O OJHKOlH ON THE WATER MEMORANDUM TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: March 3, 2016 RE: Approve Conditional Use Permit Request for a Public Utility Structure at the 3400 Block of North Main Street (Plan Commission Recommends Approval) BACKGROUND The subject site consists of approximately 11.869 acres of city-owned land located at the western 3400 block of N. Main St. The subject site consists of vacant, undeveloped land with an M-3 General Industrial District zoning. The surrounding area is comprised of industrial uses to the north, south and east (located in the city), and agricultural and single-family residential uses to the west (located in the Town of Oshkosh). The City of Oshkosh Common Council approved the initiation of the acquisition process for the property on January 13, 2015 (Resolution 15-28), followed by annexation of the property to the City from the Town of Oshkosh on November 24, 2015 (Ordinance 15-506). ANALYSIS In 2014, the Common Council established Tax Incremental District #27: North Main Street Industrial TID with the primary purpose to facilitate the development of public utility improvements to encourage new industrial development, redevelopment and expansion of businesses in the North Main Industrial Park area by eliminating the need for on-site retention ponds in favor of developing regional storm water management facilities. Many of the developments in the North Industrial Park and surrounding area are constrained from future growth by storm water management requirements as the area has already been intensely developed. The City hired consultants to perform a storm water management study and a watershed management plan for the Fernau Avenue Drainage Basin to guide in addressing existing flooding issues, manage storm water from future development and reduce storm water pollution. The subject site was identified as suitable to provide water quality and flood control from the upstream area. The main basin contains two fore basins; one at the northeast corner collecting storm water from North Main Street and the second at the southwest corner collecting water from the Jackson Street system. Water will exit the main basin and be directed back to North Main Street and eventually to Lake Winnebago. A wetland delineation was conducted identifying areas of wetlands which will be seeded with native vegetation where impacted and the area will be open space providing aesthetic vistas and wildlife habitat. A landscape plan has been submitted depicting a variety of plantings and will need to meet minimum standards required by zoning ordinance and compliance will be verified during the site plan review process. The Comprehensive Plan designates this area for industrial uses and the basin development is consistent with this recommendation as it will provide infrastructure for existing developments and properties located in the watershed. Funding for the project will be provided by the Storm Water Utility and TID #27, has been included in the 2016 Capital Improvements Program and is part of the City's continued efforts to provide flooding relief as well as continued industrial growth within the North Industrial Park. FISCAL IMPACT Funding for the project will be provided by the Storm Water Utility and TID #27 and has been included in the 2016 Capital Improvements Program. RECOMMENDATION The Plan Commission recommended approval of the conditional use permit at its March 1, 2016 meeting. The primary purpose of the TID is facilitating the development of public utility improvements to assist and encourage new industrial development, redevelopment, and expansion of businesses in the North Industrial Park area by reducing or eliminating the need for on-site retention ponds in favor of the approach of developing regional storm water management facilities, which the City now routinely incorporates into all new industrial and business parks. The North Industrial Park and surrounding area was developed prior to modern storm water regulations. Current storm water guidelines can require significant areas be devoted to storm water management. Many of the developments in the North Industrial Park and surrounding area have already been intensely developed and are thus constrained from future growth by new storm water management requirements. New regional storm water basins will alleviate some of these onsite needs thus allowing more expansion and development capability. TID #27 Project Plan includes a Proposed Improvement Plan which identifies the subject site as one of three areas appropriate for storm sewer and storm water detention (see attached plan). This request involves the proposed detention basin identified as the Main Street Detention Basin in the TID plan. The City hired engineering consultants Brown and Caldwell to perform a storm water management study and complete a watershed storm water management plan for the Fernau Avenue Drainage Basin to guide the city in addressing existing flooding problems, manage storm water from future development in the watershed, and reduce storm water pollution. Brown and Caldwell identified the location of the subject area along the 3400 block of North Main Street, as an area suitable to provide water quality and flood control for runoff from the upstream area (the upstream areas served include all parcels north of the site fronting on Main Street and fronting Jackson Street north of the north leg of Logan Drive). The consultant also performed a similar study of the drainage system for the Libbey/Nicolet Watershed to the south and identified a parcel of land approximately 0.8 miles south of this site suitable for construction of another storm water basin. As a cost saving measure, the city