Wisconsin �+I+`/ O� Oshk�sh 54903-1130 t� �� � � OlHKOlH TO: Honorable Mayor and Members of the Common Council FROM: Jon Urben, General Services Manager DATE: March 16, 2016 RE: Approve Purchase of Tactical Response Rescue Vehicle Pursuant to Used or Surplus Equipment Exception (Chapter 12-13) for Police Department to Winnebago County ($49,026) BACKGROUND Winnebago County will be purchasing a new Bearcat vehicle for their Sheriff's Office to respond to tactical situations. As a result of this, and because of the city's strong relationship with Winnebago County, they have offered their former Bearcat tactical response rescue vehicle to the city for the trade-in value of $49,026 offered from Lenco, the vehicle manufacturer. It should be noted Lenco regularly takes vehicles such as this in trade and re-sells them for a minimum of $130,000. Winnebago County's offer provides a unique opportunity for the city to acquire a tactical response rescue vehicle that had been identified as a need for the Police Department for many years, at far less than the $200,000 cost for a similar new vehicle. ANALYSIS This vehicle's primary purpose will be to provide additional protection for police officers, firefighters, paramedics and citizens who are in high risk situations involving gunfire or where the potential for gunfire is high. These types of vehicles have been proven invaluable here within the Fox Valley on several recent high risk situations. Previous tactical incidents have shown that more than one such vehicle may be required in tactical incidents to successfully and peacefully end such incidents. This tactical response rescue vehicle is a Ford F-550 truck used to transport individuals and designed with protective armor. There are no weapons mounted on this vehicle. Like any other tool that police officers have at their disposal, the use of this vehicle will be driven by strong policy that will ensure that the vehicle is used properly and for the right reasons. This vehicle has been inspected by city staff and is in excellent mechanical shape and as such will require minimal maintenance. The city has verified with Winnebago County that they have met all of their financial obligations related to the grant that funded the �� initial purpose of this vehicle and as such, can sell the vehicle to the city as surplus property. The city follows the same practice that regardless of how an item is funded, once that item is of no use to the city we dispose of it as necessary and receive whatever financial return that sale of property may bring. The City Manager has approved this purchase. FISCAL IMPACT The total fiscal impact of this vehicle would be $49,026 to Winnebago County. Finance has confirmed there is available funding in the 2016 CIP Major Equipment Project Contingency for this purchase. Costs for this project will be charged to A/N#: 323-0211- 7210-06636. RECOMMENDATION Section 12-13 of the Municipal Code provides that subject to approval of the City Manager, purchases may be made without following a formal competitive bidding process when the purchase is for the acquisition of any used or surplus or excess equipment, materials or supplies, from a federal, state or local government if the Purchasing Authority in consultation with the appropriate department head determines that such acquisition is in the best interest of the City. In accordance with Section 12-13 of the Municipal Code, and because this purchase is in excess of $25,000, Purchasing recommends the Common Council approve this purchase of this surplus tactical response rescue vehicle from Winnebago County, 415 Jackson Street, P.O.
