HomeMy WebLinkAbout16. 16-56FEBRUARY 9, 2016 16-56 RESOLUTION (CARRIED____7-0___ LOST ________ LAID OVER ________ WITHDRAWN ________) PURPOSE: APPROVE WAIVER THROUGH JUNE 30, 2016 OF ORDINANCE 4-5 REQUIRED USE OF ALCOHOL BEVERAGE LICENSE FOR MC & C SALES, LLC (RUBY OWL TAP ROOM) 421 NORTH MAIN STREET INITIATED BY: MC & C SALES, LLC / Julie Wolk, Agent (Applicant) WHEREAS, the City of Oshkosh Municipal Code section 4-5 requires businesses obtaining or holding alcohol beverage licenses to conduct a license-related business on the premises for which a license has been issued; and WHEREAS, section 4-5 of the City of Oshkosh Municipal Code further provides for the revocation of licenses for failure to conduct a license-related business on the premises for any one-year period; and WHEREAS, MC & C Sales, LLC (Ruby Owl Tap Room) was granted a license on January 27, 2015 by Resolution 15-42 for premises located at 421 North Main Street; and WHEREAS, the license was granted for a new project located at that premises which required renovation prior to opening; and WHEREAS, the applicant has submitted information indicating that the opening of the business was delayed by unforeseen issues involved in the building renovation; and WHEREAS, the applicant has also submitted information indicating that such issues are being addressed in a timely manner and that applicant remains committed to the renovation of the building and use of the license as anticipated in the original application. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that MC & C Sales, LLC (Ruby Owl Tap Room) is hereby granted a waiver through June 30, 2016 from the provisions of section 4-5 of the City of Oshkosh Municipal Code providing for the revocation of licenses for failure to conduct a license-related business on the premises for any one-year period. 0 rl A 6, e r r LOW, asfs)_ociates sc December 31, 2015 Re: Status of Alterations to 421 N. Main Street — Ruby Owl Tap Room Per your request we were to advise you of the status of the alterations at 421 N. Main Street. It is our understanding that this request relates to the liquor license. A number of issues have come up which have caused delays to the building alterations. Although it appears that the project is not progressing, considerable money has been spent on design fees, demolition of the front facade, demolition of the interior ceiling, structural repair of the wood floor joists and a now electrical service. Some of the issues causing the delays are as follows: 0 A building code variance was drafted, submitted and approved to provide a greater fire barrier at the second floor in lieu of a more costly'fire sprinkler system. 0 In removing the plaster ceiling it was found that considerable wood floor joist repair was required. Those repair plans have been submitted to Inspections and the floor joist repair work has been recently completed. a There are also common structural members between 421 & 423 N. Main that have required structural investigation, design and detailing of repairs. The owners of both 421 & 423 had to be consulted and a corrective structural repair to these common members had to be designed to the satisfaction of both owners. It should be noted that the owners of The Ruby Owl are a tenant in the space, not the owner of the building. Therefore, these structural issues are not their responsibility to correct and as a result, the timetable to correct these issues is also out of their control and is entirely up to the building owner, not the tenant. Out-timetable for opening is very siniple...as soon as possible. We have met with our architect ,electricians,etc so that construction on the inside call begin now. We intend to be open by this spring. Our concept there is similar to{3mdina`o. Take all old building downtown that has m lot of character and history, make a significant investment io the design and implementation of 8/U oorvicekitnhmn^n#uU service hor,and u beautiful interior. TYo will craft u menu that is interesting and one that we think will have a broad appeal to a lot of people, and as a result,wit]further strengthen doxn|own Oshkosh's reputation ea all extremely viable dining/bu\nz|uiomox,destination in central Wisconsin. Gardina's is a destination for a lot of people,and a lot of them are not from Oshkosh. A strong solid business like a Gardina's or our new venture is invaluable not only to a city's economy but also to its reputation as a great option to spend 6mn and money, \Vc all benefit from having strong,solid businesses that will become benchmarks for the city. That is exactly what we did at Gardina's., signed a long term lease,with an option to buy the building. We have demonstrated a uNnug commitment to running very solid,very well run businesses that we believe have helped contribute significantly ovo | vb of don�ov ��m We have been extremely successful Nvith Gardina's and truly believe that another restaurant Nvith a full service bar and kitchen,will hu equally os well received. We are looking x(employment of approximately 28-30people. Guodbmu`m employs 25 people ootTently. Uoruvor, in order for us to fully realize our concept and give ourselves the maximum benefits of running a quality, successful restaurant,a'B"liquor license is critical to our business model. If we are not awarded a Class B license,we will unfortunately,have to seriously re think out,plans for that space, That ls why no are asking you tm consider usum one my the recipients for one of the available Combination Class `13` liquor licenses this year. We have demonstrated the ability to run successful businesses in very tough economic times, not to mention the fact that when we started Gardina's,Main St and our primary parking lot were torn up and completely unusable.The Main Sio[6 years ago was not the destination that iL has become today. VYe think*ohave played a key role io the no shaping o[our dnxntnnnlandscape. We have also proven mbovery responsible and collaborative downtown business owners. We recognize that the strength and success of a downtown comes from many collaborations of businesses, along with a healthy attitude of oamumdudc and mutual support among all parties. VYo are big believers io our downtown and want to see d continue\o flourish and shine.
