OSHKOSH COMPREHENSIVE PLAN UPDATE

PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, under the State's Smart Growth Legislation, the City of Oshkosh is
required to adopt a "Public Participation Plan" to serve as a guideline on how citizens and
organizations will be involved in the update of the City's Comprehensive Plan; and
WHEREAS, In June 2002 Common Council approved a Public Participation Plan
in preparation of the Oshkosh Comprehensive Plan Update; and
WHEREAS, the attached amended Plan sets forth guidelines on groups to be
formed, hearings to be held and procedures for submitting comments; and
WHEREAS, the Plan Commission has reviewed said amended Plan and
recommended its adoption by the Common Council.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the attached amended "Public Participation Plan", “Exhibit A”, is hereby
approved and adopted.

BACKGROUND
In the early 2000's as the City was preparing to move forward to develop a state mandated
comprehensive plan, known commonly as the "Smart Growth" law, one of the requirements
was to approve a Public Participation Plan that would let the public know how the plan was
being developed; who would be involved in the preparation; and how the information would
be disseminated to the public in an effort to incorporate transparency into the process. A
Public Participation Plan was approved which guided the development of the 2005 City of
Oshkosh Comprehensive Plan. Now that the City is undertaking a general update to the
2005 Comprehensive Plan being led by East Central Wisconsin Regional Planning
Commission, staff is proposing some minor updates to the Public Participation Plan that
reflects the update process and clarifies how the public will be involved and how
information/feedback will be developed and disseminated during the update and approval
process. Included in this staff report is a marked up copy of where changes are proposed to
the current Public Participation Plan.
ANALYSIS
Some of the more significant changes proposed are reducing the number of public hearings
from three to two as only one is required including several areas of public involvement and
additional hearings seem unnecessary and administratively burdensome for a minor update.
A change to allow Plan Commission alternates to be members of the Comprehensive Plan
Update Committee (CPUC), even if all other Plan Commission members are present as there
is no total membership cap and the participation of alternates, will be an asset to the overall
update process. A change from Steering Committee meetings to Targeted Focus Group
meetings as this is a minor update versus a major update where more specific time may be
needed to review each element. Steering Committees will once again be used when a major
update is needed in the mid 2020's. A change to utilize recent feedback from past/ongoing
planning projects to be used as a guide for forming recommendations as part of this update
to reflect the time and effort put into developing those plans. A change to the
intergovernmental meetings scheduled to be held clarifying who will be contacted as part of
the update process. The existing Public Participation Plan is over 10 years old and it is
necessary to review and refresh the existing plan given the changes that have occurred in
overall planning and to reflect that this is a minor versus major update to the Comprehensive
Plan.
FISCAL IMPACT
No fiscal impact is anticipated with this update other than there will be less public hearing
notice charges with the reduction in public hearings by one meeting.
RECOMMENDATION
The Plan Commission recommended approval of the amendment to the Comprehensive Plan
Public Participation Plan at its March 1, 2016 meeting.

