UTILITIES / FIRST LOCAL STREET CONCRETE PAVING
PROGRAM (NORTHSIDE AREA)
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Common Council of the City of Oshkosh held a public hearing on
the 9th day of February, 2016, at 6:00 p.m. for the purpose of hearing all interested
persons concerning the preliminary resolution and report of the City Manager (Board of
Public Works) on the proposed improvements as listed below, pursuant to the initial
resolution adopted January 26, 2016, by the Oshkosh Common Council of the following
named streets:
Concrete Pavement, Asphalt Pavement, Grading and Gravelling, Sidewalk
Repair, New Sidewalk, Driveway Aprons, Sanitary Sewer Laterals (New and
Relay), Storm Sewer Laterals (New and Relay), and Water Laterals (New and
Relay):
Bowen Street from 100’ north of Otter Avenue to the Fox River
Mill Street from 100’ north of Otter Avenue to the Fox River
Otter Avenue from 100’ west of Broad Street to 100’ east of Bowen Street
Ceape Avenue from 100’ west of Mill Street to 100’ east of Bowen Street
Bay Shore Drive from 100’ west of Mill Street to 100’ east of Bowen Street
Harney Avenue from Bowen Street to 50’ east of Bowen Street
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh as follows:
1. That the proposed street grades, from a datum plane established by the
official United States Coast and Geodetic Survey, as identified and on file in the
Department of Public Works are hereby permanently established.

2. The Common Council for the City of Oshkosh hereby orders that sidewalk be
constructed according to the established grade pursuant to Section 66.0907 of the
Wisconsin Statutes and the ordinances of the City of Oshkosh on the following
locations:
Bowen Street, east side from Bay Shore Drive to the Fox River
Mill Street, east side from Bay Shore Drive to the Fox River
Mill Street, west side from Bay Shore Drive 155 feet south
3. That the report of the City Manager, acting as the Board of Public Works,
pertaining to the construction of the above described public improvements, including
plans and specifications therefor, is hereby adopted and approved with the following
modifications:

4. That the action of the City Manager in advertising for bids and to carry out
the work of such improvements in accordance with the reports of the City Manager and
in accordance with the said resolution heretofore adopted, is hereby approved, ratified
and confirmed.
5. That payment for said improvements be made by assessing the cost to the
property benefited as indicated in said report, except as modified herein.
6. Assessments shown on the report represent an exercise of the police power
and have been determined on a reasonable basis and are hereby confirmed.
7. That the assessments for all projects included in said report are hereby
combined as a single assessment but any interested property owners shall be entitled
to object to each assessment separately or all assessments jointly for any purpose or
purposes.
8. That the assessments may be paid in cash, or in installments pursuant to
Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to
bear interest at the rate of six percent (6%) per annum on the unpaid balance. The City
Clerk shall publish an installment assessment notice in accordance with Section
66.0715(3)(e) of the Wisconsin Statutes in the official newspaper of the City.

A public hearing is scheduled for Tuesday, February 9, 2016, in the Common Council Chambers at City Hall to
consider improvements to your sheet. S[af( will be available begiuuing at 4:00 p.m. iu Room 310 of City Aall

The public hearing covers the proposed improvements, which include the following: paving, utilities,
sidewalks, and/or driveway approaches and the lery of special assessments that partially cover the cos[ of the
improvements. Assessments are not due un[il the project is certified as complete and [hese charges can be paid
by any one of the plans as outlined by the City Clerk's infortnation on payment plan options. Based upon the
City of Oshkosh assessmen[ policy, the assessable portions of the project have been identified and are outlined
on the attached usessment worksheet(s). The estima[ed distauce for coustruction on side streets is
esfimated high to allow adequate area for the new construction to be transitioned [o [he existing pavemen[.
The quantities and wsts aze esfimates and wi0 be adjusted to the actual quantiry installed. Uni[ costs will be
adjusYed according to the assessment policy based on bid prices. The estima[ed quan[ities for sidewalk
include up to siz (� additional squares ot sidewalk to allow for private utility lateral construc[ion. Only
squares actually removed and replaced to repair defec[ive sidewalk or facilitate [he priva[e utili[y lateral
construction will be billed to the proper[y owner. Additional sidewalk syuazes removed will no[ be billed to [he
property owner if llte Construction Access Agreement previously mailed to them was signed and retumed by
the property owner.
Proper[y owners who have wt retumed [he Constrnction Access Agreemen( will only have partial sidewalk
squares removed and patched. These property owners will be sent orders to replace the pa[ched sidewalk with
permanent wnaete sidewalk in 2017. These properly owners will be financially responsible for replacing
all patched concrete sidewalk, all defective sidewalk, aod all sidewalk tha[ does no[ mee[ [he Americans
with Diaabilities Act (ADA) standarda. Sidewalk equares needing replacemen[ ouly to meet ADA
staudards will oo[ be billed to [he property owuer if the property owoer returns [he Consbuction Access