will construct both ponds in unison as part of one project. The Department of Public Works acquired the subject 11.87 acre site for construction of the recommended storm water detention basin within the Fernau Avenue Watershed. The proposed detention basin will allow for storm water runoff to collect up to 63 acre-feet (20,528,613 gallons) of storm water and will reduce flooding to properties within the watershed as well as providing water quality treatment to storm water runoff. It is estimated that the basin will remove 30 tons of sediment and 96 pounds of phosphorus from storm water annually prior to entering Lake Winnebago. The reduction in these pollutants will contribute to the pollutant reduction targets required by the City's storm water permit. The proposed basin itself covers approximately 90% of the 11.87 acre parcel. The main basin contains two forebasins; one located at the northeast corner collecting storm water from N. Main Item — CUP —Storm Water Detention Basin — 3400 Block of N. Main Street Street and the other located at the southwest corner which will collect water from the Jackson Street storm water system. Water will then exit the main basin at the southeast corner, heading back to N. Main Street and eventually to Lake Winnebago. A wetland delineation was conducted in October of 2015 resulting in approximately 0.5 acres (21,780 square feet) of the existing farm field identified as wetlands as dictated by the Wisconsin Department of Natural Resources. It is anticipated that 3,322 square feet of the identified wetlands will be disturbed during construction of the basin. The wetlands impacted by construction and outside of the construction area will be seeded with native vegetation. A landscape plan has been submitted, and depicts a variety of emergent plantings, grasses, Burr Oak trees and clusters of arborvitae. The landscape plan will need to meet minimum planting standards required by the zoning ordinance and will be checked for compliance during the site plan review process. Staff does not have concerns as the Department of Public Works has historically done a very good job in regard to landscaping its municipal storm water basins. The applicant also states in their narrative that the area will be preserved as open space and planted with natural vegetation providing aesthetic vistas and wildlife habitat. The Comprehensive Plan designates this area as appropriate for industrial uses. The proposed basin development is consistent with the Comprehensive Plan's recommendation as it will be an addition of City infrastructure to provide storm water capacity to existing developments and provide flooding relief to properties located in the aforementioned watershed. Funding for the proposed project will be provided by the Storm Water Utility and TID #27 and has been included in the 2016 Capital Improvements Program for construction. Staff is in support of the conditional use permit request as this is part of the City's continued efforts to provide storm water flooding relief to high flood risk areas of the City as well as allow for continued industrial growth within the North Industrial Park. RECOMMENDATION/CONDITIONS Staff recommends approval of the Conditional Use Permit for the wet storm water detention basin a presented. The Plan Commission approved of the Conditional Use Permit as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He discussed the previous acquisition and annexation of the property and the establishment of Tax Incremental District #27 and its purpose. He discussed the advantages of the creation of regional storm water detention basins rather than the individual on- site basins and the existing developments in the area which do not allow for future growth as they are constrained from any expansion due to storm water management requirements. He reviewed a map of the TID #27 project plan depicting the location of detention basins to be constructed to serve this area and discussed the storm water management study and watershed storm water management plan completed by consultants which identified this site as an appropriate location for a detention basin. He reviewed the site plan for the basin and discussed how it functions and the Item — CUP —Storm Water Detention Basin — 3400 Block of N. Main Street advantages to controlling the storm water runoff and the reduction of pollutants that will result with the construction of the proposed basin. He reviewed the direction of the water flow through the basin and the wetland delineation that was conducted and that the wetland area impacted by the construction will be seeded with vegetation to meet Wisconsin Department of Natural Resources requirements. He also discussed the landscape plan submitted which will be reviewed and approved during the site plan review process and will be required to meet code requirements. He stated that the proposal is consistent with the City's Comprehensive Plan and funding for the project will be provided by the Storm Water Utility and TID #27 and has been included in the 2016 Capital Improvement Program. Mr. Hinz questioned if the channel improvements were natural features of the area or needed to be constructed. Mr. Gohde explained how the channels were part of the TID plan for long term storm water control and that they were existing ditches that will be maintained as part of the system. Mr. Thoms inquired if the detention basin was only meant to provide relief from flooding issues for the industrial park and not for any residential properties. Mr. Nau reviewed the map of the existing flooding conditions and identified the area of the Fernau Avenue Watershed and explained that there were some residential properties that would benefit from