ITEM: AMENDMENT TO COMPREHENSIVE PLAN PUBLIC PARTICIPATION
PLAN
Plan Commission meeting of March 1, 2016
GENERAL INFORMATION
Petitioner: City Administration
Action Requested:
Amend provisions of the Public Participation Plan that was originally created for the development of
the 2005 City of Oshkosh Comprehensive Plan.
Applicable Ordinance Provisions:
None.
BACKGROUND
In the early 2000's as the City was preparing to move forward to develop a state mandated
comprehensive plan, known commonly as the "Smart Growth" law, one of the requirements was to
approve a Public Participation Plan that would let the public know how the plan was being
developed; who would be involved in the preparation; and how the information would be
disseminated to the public in an effort to incorporate transparency into the process. As such a Public
Participation Plan was approved which guided the development of the 2005 City of Oshkosh
Comprehensive Plan.
Now that the City is undertaking a general update to the 2005 Comprehensive Plan being led by East
Central Wisconsin Regional Planning Commission, staff is proposing some minor updates to the
Public Participation Plan that reflects the update process and clarifies how the public will be involved
and how information/feedback will be developed and disseminated during the update and approval
process. Included in this staff report is a marked up copy of where changes are proposed to the
current Public Participation Plan.
ANALYSIS
Some of the mare "significant" changes, with reasoning for the change following in italics, as
proposed are as follows:
1. Reducing the amount of public hearings from 3 to 2. Statutorily only one public hearing is
required and that is required to be noticed with a 30 day Class I notice. The update process
already exceeds the amount of public hearings required and includes several areas of public
involvement and requiring additional public hearings seems unnecessary and administratively
burdensome for a minor update.
2. Allowing Plan Commission alternates to be members of the Comprehensive Plan Update
Committee (CPUC) even if all other Plan Commission members are present. The CPUC
allows extra members to be appointed as needed with no total membership number cap so
there is no reason not to allow alternates full participation privileges as the alternate's
experience in general planning will be an asset to the overall update process.
3. Changing from Steering Committee meetings to Targeted Focus Group meetings. This reflects
that this is a minor update versus a major update where more specific time may be needed on
each element outside of the CPUC. During the development of the 2005 Comprehensive Plan
separate steering committees were created for each of the major elements of the plan. When
a major update is needed again in the mid 2020's it is likely steering committees will once
again be used to review each element.
4. Utilizing recent feedback from past/ongoing planning projects. The feedback and
recommendations developed in more recent community planning projects will be used as a
guide for forming recommendations as part of this update process and this reflects the time
and efforts those individuals and organizations put into developing those plans.
5. Intergovernmental Meetings. While intergovernmental meetings were held during the 2005
process and part of the development of the intergovernmental element, this change just
clarifies who will be contacted as part of the update process.
In general the existing Public Participation Plan has served the city well but as it is over 10 years old
and with the city embarking on a minor update process it is necessary to take a look at the existing
plan and refresh where needed given some of the changes that have occurred in overall landscape of
planning. The proposed changes also reflect the fact that this is proposed as a minor versus major
update to the Comprehensive Plan.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the Public Participation Plan as proposed.
The Plan Commission approved of the amendment to the Public Participation Plan as requested. The
following is the Plan Commission's discussion on this item.
Mr. Burich explained that this was not an amendment to the Comprehensive Plan itself but an
amendment to the policy document which guided the general update to the plan which was being led
by East Central Wisconsin Regional Planning Commission. He reviewed the Public Participation
Plan and stated that this was an update to the existing plan. He explained that there were not a lot of
major changes to the existing plan and reviewed the items that would be revised. Those changes
would be reducing the number of public hearings held from three to two, allowing Plan Commission
alternate members to be members of the Comprehensive Plan Update Committee, changing from
Steering Committee meetings to Targeted Focus Group meetings, utilizing feedback from
past/ongoing planning projects, and clarifying intergovernmental meetings and who would be
notified as part of this process.
Mr. Bowen left at 5: 40 pm.
Mr. Thoms questioned if there was any procedure that could be implemented to allow alternate Plan
Commission members to be able to vote when the updated Comprehensive Plan is presented to the
Plan Commission as they currently cannot vote if the regular full members of the Commission are all
present.
Mr. Burich responded that is likely limited by either state statute but would check into the question.
Mr. Gray commented that since all regular Commission members do not attend the meetings, he most
times is allowed to vote on items at the meeting. He stated he was confused about the role of what
the temparary ad hoc members would be.
Mr. Burich explained that the ad hoc members would serve on the Comprehensive Plan Update
Committee (CPUC) on a temporary basis for the duration of the update to the Comprehensive Plan.
Item -CP Plan Participation Plan
He discussed who should be invited to participate in this process and explained that it was not a
permanent standing committee. He further discussed the CPUC membership and how it functions.
Mr. Gray questioned why temporary ad hoc members were appointed to serve on the CPUC.
Mr. Burich indicated that the ad hoc members expand knowledge and input on key areas of the city
and that there were no issues during the last process with this procedure.
Mr. Thoms questioned how it would be handled if another person is appointed for a brief period to
review just specific sections of the Plan as this could only last for 3-5 weeks.
Mr. Gray commented that he felt we need to specify what temporary is defined as.
Mr. Burich responded that it will be determined at the time of the appointment what the duration of
time to be served would be.
Mr. Borsuk commented that the only permanent group of inembers would be the Plan Commission
members themselves and any other members appointed would be considered ad hoc members.
Mr. Gray inquired if ad hoc members are allowed to participate in discussion and make motions.
Mr. Burich responded affirmatively.
Motion by Nollenberger to approve an amendment to the Comprehensive Plan Public
Participation Plan.

PURPOSE
In an effort to address the guidelines for adopting comprehensive plans under the Smart Growth Legislation, the
Planning Services Division staff has drafted this public participation plan. While no specific dates are given in this
plan, the document serves as a general guideline on what groups will be formed, which hearings will be held, and the
procedures for submitting written and oral comments. This Public Participation Plan will be forwarded 4o the Common
Council via the Plan Commission for approval and revisions, as necessary.
Comments and questions regarding the Comprehensive Plan Update can be forwarded to the Department of

