CITY OF OSHKOSH AND BEAVER CYCLE CLUB OF BEAVER DAM
PARAMEDIC AMBULANCE STAND-BY
� 2016 ICE CYCLE RACES ON LAKE WINNEBAGO
. THIS AGREEMENT made and entered into this day of January, 2016, by and
between Beaver Cycle Club of Beaver Dam, hereinafrer called "BEAVER CYCLE CLUB", azid
the Ciry of Oshkosh, a municipal coiporation, hereinafrer called "CITY". .
WHEREAS, BEAVER CYCLE CLUB has requested the CITY provide a dedicated
pazamedic ambulance foc stand-by, during specified houcs for 2016 Ice Cycle Races at
Menominee Pazk in Oshkosh, WI.
WI-IEREAS, the Common Council for the City of Oshkosh has authorized the appropriate
Ciry officials to enter into such an ageement.
NOW, THEREFORE, it is agreed by arid between the parties to this agreement that the
CITY shall provide one (1) two-person paraznedic ambulance and a Kawasaki Mule with
medical transport capabilities to be present at Menominee Pazk during the Ice Cycle Races on .
Saturday, Febmary 6, 2016, from 11:00 am. until approximately 4:00 p.m. �
IT IS FURTHER AGREED that BEAVER CYCLE CLUB shall pay One-Hund�ed-
Twenry-Four pollazs and 25/100 ($12425) per hour foc the ambulance with a minimum billing
[ime of three-hours. $illed tune will commence 30-minutes pdor to the start of stand-by and end
30-minutes after the teanination of stand-by. Any additional hours requested or cequiied to
provide adequate service in the sole opinion of the DuTy Chief for the CiTy of Oshkosh Fire
Department, and shall be added to the prescheduled stand-by hours a�d billed at the same hourly
rate. If for any reason the event is cancelled, a three-hour miuimum wil] be chazged if the event
is uot cancelled at least twelve (12) houcs before the scheduled start tune.
Pre-event cancellation shall be made by calling; 920-236-5240 during normal business
hours (Monday - Friday, 8:00 a.m. - 4:30 p.m.), if outside of norma] business hours call;
920-236-5271.
The CI7Y shall invoice the Beaver Cycle Club of Beaver Dam, c/o Mike
Schwazzenbacher, W9314 CounTy Road G, Beavz: Dzm, WI, 53915, following [he event, with
payment to be made within thirty (30) days of receipt of invoice.
The role of this u�it shall be to provide Basic Life Support (BLS) and Advance Life
SuppoR (ALS) for emergencies, if they occw. Minor first aid and re-hydration will not be a
primary function of this unit. Emergencies requiring a response beyond the capabilities of the
unit on scene or emergencies occurring while the on-scene unit is busy on any emergency will be
ha�dled by a response of on-dury resources.
All patients requiring transport by the Oshkosh Fire Department ambulance will be billed
for services rendered according to the CITY's usua] and customary procedures and rates for
service.
BEAVER CYCLE CLUB shall indemnify and hold harmless the CITY from and against
any and all losses, clauns, demands, pe¢alties, fines, causes of action, cos[s, damages, expenses
and IiabiliTy, incl�ding without ]imitation a�y attomey or coosultant fees, investigation fees,
court cosfs and ]itigation expenses, and othec costs of defense arising out of, or in any manner
related to BEAVER CYCLE CLUB's operatiou during this event, including b�t not ]imited to:
A. Any personal injury or bodily injury (including wrongful death) or properry damage (rea]
orpersonal); . � �
B. Any lawsui[ brou�t oi threateoed, settlement reached, or local, state, or federal
. govemment or agency order, including, but not lunited to claims, costs, liabilities, or
expenses arising under federal, state, or ]ocal law;
C. Any violation of laws, orders, regulations, requirements, or demands of any
govemmental authorities; and,
D. Any breach or violation of any contractual provision of whatever kind with any third

BEAVER CYCLE CLUB and the CITY shall have the right to terminate trus agreement
without cause upoa ten (10) days prior writte� notice to the other party.
