HomeMy WebLinkAboutAmbulance Standby/UWO Football 11/30/2015,_ AGREEMENT CITY OF OSHKOSH AND UW-OSHKOSH PARAMEDIC AMBULANCE STAND-BY Novembei 28, 2015 UWO TITAN FOOTBALL CHAMPIONSHIP GAME THIS AGREEMENT made and entered into this �Q day of November, 2015, by and between, Board of Regents of the UniversiTy of WI system on the behalf of the Universiry of WI Oshkosh hereinafter called "UV✓O", and the Ciry of Oshkosh, a municipal corporation, hereinafter called "CITY". WHEREAS, UWO has requested the CITY provide a dedicated paramedic ambulance for stand-by, during specified hours for a Football Scrimmage at Titan Stadium, and WHEREAS, the Common Council for the Ciry of Oshkosh has authorized the appropriate Ciry officials to enter into such a¢ agceement. NOW, THEREFORE, it is agreed by and between the parties to this agreement that the CITY shall provide one Q) two-person pazamedic ambulance to be present at Titan Stadium during the Foo[ball Scrimmage. The pazamedic unit shall be primarily responsible for providing tirst aid and response to medical emergencies. Date of Service: Saturday, November 28, From 1130 a.m. — 230 p.m. IT IS FURTHER AGREED that U WO shall pay $110.54 per hour for [he ambulance. Billed [ime will commence 30 minutes prior to the start of stand-by and end 30 minu[es afrei the termination of stand-by with a minimum of 3 hours. Any additional hours requested or required to provide adequate service in the sole opinion of the Dury Chief for the Ciry of Oshkosh Fire Department, shall be added to the prescheduled stand-by hours and billed at the same hourly rate. If for any reason the event is cancelled, a[hree (3) hour minim�m will be chazged if [he event is not caneelled at ]east twelve (12) hou�s before the scheduled start time. Pre-event cancellations shall be made by calling (920) 236-5240 between 8:00 a.m. and 430 p.m Monday through Friday or (920) 236-5271 at other times. The CITY shall imoice UWO Stadium Budget, c/o Susie Gustke, 800 Algoma Blvd., Oshkosh, WI 54901 following each eveut, with payment to be made wi[hin 30 days oFreceipt oF invoice. Failure to timely pay an invoice shall be a bieach of this agreement. All patients requi�ing transpoR by [he OsLilcosh Fire Department ambulance will be billed for services rendered according to the CITY's usual and customary pxocedures and rates for service. Consistent with the Sta[utes of the State of Wisconsin, each par[y to this contcact agrees to assume ]ia6iliTy for the wrongful acts or omissions of its employees or agents while they aze functioning within [he scope of [heir employment or agency, and hold [he other hazmless for such liability. The Boazd of Regents for the University of Wisconsin Sys[em agrees to provide liability protec[ion for its officers, employees and agents while acting withio the scope oYtheir employment. The Boazd of Regents further agrees to hold harmless the City of Oshkosh, its officers, agents and J.• employees from any and all liability, including claims, demands, losses, costs, damages, and • expenses of every kind and description (including death), or damages to persous or pcoperty arising out of oi in counection with oc occumng during the coutse of this agieement whe�e such liability is founded upon or grows o�t of the acts or omissions of any of the officers, employees or agen[s of the Ucuversity of Wisconsin System while acting within the scope of Iheir employment where protection is afforded by ss. 893.82 and 895.46Q) Wis. Stats. Similazly, [he CiTy of Oshkosh agrees to hold harmless the University, and all its officers, employees and agents from any and all liability, including claims, demands, losses, costs, damages and expeases of every kind and description or damages to persons or property azising out of o� in connectioo with or occurring during the course of this agreement, where such liability is founded upon or grow�s out of the acts or omissions of employees, officers, or agents ofthe City of Oshkosh while acting within the scope of their employment where protection is afforded by ss. 893.80 and 895.46(1) Wis. Sta[s. UWO and the CITY shall have the right to terminate this agreement without cause upon 10 days piioc written notice to the other party.