PUBLIC PARTICIPATION PROCESS
WISCONSIN STATE STATUTES CHAPTER 66: GENERAL MUNICIPALITY LAW
66.1001 Comprehensive planning, (4) PROCEDURES FOR ADOPTING COMPREHENSIVE PLANS. A local
governmental unit shall comply with all of the following before its comprehensive plan may take efFect:
(a) The governing body of a local governmental unit shall adopt written procedures that are designed to foster public
participation, including open discussion, communication programs, information services and public meetings for
which advance notice has been provided, in every stage of the preparation of a comprehensive plan. The written
procedures shall provide for wide distribution of proposed, altemative or amended elements of a comprehensive plan
and shall provide an opportunity for written comments on the plan to be submitted by members of the public to the
governing body and for the governing body to respond to such written comments.
The following represents the approach the City will take to inform and involve the public:
• Public hearings, . �
• Web-based, on-line and traditional surveys,
• City's website,
• Town Hall/Open House meetings,
• Comprehensive Plan Update Committee meetings,
• Targeted Focus Group Meetings,
• Television,
• Media and press releases,
• Presentation to professional and civic groups, and
• One-on-one meetings with government and public service officials,
• Intergovernmental meeting(s) with area municipalities, Winnebago County and State agencies
• Recent feedback from pasUongoing planning projects.
Public Hearings
The requirements for the number of public hearings, as outlined in the Wisconsin Statues, will be exceeded.
According to statues, at least one public hearing must be held, at which the proposed ordinance is discussed: At least
two public hearings will be held regarding the Plan. One public hearing will be with the Plan Commission and one
with the Common Council. All public hearings will be open to the public and written and oral testimony will be taken.
Minutes will be kept by recording secretaries and filed as per usual with either the Department of Community
Development (Plan Commission) or the City Clerk's office (Common Council).

specialized needs (language interpreter, handicap accessibifity, etc.) please calf 920.236.5057 with any questions

Surveys _ -
A web-based, on-line survey of the citizens of the City will be conducted throughout out the planning process.
Hardcopies of the survey will at a minimum be made available at the library, City Hall, the Chamber ofi Commerce,
�he Senior Center, and on the Internet at htt :!/www.ci.oshkosh.wi.uslCommuni Develo ment/. Citizens will have
the option of delivering, mailing, or faxing the survey to the Planning Services Division, or e-mailing the survey via the
City's internet site.
The City will also be asking a few strategic questions regarding planning as part of its Annual Citizen Survey. This
survey is sent out annual in February/March to 1,500 random addresses within the City. Several questions were
developed for inclusion in the survey pertaining to the comprehensive plan and its future vision.

Information will be provided through the City's website, specifically through the Community Development's page
athttp�//www ci oshkosh.wi.us/Communitv DevelopmenU. fnformation wili include meeting notices and summaries
and drafts of chapters of the Comprehensive Plan document. A feedback option is provided so that questions and
comments can be forwarded electronically to the Planning Services Division.
Town Hall/Open House Meetings
1n additional to public hearings, Town halUopen house meetings will be held to solicit input from the general
citizenship and to provide information on the p4anning project. Towards the end of the project, a draft of the plan,
including maps will be available for viewing in an open house format and on the City's website. At all of these
meetings, participants will be able to submit written comments regarding the plan.
Comprehensive Plan Update Committee (CPUC) Meetings
The Comprehensive Plan llpdate Committee (CPUC) shall consist of the existing Plan Commission with additional
temporary ad hoc members being appointed as needed by the Plan Commission in order to expand knowledge and
input on key areas of the City. The Chairman and Vice-Chairman ofi the Plan Commission will serve in these same
positions for the CPUC. The participants of this committee are sfiown in the document titled "Committees List." All
meetings wi11 be open to the public and notices wi{I be posted in the Oshkosh Public Library, at City Hall, and on the
internet site. Attendance and minutes will be taken for these meetings. The minutes will be posted on the City's
internet site and will be available in the Department of Community Development office.
Because the CPUC will make decisions and approye various documenis throughout the process, a majority of
members wi{I need to be present to make those decisions. In instances where a CPUC member (other than those on
the Plan Commission) is unable to attend, a proxy may be sent in that member's place to participate and vote in any
decisions made by the CPUC.
Targeted Focus Group Meetings
A series of up to four (4) targeted focus group visioning sessions woufd be devefoped in concert with input from the
Community Development Department staff. These sessions would target specific areas/groups within the city and
would be best defined by geography or topic. For example (but subject to change) fhey might include Commercial
Corridors & Business Owners, Neighborhood Association Leaders, West Side Growth Area Landowners, and Elected
Officiais (Plan Commission and Common Council).