it but it mostly would serve the Industrial Park. Mr. Gohde added that this detention basin was mainly for Industrial Park purposes and discussed the it was only one project that will be necessary and the other basins that will need to be constructed within this watershed in the future to address other areas of concern. Mechanical equipment includes, but is not limited to; HVAC equipment, elech-ical transformers and boxes, exhaust flues, plumbing vents, gas regulators, generators, etc. Fernau Watershed Wet Detention Basin Conditional Use Permit Project Narrative PROJECT SETTING The City of Oshkosh experienced significant and repeated flooding throughout the City; August 1982, September 1986, June 1990, August 1990, 1993, 1996, June 1999 (twice), 2000, June 10-11, 2004 and June 12-13, 2008. The City of Oshkosh undertook a detailed watershed analysis of the pipes, channels and ponds in the Fernau Watershed that showed the extent of flooding in the watershed (Exhibit A) and identified two parcels along N. Main Street where the detention of storm runoff would significantly reduce downstream flooding. A similar study of the drainage system in the Libbey / Nicolet Watershed identified a parcel of land, just 0.8 miles further south on N. Main Street that would significantly reduce flooding in that watershed. Construction of both basins would require nearly identical skilled dewatering capabilities of the contractor and clay material from the Libbey / Nicolet site could be used to construct the (northern) Fernau basin at a significant cost savings to the City. To take advantage of the economies of scale to resolve flooding in two watersheds, the City of Oshkosh has pursued constructing these storm water detention basins as one project. The Femau Basin is identified as Work Unit B and the Libbey / Nicolet Basin is identified as Work Unit A. THE PROJECT Work Unit B, the 11.7 acre Fernau Watershed — North Main Street Area Wet Detention Basin (Exhibit B), is a wet detention basin that will be able to detain up to 63 acre-feet of storm runoff. The Basin will provide flood relief and the treatment of storm water pollution from existing and future development for 192 acres of the Fernau Watershed. PROJECT LOCATiON The proposed Fernau Basin is located west of North Main Street, between Snell Road and Fernau Avenue, approximately800 feet north of Fernau Avenue. The detention basin is located immediately north of an un-named stream (locally referred to_ as the North Branch of Fernau Creek). The project also involves the realignment of the existing ditch from the west side of N. Main Street to an enclosed box culvert on the east side. A 30-foot easement (Exhibit C) has been obtained from the Wisconsin Public Service Corporation for this construction. CURRENT AND SURROUNDING LAND USE Current Land Use The 11.9 acre property upon which the Fernau Basin will be constructed was currently being farmed. The property is zoned M-3 by the City of Oshkosh 0 In October, 2015 an Assured Wetland Delineator identified approximately 0.5 acres of the farm field that would be classified as wetiand by the Wisconsin Department of Natural Resources. These wetlands were farmed in 2015, and contain very few native species. Only 3,322 square feet of these wetlands will be disturbed as part of the detention basin construction. The area impacted by construction and the wetland areas outside of the limits of construction will be seeded with native vegetation. Properties Surroundin� the Basin ' The two businesses to the south side of the Basin are zoned M-3. The business to the north of the Basin is zoned M-3. East of fhe Basin are two (2) businesses across N. Main Street that are zoned M-3. The three properties to the west of t_he basin face Jackson Street and are outside of the City of Oshkosh. All three parcels are zoned R-1 by the Town of Oshkosh. The northern most parcel is a residential property. The� rernaining two parcels are currently being farmed. PROJECT PURPOSE The purpose of this project is threefold, Safety, Environmental and Economic Development. Safetv By detaining up to 63 acre-feet of storm runoff the amount of land and the number of business and residential structures that could be damaged by flood waters will be reduced. The restricted discharge - from the basin will also reduce the velocity and quantity of flood waters moving through open channels which will reduce the risk to individuals that might accidentally_ become caught up in the flopd flows. Environmental � The property that has been acquired by the City for the Fernau Basin totals approximately 11.8 acres. In addition to storage of storm water it will be preserved as open space planted with natural vegetation providing aesthetic vistas and wildlife habitat. The Basin has been design with permanent wet pond that has been designed to annually remove approximately 30 tons of sediment (an 87% reduction) and 96 pounds of phosphorus (a 63% reduction) that would have otherwise contributed to the degradation of the water quality in Lake Winnebago. The reduction in pollutant loads will contribute to the pollutant reduction targets that are required by City of Oshkosh's storm water permit. Economic Development The overall design of the wet detention basin, along with other area storm water improvements, will address the future storm water management needs of TIF District #27 such that future land development and building expansions will meet flow control and pollution control requirements without having to add structural measures on the individual properties. The basin and associated storm water improvements are designed to meet both the City's Chapter 14 requirements, and the WDNR NR 151 storm water control requirements.
