INITIAL RESOLUTION - SEi9ER & WIaTER AND GRADING AND
GRAVE;LING
BE IT RESOLVED by the Common Council of the City of Oshkosh
as follows:
1. The Common Council hereby declares its intention to
exercise its power under Section 66..60 of thc: Wisconsin Statutes
to levy special assessments upon property within the following
described areas for benefits conferred upon such property by
improving the following named streets, said public improvement to
include the following: SANITARY SF:�VFR AND S4ATER MAIN
VTEST 33rd AVENUE - From Dledalist Drive to 735' east o£
Medalist Drive.
MEDALIST DRIVF - From 233' south of S9. 33rd Avenue to
500' south of W. 33rd Avenue
2. Said public improvements shall include the grading of
the above named street to the grade hereafter establisheci by
special ordinance of the City of Oshkosh, and the suriacing of
said street with gravel and a dust preventative.
3. IIefore such i.mprov�ments are made, the Soard of Public
Works is directed to cause water ar,d sewer serv.ice pi.pes to be
laid in said streets from the mains to the curb line of each lot
fronting on the said streets and to keep an accarate account of
the expense incurred in £ront of each lot and report the sar�e to
the Comptroller who shall cause the amount charged to each lot to
he entered on the tax roll as a specia7. tax against said road,
provided, however, that the Board of Public Works shall not cause
such laterals +ze be se lai3 for any pa.tzcular lot, cr parcel
wherc, in the opinion of the Board of Public Works, it would be
impractical to do so. -
4. The total amount ascessed against such district shall �
not exceed the total cost of the im�rovements and the amount
assessed against any parcel shall not be greater than the benefits
accrued thereto from said improvements.
5. The assessments againet any parcel may be paid zccording
to the provisions of Section 25-63 thru 2i-89 of the Oshkosh
Municipal Code.
6. The Boazd o£ Public Works is directed to prepare a
report con,isting of:
(a) Final plans and specif5.cations for said improvements.
(b) An estimate of the entire cost of the improvements and
laterals.
(c) An estimate as to each parcel of property wi.thin the
assessment district cf:
(1) The assessment of benefits to be levied for each
improvement.
(2) T?�e damages to be awarded for property taken or
damages by each improvement.
(3) The net amount of benefits over damages or of
da�,.ages over benefits for each improvement.
Upon completion of such report, the Board o,` Public Works is
directed to file a copy thcreof in the City Clcrk's Office for
public inspection.

7. Upon receiving the report of the Board o£ Public Works,
the City Clerk is directed to give notice of a public hearing on
such reports as specified in Section 66.G0 (7) of the Wisconsin
Statutes. The hearing shall be held by the Board of Public Works
at the Council Chambers in the City Hall at a time set by the
Clerk in accordance with Section 66.60 (7) of the Wisconsin Statutes.
8. The wisconsin Publi.c :,ervice Corporation of Oshkosh,
Wisconsin, is hereby required to install gas mains in said street
and service laterals at such intervals as the Board of Public
Works shall direct, said worY, to be compieted prior to the improve-
ment of the said street, the City C1erY, sha7.1 fonvard a certified
copy of. this resolut.ion to suid corporation f.orthwith.
9. The Board of nuhlic [9or!:s and thc proper city officiais
,ha11 do all thinys necessary so as to complete the installation
oC storm sewers in said street prior to the improvements thereof,
if necessary. �
10. The installation of said street improvements shall be
accomplished according to the provisions of Section 25-3 thru 25-
11 of the Oshkosh Municipal Code.

Pursuant to an ordinance duly adopted by the Common Council
on Oceober 3, 19J4 and Oc[ober 17, 1974 ordexing and disecting
the following described work to be done by the City without
submitting same for bids and requiring a report of the cost of
such work as provided by Sectlon 62.15(14), the following report
includes grading, laying of base material and nust preventative
for the folloc,�ing streets:
