RE: Approve Planning Services Fee Schedule for Miscellaneous Land Use Related
Administrative Fees
BACKGROUND
The majority of the fees on the Planning Services Division fee schedule have not been
adjusted since at least 2006 so a general update is warranted to help offset costs of service
provision provided by staff. In December 2015 Council approved updating the Planning
Services fee schedule for site plan review and establishing a contracted service fee for
stormwater and site engineering service which fees help to offset the staff cost of
administering the site plan review process that all new development receives in the city.
Staff is now proposing to update the balance of the fee schedule for items requiring
administrative land use permits that requires staff time and/or materials. Fees are not
significantly changing, relative to their pre 2006 levels, and are generally being adjusted to
reflect changes in operating and overhead costs but are still not at 100% cost recovery.
ANALYSIS
The Planning Services Division charges several fees generally related to permit issuance
(closely related to the Inspections Division) and administering items going through the Plan
Commission or Board of Appeals. The fees are meant to offset some of the overhead costs
associated with providing the services such as issuing various land use and development
permits (e.g. new buildings, additions, signs, etc.) and following up on inspections for the
various permits.
In addition to some minor new fees and overall adjustments, for 2016 two significant new
fees are being proposed. One is a $3,000 new tower and antenna collocation fee and the
other is a triple permit fee for work commenced without a permit. The $3,000 tower and
antenna fee was permitted by statute when the legislature changed the laws (as part of a
budget bill and not general legislation) governing what local municipalities could do to
regulate these items. Essentially, the legislature preempted a municipality from regulating
these items and in return for the preemption allowed municipalities to charge the $3,000 fee
to make up for the lost home rule ability.
The other new fee (for Planning) is a triple permit fee for work commencing without a permit
and is the same that the Inspections Division is charging for building work commencing
without a permit. The fee is intended to cut down on this activity as it often creates additional
work because it is not unusual for the work to have been done in violation of a particular
zoning provision often requiring other additional corrective measures such as ordering the
item removed or issuing citations and court action or going to the Board of Appeals or Plan
Commission. Oftentimes persons commencing work without a permit do so with the
knowledge that a permit is required but are doing so in hopes of not getting caught and if they
do get caught knowing that they will just pay the standard fee. This philosophy while
uncommon is unfair for all those persons that go through the upfront process obtaining a
permit ahead of the work starting.
Other new fees include a notification and/or publication fee for some items going before the
Plan Commission and Board of Appeals and a Historic Tax Credit research fee to be charged
on an hourly basis versus a flat fee which is the most common fee on the schedule.
The temporary use permit fee has not changed since 2006 and that has been at $75 for up to
90 days. A new three tiered system is being proposed ranging from $75-$125 depending on
the time period requested and for the first time a "quantity discount" for up to 4 separate sites
is being proposed that reduces the additional fee by 50% per site (maximum of 4 sites) if the
permits are all obtained at one time.
The sign category has expanded to reflect the various categories of signs that are put up and
each may require a different level of review depending on type and location.
FISCAL IMPACT
For the 2016 budget, Planning Services was anticipating revenue of$69,900. By updating
the fees as proposed it anticipated an additional $3,500 of revenue will be added if no tower
permits are issued. Tower permits are issued very sporadically so projecting them as
revenue cannot be counted on in any given year.
RECOMMENDATION
Staff recommends approving the fees as proposed.