property owner.
1'he final assessment wst will not increase above the estimated total without another public hearing. Questions
in regard [o payment of Special Assessments can be answered by calling the City Clerk's office at (920)236-
50I1. Ques[ions in regard to [he consWCtion project in general can be answered by calling the Departmen[ of
Public Works Engineecing Division at (920)236-5065.
The sequence of consWCtion has not ye[ been scheduled with a contrac[or. Residents will be notified
approwmately one week before construc[ion will begin on a particulaz street Each street identified in this
year's paving program has been designated a specific time frame in which the conhacror will need to complete
their work on tha[ street The cons[ruction time frames vary from 8 to 18 weeks depending upon the amount of
work and the complexity of the work associated with a specific street. All work within this contrac[ is
scheduled to be completed by the end of November 2016. Wisconsin Public Service and other utility
companies will be relocating some of their facili[ies prior to the City conhactor beginning work. This work is
not part of the above time frame.
A specific description of the projec[ construction consisks of the following elements: concrete pavement with
curb and gutter, relay or insffiIlation of specific segments of water and sanitary sewer mains and their associated
la[erals at various locations along Lhe project; relay or installation oC storm sewer and storm sewer laterals, as
aeeded, along the project to accommodate the draivage needs for the street and the adjacent properties; new
concrete driveway aprons will be construc[ed; and [he existing concrete sidewalk will be repaired, as needed.
Gaps in the sidewalk system will be completed wi[h conshuction of new sidewalk. I[ is recommended that no
sal[ or harsh chemicals be put on the new sidewalk for one (1) year. If you know of any underground wires
and/or pipi�g (exarnples: invisible elechic fence, conduit for exterior lighting, irrigation system, e[c J on your
proper[y which are located near the sidewalk and driveway, please contact the Engineering Division as soon as
possible. Prior [o the completion of the project, all disNrbed areas will be topsoiled, seeded, and covered wi[h
erosion mat. The property owoer is responsible [or watering [he newly vegetated areas. The matting
placed over the seed is biodegradable. Please do not remove t6e mat because it serves as mulch for [he uew
grass. Please set your lawn mower to the highest setting when mowing the new grass areas until [he new grass
areas are well established.
As part of the consV�ctioq a storm lateral is proposed to be installed for each residential lot on the projecL An
eighbinch (8") diame[er surface drain with a slotted drain cover will be placed in[o your yard. The s[orm sewer
la[eral and drain will allow you to direct drainage and/or sump pump hoses ro this location. This drain is
connected [o [he s[ortn sewer system and drains directly [o local streams and lakes. The lateral is to be used for
"cleaz water" only. °Cfear wa[er" is Typically groundwa[er discharged by a sump pump or runoff from
precipi[ation (i.e. rninfall or snow melt). Do not place pe[ waste, yard was[e, or other was[e material in[o
Ihe s[orm sewer system. In tt�e event conditions on the property preven[ [he i�stallation of the drain (example:
a substantial retaining wall), a drain will not be installed, but the storm sewer lateral will be installed
under�ound to ffie property line. You will be receiving additio�al informa[ion about the storm sewer lateral
and draiq including a telephone number for contact to coordinate the lateral's and draids final locatioa The
drain is part of your private lateral and i[ will be yours to main[airt The drain will have a fabric filter installed
as a par[ of the constructioa Pleue leave the filter in place until [he �ass surtounding the drain is well
established. The fabric will prevent dirt and debris from filling the pipe until the grass is established.
Commercial properties will receiva a lazger diarneter storm sewer latecal instal]ed onto fhe property. The
previous [wo pazagraphs assume tbe Construction Access Agreement was signed and retumed by the property
owner.
During construction, there will be periods of time when access to your proper[y will be restric[ed. There will
only be a few instances when this situa[ion will occur. Typically, short access restrictions occur during the

