That Section 2-47 Public Arts and Beautification Committee is hereby repealed and recreated as follows: (See the attached “Exhibit A”) SECTION 2. This Ordinance shall be in full force and effect from and after its passage and publication. SECTION 4. Publication Notice. Please take notice that the City of Oshkosh enacted Ordinance #16-XXX APPROVE REPEALING AND RECREATING SECTION 2- 47 PUBLIC ARTS AND BEAUTIFICATION COMMITTEE OF THE MUNICIPAL CODE on February 23, 2016. The Ordinance repeals and recreates Section 2-47 Public Arts and Beautification Committee of the Municipal Code. EXHIBIT A SECTION 2-47 PUBLIC ARTS AND BEAUTIFICATION COMMITTEE (A) Membership and Terms The Public Arts and Beautification Committee shall be composed of seven (7) voting members consisting of: Six (6) citizen members and one (1) Council Member. The Director of Community Development or designee shall serve as coordinator and recording secretary for the Committee. There shall also be appointed two (2) alternate members, who shall be authorized to act in the place of any member who is unable to attend a meeting. Citizen members shall serve three (3) year terms. In addition to these voting members, the Director or his/her designee of the Paine Art Center and Gardens, Oshkosh Public Museum, Oshkosh Parks Department and Oshkosh Public Library shall be nonvoting ex officio advisory members of the Committee. (B) Terms Defined 1) Public Art. The term "Public Art" means any Work of Art acquired by the City and integrated into the design of, or placed or performed in, on or about a place generally accessible or visible to the general public. 2) Work of Art. The term "Work of Art" means any application of skill and taste to the production of tangible objects according to aesthetic principles, including but not limited to paintings, sculptures, engravings, carvings, frescoes, mobiles, murals, collages, mosaics, statues, tapestries, photographs, drawings and ceramics, but excluding purely structural or supportive elements, advertising, or those required by applicable law, code, rule or regulation. (C) Scope of Authority The committee shall provide assistance for Public Art projects that utilize public funding or are located on property owned by the City of Oshkosh. (D) Purpose, Duties, and Functions The Public Arts Advisory Committee shall have the responsibility to: 1) Promote public art and beautification in the community. 2) Advise the City Manager, Common Council and appropriate boards and commissions on matters pertaining to public art and beautification. 3) Facilitate community and agency input pertaining to public art and beautification. 4) Advise the Common Council on Gifts or donations of public art pursuant to the City of Oshkosh Gifts and Donations Policy. 5) Act upon appeals under the City's mural ordinance. MEMORANDUM OJHKOJH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: February 4, 2016 RE: Approve Repealing and Recreating Section 2-47 Public Arts and Beautification Committee BACKGROUND The Public Arts Advisory (PAA) Committee was originally created in connection with the City's gift policy, which was adopted by Council in 2011. At that time staff was also developing a mural ordinance and the PAA was given the responsibility of hearing appeals to mural applications. Since that time the PAA has never been seated with members because there hasn't been a need and has been a dormant committee. With the recent interest in increasing the quality of life in the community, especially the public realm through public art and beautification, staff is proposing to expand the scope of the PAA to fill this need and help to provide a coordinated effort for public arts and beautification projects. The recent grant funding of the Lake Fly sculpture project has revealed that a citizen committee would be beneficial in the project planning process. Creation of such a committee as proposed is not that uncommon throughout the United States. Within this state communities like Madison, Milwaukee, Middleton, Waukesha, and Shorewood all have some type public art committee. ANALYSIS Current membership is composed of five (5) voting members consisting of: two (2) citizen members, one (1) Plan Commission member, one (1) Landmark Commission member, one (1) Council Member and two (2) alternate members. The Director of the Paine Art Center and Gardens, the Oshkosh Public Museum, and the Oshkosh Public Library serve as nonvoting advisory members. The proposed ordinance amendment would establish a seven (7) member committee that would include one (1) Council member. In addition, the Director of the Paine Art Center and Gardens, the Oshkosh Public Museum, the Parks Director and the Oshkosh Public Library would serve as nonvoting ex officio advisory members. The committee would be staffed by the Community Development Department and meet on an as needed basis that could evolve to monthly or quarterly basis. In order to more clearly define the role of the Public Arts and Beautification Committee, staff has added a "Terms Defined" and "Scope of Authority" item to the proposed ordinance. The committee's responsibilities would continue to be to advise the Common Council on murals, public art and upon gifts or donations of public art pursuant to the City of Oshkosh Gifts and Donations Policy. The committee would continue to act as the appeals board for determinations by the Director of Planning Services under the mural ordinance. In addition, the committee would promote public art in the community and facilitate community input pertaining to public art and beautification, as well as advise the City Manager, Common Council and appropriate boards and commissions on matters pertaining to public art and beautification. FISCAL IMPACT Fiscal impact is undetermined because no funds have currently been budgeted for it. The committee will be staffed by a current member of the Planning Services Division. RECOMMENDATION Staff recommends that the Council pass the ordinance amending section 2-47.
