That a temporary exception to the prohibition to extending water service beyond the legally established city limits in Section 20-11(A) of the Oshkosh Municipal Code be permitted for the properties located at 3696 Stearns Road and 1985 West Snell Road for the purpose of constructing the Snell West Sanitary Pump Station. That this temporary exception shall begin with the passage and publication of this ordinance and shall automatically repeal and terminate upon the reestablishment of potable water to the parcels through private wells or a date two years from the publication of this ordinance, whichever is earlier, without further action of the Common Council being required. SECTION 2. This ordinance shall be in full force and effect from and after its passage and publication and shall automatically repeal and terminate upon the reestablishment of potable water to the parcels through private wells or a date two years from the publication of this ordinance, whichever is earlier, without further action of the Common Council being required. The ordinance allows the City to provide temporary water service to two Town of Oshkosh parcels to accommodate the construction of the Snell West Sanitary Pump Station. Clerk’s phone: 920/236-5011. � OHKOH ON THE WATER MEMORANDUM TO: Honorable Mayor and Members of the Co Council FROM: James Rabe, Director of Public Works DATE: March 17, 2016 RE: Approve Providing Temporary Water Service for Town of Oshkosh Parcels from City of Oshkosh Water Distribution System (Staff Requests to Waive the Rules) BACKGROUND Contract 16-03, which was awarded at the February 23, 2016 Common Council meeting, replaces the existing Fountain Avenue wastewater pump station with a new pump station, which will be known as the "Snell West Sanitary Pump Station". The proposed pump station is being constructed to enable effective management of sanitary needs for this area and provide additional capacity to facilitate new development in the northern Jackson Street area. The construction requires significant groundwater dewatering during the construction. ANALYSIS Based upon information obtained from AECOM Technical Services, Inc. through soil borings and monitoring wells, the dewatering wells will be placed in Platteville Dolomite and St. Peter Sandstone bedrock formations. The St. Peter Sandstone is often highly mineralized and the water pumped from this formation can have elevated concentrations of arsenic, iron, manganese, and nickel. Groundwater dewatering from the construction activities may cause heavy metals to release into the groundwater and potentially cause elevated levels of these metals. FISCAL IMPACT In order ensure the Town of Oshkosh parcels, located at 3696 Stearns Road and 1985 West Snell Road, have safe drinking water throughout the construction, the City of Oshkosh is proposing to temporarily connect these parcels to the City of Oshkosh's water supply. The cost for the water and all services required to provide the water is included in the budget for this construction project and was included in the Sanitary Sewer Section of the 2016 Capital Improvement Program. Upon completion of the project, the City will continue to test the parcels' wells. When the wells produce safe drinking water, the parcels will be removed from the City's water system and reconnected to their wells. If the wells do not produce safer drinking water, the City will drill new wells to serve the properties, and disconnect the properties from the City's water system. RECOMMENDATIONS I recommend approval of providing temporary water service for these Town of Oshkosh parcels from the City of Oshkosh Water Distribution System. Due to the 5'h Tuesday in the month of March, and the additional delay that would be caused to the Contractor, I also agree with the request to waive the rules and approve on the first reading.