Television
The local cable access station, Channel 10 (Oshkosh Community Access Television - OCAI�, will be used as a
venue for updates during the planning process. For example, some appearances may be made by the City Manager
or the Director of Community Development to encourage citizens to complete a survey or attend a meeting. In
addition, the two public hearings before the Common Council will be broadcast on Channel 10.
Media and Press Releases
In addition to required notices being published in the newspaper, it is anticipated that the media will play an active
role in the public awareness process. This may occur in the form of newspaper articles or interviews with the City
Manager or Director of Community Developmenfi on the status of the project. The media (radio and newspaper) will
be notified of all meetings held throughout the process.
Presentation to Professional and Civic Groups -
It is anticip.ated that presentations will be given to various civic groups, service clubs, and business organizations
throughout the process.
One-on-One meetings with Government and Public Service Officials
In addition to various government and public service officials serving on the update Committee and the Steering
Committees, meetings will be held with individuals to gather in-depth recommendations and comments. This includes
community leaders, public officials, and agency directors.
Recent Feedback from Past/Ongoing Planning Projects
The City also intends on utilizing any public input which was/has/will be generated from recent and/or ongoing
planning studies. This includes, but is not limited to:
• Downtown Master Plan (Ongoing)
• City of Oshkosh RiverFront Visioning Plan (2015)
• Oshkosh Metropolitan Planning Organization (MPO) Long-Range Transportation Land Use Plan (2015)
• Oshkosh MPO Bicycle & Pedestrian Plan (2014)
• City of Oshkosh Pedestrian and Bicycle Circulation Plan (2012)
• Gity of Oshkosh Comprehensive, Outdoor Recreation Plan (2011)
•. Oshkosh Transit — Transit Development Plan (2011)
• County Health Improvement Plan (CHIP) (2010)
Intergovernmental Meetings
One or more meetings will be held inviting elected officials and staff from adjacent municipalities as well as other
overlying governmental jurisdictions such as school districts and sanitary districts, and potentially impacted state
agencies such as the Wisconsin Department of Natural Resources and Wisconsin Department of Transportation.
PLAN ADOPTION
The Plan Commission will hold the first public hearing using proper statutory procedures. The plan update that is
recommended by the Plan Commission will not take effect until the Common Council enacts an ordinance that adopts
the plan. The Plan Commission may recommend the adoption or amendment of the comprehensive plan update only
by adopting a resolution by the majority vote of the entire commission. Their vote will be recorded in their official
minutes. A copy of this adopted plan update shall be sent to the governmental bodies located in whole or in part
within the boundaries of the City, the clerk of every local governmental unit that is adjacent to the City, the Wisconsin
Land Council, the Wisconsin Department of Administration, the East Central Wisconsin Regional Planning
Commission, and the Oshkosh Public Library.

The ordinance is enacted by only a majority vote of the Council. The Council must hold at least one public hearing at
which the proposed ordinance is discussed. a A class 1 notice wil! be published at least 30 days before the hearings
with the Plan Commission and Council containing the following information:
• The date, time, and place of the hearing;
• A summary, which may include a map, of the proposed comprehensive plan update or amendment to the
plan;
• The name of an individual employed by the City who may provide additional information regarding the
proposed ordinance; and
• Information relating to where and when the proposed comprehensive plan update or amendment to such
plan may, be inspected before the hearing, and how a copy of the plan or amendment may be. obtained.
Copies of the proposed plan update will be made available for viewing at the Oshkosh Public Library and at the
Department of Community Development and on the City's website, at the time the public hearing notice is published.
Any duplication costs will be incurred by the person requesting such duplication.
After the notice of this hearing has been published, written comments on the plan update may be forwarded to the
Department of Communiry Development. Written comments will be accepted up to one week prior to the public
hearing and wi41 be addressed at the hearing.
Any proposed revisions after the plan update has been presented to the Plan Commission hearing or at the first
Common Council hearing will be noted in the meeting minutes and posted on the internet site prior to the final public
hearing.
After enactment of the ordinance for adoption of the plan, a copy of the plan update wi{I be forwarded to the
governmental bodies located in whole or in part within the boundaries of the City, the clerk of every local
governmental unit that is adjacent to the City, the Wisconsin Land Council, the Wisconsin Department of

The local cable access station, Channel 10 (Oshkosh Community Access Television - OCA�, will be used as a

addition, the iwo public hearings before the Common Council wili be broadcast on Channel 10.
Media and Press Releases
In addition to required notices being published in the newspaper, it is anticipated that the media will play an active
role in the public awareness process. This may occur in the form of newspaper articies or interviews with the City
Manager or Director of Community Development on the status of the project. The media (radio and newspaper) will
be notified of ail meetings held throughout the process.
Presentation to Professional and Civic Groups
It is anticipated that presentations will be given to various civic groups, service clubs, and business organizations
throughout the process.
One-on-One meetings with Govemment and Public Service Officials
In addition to various govemment and public service officials senring on the update Committee and the Steering
Committees, meetings wili be held with individuals to gather in-depth recommendations and comments. This includes
community leaders, public officials, and agency directors.
