WHEREAS, the City desires to engage the Consultant to render certain professional and technical services; and .- �- WHEREAS, the City has entered into agreements with �- the United States of America providing £or financial aid �� to the City under Section 701 under Title I of the Housing Act of 1961; and - _ . � WHEREAS� pursuant to such agreements, the City is - - un3ertaking the preparation of �a Central Business District Plan ober��a�one-year period as set forth in an approved Overall Program Design�with the Department of Housing and Urban Development; NOW, THEREFORE, the parties hereto do mutually agrees as follows: - 1. Employment o£ Consultant. The City hereby agrees to engage the Consultant and the Consultant hereby agrees to oerform the services hereinafter set £orth. 2. Area Covered. The Consultant shall perform all the necessary services provided under this Contract in the Study Area as set forth in Appendix A, Scope of Work. . 3.�-56ope of Services. The Consultant shall do, perform and carry out, in a satisfactory and proper�manner, as determined by the City, the services.set forth in the Scope of `.�lor:c as defined in the attachen Appendix A•(tahich is appended 'r.ereto and nade a'part of this Contract). � 4. Time of Performance. The services of the Consultant � zr=_ to comr..ence as soon as practicable after the execution of this Contract and shall be�undertaken and completed in such sequence as to assure their expeditious completion in the light of the - �urposes of�this Contract; but, in any event, all of the services required hereunder shall be completed within 360 consecutive calendar d=_yg Prom the dzte of this Contract. � S. Compensation. The City agrees to pay the Consultant the total sum oF $30,200 for the above services, which includes payment for all travel and subsistence expenses incurred in the performance of said services. � 6. �Method of Payment. The City will pay to the Consultant - the amount set forth in Paragraph 5, which shall constitute full and co�plete compensation £or the Consultant's services hereunder. Such sum will be paid in the following manner, in every case subject to receipt of a statement from the Consultant specifying that he has performed the work under this Contract in conformance with the Contract and that he is entitled to receive the amount requisitioned under the terms o£ the Contract. Upon - certification by the Director� the City will remit the 3020 to the Coascltant. - 7.� Personnel. The Consultant represents that he has, or will secure at his own expense, all personnel required in performing the services covered by this Contract. None of the work or services covered under this Contract shall be subcontracted without the prior c��^itten approval of the Qty. • � B. Existing Data to be Furnished to Consultant All � in£ornation, data, reports, records, and maps as are existing, =_vailable and necessary for the carrying out of the work shall be furnished to the Consultant crithout charge by the City, and the City shall cooperate o-�ith the Consultant in every way possible in thz carryino out of thz planning erork. . � 9. Ownershio and Use of 19aterial. All maps, collected c=_ta, reports, findings and other materials �repared by the Coasultant shall become the property of the City. No material gro3uced in whole or in part under,this Contract shall be subject to copyright in the United States or in any other country. The Ci'y shall have unrestricted authority to publish, disclose, Z-stribute and oYherwise use, in whole or in part, any"reports, data, or other materials prepared ur�der this Contract. � 10. Termination of Contract. The City may terminate this Contract at any time by giving written notice to the Consultant of such termination and specifying the effective data thereof, at least 30 days beFore the effective date-of such termination. In that event, all finished or unfinished�� docw-nents and other�materials shall, at the option of the City, beco;:ie its property. If the Contract is terminated by the - City as provided herein, the Consultant will be paid an anount which bears the same ratio to the total compensation zs the services actually performed bear to the total services of the Consultant covered by this Contract. � I1J WITNESS WHEREOF, the City and the Consultant have executed this agreement as of the date first written above. Appendix A Scope of Work� CENTRAL BUSINESS DISTRICT PLAN FOR OSHKOSH, {YISCONSIN ' Revised June 14, 1974 A Development Plan for the Oshkosh Central Business . District will be developed in coordination with the City - Counc3l, City Plan Commission, the Planning and Redevelop- �� nent of Oshkosh Downtowa group, and other�participating - organizations. The work under this scope will be carried� . out in coordination with the Department oY Planning and _ other consultants employed for the purpose o3 preparing -� the Development Plan. . � The Study Area will include all lands bounded by Broad Street on the east, New York Avenue on the north, Jacksoa St.-Wiseonsi Avenue oa the west, and the Fox River on the south. -The �. Study Area will also include a section oY the business area -� located south o£ the river�bounded by Minaesota Street on the � � west,Eighteenth Avenue on the south and the lake�on the east, During the course of the preparation oY the�Central �- � Business District Plan, fvll use will be made by the con- - sultant oi various economic studies and market analyses � .