underground u[iliTy installa[ion and longer restric[ions occur during the placement of concrete pavemen[ and
driveways. To minimize the i�convenience, the contractor will provide a one-week mtice prior to the access
being resVic[ed for concrete work. Per the Police Deparhneut, a Construction Parking Permi[ is oot
reauired to park on a stree[ overoight, if vou oark within two (2) blocks of the s[reet under construction
(see encbsed information). All "No Parlring" areas and/or pos[ed Gme zooes must be obeyed. Vehicles
parking overoigh[ mus[ be parked on the house address side of the s[reet that corresponds to the current
date before midnight On odd caleudar dates, the vehicles should be parked on [he odd address side of
[he street. On even calendar dates, vehiclu should be parked on the even address side of the s[reet.
Provisions will be made with the Fire Deparlment and the Sanita[ion Division so fire protection and CiTy
garbage/recycling collection will continue at all times. Please ensure yoar garbage/recyclables are at the
curbside by 7:00 a.m. oo your regular collectlon day. Crews schedule collection of garbage/recyclables in
construction areas a[ the start of each day. If rural-type mailboxes e�st on your street, the contractor will
remove them during constrvc[ioa This removal wil] make it necessary for you [o pick up your mail at [he Post
O�ce. The contrac[or will be responsible so as not to damage the mailboxes. Upon completion of the paving
work, [he conhacto� will reset the mailboxes.
Although terrace trees may need to be removed �at speci£c bcations, they will be preserved as much as
possible. Property owners at locations where a tree needs to be removed will receive advance notice of the
removal and replacemen[ options. Roots and branches may be cut to allow for pavi�g opera[ions. Cutting and
pruning will either be done by, or under [he direction of, the CiTy Forester.

As per Sections 27-27, 27-28, and 27-29 of the Mwicipal Code of the Ciry of Oshkosh, there is no
pazking on CiTy stree[s, 2 AM to 5 AM, unless the owner of vehicle wu granted permission or has
purchased a City parking permit.
If your street or sidewalk is under construc[ion, it is NOT necessary to obtain a parking pertnit if you pazk
your car wi[hin hvo blocks of the street under construction. AII CiTy ordinances and pazking
rules/guidelines must be £ollowed, and all posted pazking restrictions, including [ime mnes and no
parking areas, mus[ be obeyed.
You wiil need to follow [he odd-even rules. On odd days of the week, the vehicle should be pazked on
the side of [t�e street with odd-numbered houses. On even days of the week, the permit holder should
pazk on the side of the street wi[h evemnumbered houses. Each nigh[, the car should be parked on the
opposite side of [he street as the night beFore. NOTE: Odd aud eveu dates are figured before
midoigh4
If parking is only allowed on one side of the street, tk�e Odd-Even rule DOES apply. V ehicles can only
pazk on the side of the s[reet that does not have restricted parking and are only allowed to park ovemight
o� [he appropriate Odd-Even days.
In the case of a declazed Snow Emergency, parking on City stree[s is restric[ed to one side of the stree[
using the Odd-Even rule with dates figured from noon on the calendar date to noon on the followi�g
caleudar date. It is the responsbility of [he vehicle ownedoperator [o find appropria[e pazking in tl�a event
of a snow emergency. Vehicles in violation of snow emergency parking will be towed at the owner's
expense.
Disabled vehicles are �o[ allowed to park overnigh[ a[ any[ime and shouid be moved within 24 hours.
Moror busses, truck trac[ors, semi-trailers and motor trucks designed, used, or maintained primarily for
the hansportation of property u de£ned in Municipal Code 27-26(3) are no[ permitted to park overnight
on Ciry streets.
All stree[ parking is subject to the following guidelines:
• May no[ park in signed / designated "No Parking" areu.
• V ehicles may no[ s[op or pazk in a desi�a[ed "Fire Lane".
• No parking wi[hin 10 feet of a fire hydrant (an ofticial traffic sign may indica[e a gea[er distance
is raqnired).
• No parking in loading mnes .
• No parking wi[hin 4 feet of an alley or private roadway or driveway.
• No pazking wi[hin 15 fee[ to the near limits of a crosswalk.
Failure to follow the above rules could result in parking citations being issued. Individuals wishing to
appeal a pazking citation may do so by completing a Request to Review Pmking Citation form which is
available at tha Oshkosh Police Departrnent Telecommunications Desk, on the Police Deparhnen[ website
(ashkashpd.wm) or on the CiTy of Oshkosh website.

BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its police
power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special
assessments upon property within the following described areas for benefits conferred
upon such property by improving the following:

2. The total amount assessed against such district shall not exceed the total
cost of the improvements and the amount assessed against any parcel shall not be
greater than the benefits accrued thereto from said improvements.
3. The assessments against any parcel may be paid according to the provisions
of Section 25-83 through 25-89 of the Oshkosh Municipal Code.
4. The governing body determines that the improvements constitute an exercise
of the police power for the health, safety, and general welfare of the municipality and its
inhabitants.

5. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the proposed work or improvements.
(c) An estimate as to each parcel of property within the assessment
district of:
(t) The assessment of benefits to be levied for each
� improvement.
(2) The damages to be awarded for property taken or damages
by each improvement.
(3) The net amount of benef�ts over damages or the net amount
of damages over benefits for each improvement.
(4) The total assessment against each parcel
Upon completion of such report, the Board of Public Works is directed to file a copy
thereof in the City Clerk's Office for public inspection.
6. Upon receiving the report of the Board of Public Works, the City Clerk is
directed to give notice of a public hearing on such reports as specified in Section
66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held before the Common
Council at the Council Chambers, Room 406 in the City Hall at a time set by the Clerk in
accordance with the Wisconsin Statutes. The assessment against any parcel may be
paid in cash, paid with the first property tax installment, or in ten (10) installments if the
total amount of the assessment is greater than five hundred dollars ($500.00) or fifteen
(15) installments if the total amount of the assessment is greater than one thousand
dollars ($1000.00).
7. The installation of said street improvements shall be accomplished according
to the provisions of Section 253 through 25-11 of the Oshkosh Municipal Code.

Included in this mailing, is an estimated amount (quantities and costs) of the special
assessment (sheet #5) against your property or properties. A statement of the same is on
file in the offce of the City Clerk. Once Contract No. 16-04 is certified as complete by the
Public Works Department, the final amount (quantities and costs) of the special
assessment against your property or properties will be mailed to you. At that time you will
also receive the papenvork to select a payment choice for the special assessments.
PAYMENT CHOICE OR PAYMENT IS NOT ACCEPTED AT THIS TIME.
THE PAYMENT OPTIONS SHEET YOU WILL RECEIVE AFTER THE CONTRACT IS
CERTIFIED AS COMPLETE WILL HAVE THE FOLLOWING OPTIONS:
INVOICE - PAYMENT WITHIN 30 DAYS
If you choose this option, the City of Oshkosh will then send you a special assessment
invoice and you must make payment within thirty days of that notice.
If the payment is not made within thirty days after receiving the special assessment invoice,
6% interest accrues from the date of notification.
If after making this selection, the property owner fails to make payment to the City
Treasurer; the entire amount including interest will be placed on the neut property tax bill.
TOTAL ASSESSMENT ON NEXT TAX BILL IN FULL
Property owners may elect to pay 100% of the assessment on the next designated real
estate property tax bill, without interest. The total amount of the assessment will be
included on and payable in conjunction with the next designated property tax bill.
TEN ANNUAL INSTALLMENT PAYMENTS ON PROPERTY TAX BILL (ASSESSMENT
MUST BE IN EXCESS OF $500.00)
The amount of the assessment will be placed on the property tax bill with interest at 6% on
