HomeMy WebLinkAboutAmbulance Stand by/UWO Titan Football ChampionshipAGREEMENT C/7Y OF OSHKOSH AND UW-OSHKOSH PARAMEDIC AMBULANCE STAND-BY December 5, 2015, UWO TITAN FOOTBALL CHAMPIONSHIP GAME THIS AGREEMENT made and entered into this 2� day of Decembec, 2015, by a¢d betweeq Board of Rege�ts of the University of WI system on the behalf of the UniversiTy of WI Oshkosh hereinafter called "UWd', and Ihe City of Oshkosh, a municipal corporation, hereinafrer called "CITY". WHEREAS, UWO has requested the CITY provide a dedicated pazamedic ambulance for sta�d-by, during specified houcs for a Championship Football Game at Titan Stadium, a�d WHEREAS, the Common Council for the City of Oshkosh has authoiized the approp�iate Ciry officials to entec into sucli an agreeme�t. NO W, THEREFORE, it is agreed by and between the parties to this agreement that the CITY shal] prwide one (1) two-person paramedic ambulance to be present at UW O- Titan Stadium during the Football Championship. The paramedic u�i[ shall be primarily responsible for providing first aid and response to medical emergencies. Date of Service: Sam�day, Decembei 5, 2015, from 1130 a.m. — 230 p.m. IT IS FURTHER AGREED that UWO shall pay One-Hundred-"Ien and 54/100 Dollazs ($] 10.54) per hour for the ambulance. Billed time will commence 30 minutes prioi to the start of stand-by and end 30 mirmtes after the termination of stand-by with a minimum of 3 hours. My addi[ional hours requested or required to provide adequare service in the sole opinion of the, Duty Chief for the City of Oshkosh Fire Department, shall be added to the p�esched�led stand-by houcs and billed at the same hourly rate. If for any reason the event is cancelled, a three (3) hour minimom will be chazged if the event is not cancelLed at least rivelve (12) hou�s before the scheduled start time. Pre-event cancellations shall be made by calling (920) 236-5240 between 8:00 a.m. e�d 4:30 p.m. Monday through Friday or (920) 236-5271 at other times. The CITY shall invoice UWO Stadium Budget, c/o Susie Gustke, 800 Algoma Blvd., Oshkosh, WI 54901 following each eveat, wi[h payment [o be made within 30 days of receipt of invoice. Failure to timely pay an invoice shall be a breach of this ageement. All patie�ts �equiring transport by the Oslilcosh Fice Departmeut ambulancewill be billed for services rendered according to the CITY's usua] and wstomary procedures and rates for service. Consiste�t with the Statutes of the State of Wisconsin, eaeh party to this contract agrees to assume liability for the wrongfu] acts or omissions of its employees or agents while they aze functioning within the scope of their employment or agency, and hold the other harmless fbr such liability. The Boazd of Regents for the Univecsity of Wiscousin System agrees to provide liability protection fo� its officecs, employees and age�ts while acting within the scope of their employment. The Boazd of Regeuts further agcees to hold harmless the City of Oshkosh, its officers, age�ts a�d employees from a�y aod all liabili[y, including claims, demands, losses, costs, damages, and expenses of every kind and description (includin� death), or damages to persons or property azising out of oi in connection with or occuaing during the course of this agieement where such liabiliry is founded upon or grows out of the ac[s oi omissio�s of any ofthe officers, employees or agents ofthe University of Wisconsin System while acting within the scope oftheiremployment where protection is afforded by ss. 893.82 and 895.46(1) Wis. Stats. Similazly, the City of Oshkosh a�ees to hold harmless the Univetsity of WI Oshkosh, and all its officecs, employees and age�ts from any and all liability, including claims, demends, losses, costs, damages and expenses oFevery kind and description or damages to persons or properiy arising out of or in connection with o� occur�ing du�ing the course of this agreement, where such liabiliTy is founded upon or grows out of the acts or omissions of employees, officers, or agen[s of the City of Oshkosh while acting within the scope of their employment where protection is afforded by ss. 893.80 and 895.46(I) Wis.