�. prepared by the staff o£ the University oY {Yisconsin - Oshkosh. The consultant will provide an outline oY econo- . mic data and analysis that will be necessary Yox the study. �- These economic studies will provide a basis £or recommenda- � tions regarding various types o£ proposed uses for the cen- � tral area. . � The consultant will carry out the £ollowing assignments under this Scope o£ S7ork: . THE CENTRAL BUSINESS DISTRZCT -� � �C 1. Central Business District Base h7ap The existing 100 scale base map of the Central Business District will be updated in the following manner. The Plan- ning Departeent will v�ark up a print oP this map in regards - to any changes in street rights-of-way, railroad lines and � building outlines. All buildings that have been removed � since the preparation of the base map will be crossed out - and the outlines o£ new buildings will be marked on this � print. This inPOrmation will then be used by the consultant to draw a completely new tracing oY thc entire cexrtral area, at a scale of 1'� = 100', showing the enlarged Study Area to the north and to the south, � The finished map will show street rights-of-way, street pavement: railroad rights-of-way and rail lines, open spaces, the river, and the outlines of all existing buildings. A mylar repro- ducible base map will be prepared for purposes oP this Study Area and will become the property of the Department oi Commu- -� nity Development. A reduction oi this map at a scale of 1" R 200* will be made to serve as a reproducible base map, ,F 2. Review oY Background Data Previously completed background studies and reports re- - lating to the Central Business District axe sufPicient to provide a basis £or the study oP the central area. The con- sultant's key staPf inembers will meet with the staYf�oY the Depart¢ent oi Community ➢evelopment ior the purposes of ob- taining and reviewing this information. Oshkosh Downtown Development Plan A new revised Development Plan for the Central Business District will be prepared which will show the proposed gen- eral pattern oP uses, transportation routes and parking fa- cilities within the central area. This plan will be prepared in the following manner. � Phase 1- Development Strategy, Based Upon the previously reviewed bac ground in ormation, the major economic and physical pro6lems and issues iacing the business area will be identiPied, The consultant will attend a series oi meetinas £or the purposes oi dis- cussing these economic and physical conditions and the growth potential ior the centr.al 6usiness area. ��e�ee»br�area• These strategies will identiYy the major physical development objectives regarding new land uses; total land use pattern Por the area; oppor- tunities for growth in various types of uses such as retail, of£ice, government, cultural and the like; major objectives regarding parking facilities; and, finally, major concepts regarding pedestrian ways, malls, and the like. These strategies and objectives A-3 will be thoroughly reviewed by the participating organi- zations; and the final product will be a written state- ment on strategies together with strategy maps which will then be Used as a basis for the preparation of the Central Business District Plan. � {�Y Phase 2- Alternate Plans. Q series o3 three or Pour -� alternate p ans wi be prepared in preliminary form��or local study and review by all participat3ng groups. These plans (drawn on the 1" = 200' scale basa map) will reYlect the agreed upon strategy w3th alternate approaches to the �solution of this strategy. These�alternate plans w311 be prepared in graphic Yorm, showing the proposed location for various land�uses deemed appropriate, the general ar- rangement of buildings, vehicular routes and other trans- postation Yacilities, pedestrian ways, public and private parking areas, the location of vaxious public Facil3ties,� and other physical elements. These alternate plans will incorporate different approaches to the revAtalization o3 the Oshkosh Central Business District - all within the iramework o3 the agreed upon strategies. These alternate plans will be preseated.to the participating organizations for thorough discussion and review so as to identify tha advantages or disadvantages oP the various elements oi the plans. � . � � - � � Phase 3- Oshkosh Downtown Development Plan. Following review and study o the al ernate plans or the central area, a single Development Plan will be agree� upon and prepared 3n rough Yorm, consisting oP maps and supporting graphics. This plan (drawn on the 1" = 200' acale base map) wi11 incorporate those features o£�the alternate plans considered most suitable and effective in meeting the iden- tified strategies. . � � � Follo�ing review of the rough draft oY this plan and general agreement upon the content of the Development Plan, the consultant will proceed to prepare a Yinal dra3t of the Central Business District Plan, which �vill include the iollowing elements.. - - - - A Land Use Plan of the central area will be prepared to sho}v the overa arrangement of�land uses and.their relationship to vehicular rovtes, transit Yacilitiesy parking areas, pedestrian Nays, and public facilities. This plan �vill portray the overall development of the central area in its ultimate form, The land uses indi- cated in the plan will include those considered appro- priate for the future economic grorvth and �vell-being oP A-4 the area such as retail, oYfice, pro£essional, iinan- cial, entertainment, cultural, governmental and other uses deemed appropriate £or the central area:" These �� various uses will be identified in this Land Use Plan. A Transportation Plan will be prepared which would graphica y portray t e major concepts for traPPic and transit facilities. This plan will show existing and proposed laneage, one-way routes, alleys aad serv3ce � areas, iatersections and interchanges. The proper re- lationship of the central area circulation to Lhe sur- rovnding major streets and highways will be included, Bus and mass transit routes and terminals will be iden- tified in this plan. Traffic assignments will be made by the Department in this proposed network using tha East Central Wisconsin transportation pxogram. . � A Parking Plan will be prepared to show the location oY all existing and proposed oYf-street parking £acili- ties by lot or multi-level structure, the number oY spaces and the function of the Yacility for geheral � public (short-term and long-term), customer, employee and private parking. The plan will also indicate re- �� lated elements such as access to each Pacil3ty Yor ve- hicles and pedestrians. The amount oY parking provided � " will be related to land use studies and the volume of parking space provided by the overall plan. Also, the recommended location and type of on-street parking will be included in this Parking Plan, A Pedestrian Plan indiCating sidewalks, malls, sky- ways, over ead wa s, plazas and arcades will be ind3- cated in this plan. Emphasis will be placed on creating an interesting and exciting environment w3th emphasis on all-weather iacilities where logical and possible. A pedestrian linkage between all land uses and transporta- tion terainals will be established and indicated in this plan, These plans will be accompanied by drawings for ma- jor pedestrian components and will be in detail, showing walking surfaces, trees� planting beds, and the like. Phase 4- Central Area Site Plans. A single, large- scale detailed ^site plan" £or the entire central area will be prepared. This plan will graphically portray the outline and relationship of the bvildings, land- scaped areas, and other physical elements of the plan. This site plan will sho�v building outlines, trees and plant materials, streets, drives, service areas, the layout�of parking lots, walks, pedestrian ways and open landscaped areas. This plan will be prepared as a multi-color graphic at a large scale. The Central Busi- ness Distx•ict Site plan would then be combined �vith site plans for the University to show the relationship of th2se areas and their combined impact, A-5 Sketches and renderings will be prepared of views of various areas within the Central Business �istrict; indicating existing and pro�osed buildings, proposed trees, walks and other physical featvres o# the site plan. The intent of these sketches-and renderings will be to provide a visual concept of the various elements oi the plan deemed appropriate. Areas se- lected Por sketches and renderings might include the views of proposed office build3ng groups, the iront- ages of several blocks, views within the retail core area along malls, or various proposed housing for the central.area, A brief report will be prepared An two parts, Part I will describe the CBD Plan�and will contain a map of each oY the four above plans; i,e., Land Use Plan, Trausportation Plan, Paxking Plan, and Pedestriaa Plan. Part II will present a brieP ex- planation of the site plans and gxaphics. Tho site plan of the CBD Plan and al� supporL-ing sketches and renderings will be included in this report, 4.� Implementation Report Programs for implementation and development oP physical £acilities to carry out the Central Business�District Plan will be presented by the consUltant for consideration by the committee. This will include a review oY appropriate proce- dures for the Pinancing of the Development Plan, Estimates of the amount oi public and private money required to carry out the plan will be identified. The need Sor general obli.- gation bonds or revenue bonds and the general effect upon tax base will b2 analyzed. The advantages and disadvantages oP a benefit district will be diseussed. Eicamples of the � cost of the program to private property owners within the central area will be identified, such as front-ioot costs or assessments ior various malls, The areas aill be.iden- ti£ied there the city, in terms oi policies or programs� can make a positive or negative impact vpon the Yuture eco- nomic success oi the downtown area, � A recommended improvement program will be identified including a short-range action program and detailed steps to be iollo�ved to carry out the immediate short-range ac- tion program, � 5. Svmmary Brochure A sucunary brochure will be prepared which will contaxn a briei description of the proposed plan £or the Central Businesa District (20 pages or less), together with a color map of the plan for the Central Business District and all ( n-s oi the renderings and sketches oi the central area, This will include a statement oi the strategy Yor the central area and brief comments regarding the economic potential for deve2op- ment �vithin the Central Business District. This brochure wil.l be prepared in such a manner so that it will explain the cen- tral area program in terms understandable to the citizens oi the commuaity, 6, Reports and nlaterials - � � The consultant will provide the following reports and materials as a result oi the £oregoing work: � Afaps and Graphics - d(a) A base map of the Central Business District, ink � on mylar reproducible fil.m. - � �(b) A Final Central Business Distr.ict Plan and the four separate plans 3n ink on a mylar as a repro- ducible overlay to Yit the CBD base map in item .
