Y?FIERBAS, Section 66.293 of the Wisconsin Statutes provides
that it shall be the duty of evcry city which proposes the making
of a contract for any project of public works to determine the
rate o£ wage scale which shall be paid by the contractor to the
employees upon such project, and reference to sucY� scale having
to be published in the notices issued for the purposes of securing
bids £or any project,
NOW, THEREFORE, I�E IT RESOLVED by the Conunon Council o£ the
City of Oshkosh that the attached schedule mar7:ed "Exhibit A" and
made a part hereof as though fully set out at length herein is hereby
determined to be the rate of wage scale for such puUlic works; and
the City C1erk is directed to file same and to use same in connection
with and as directed by said s�tatute, same being the rate of wage
scale publishefl by the IIuilder and Construction Trades Cour.cil of
Oshkosh and vicinity, and same shall remain in full force and effect;

are adoptc3 resulting in an increase in the rate of wage scale over
and above these established in the schedule marked "Exhibit A', the
same waye scale ado�ted as the r�sult oi said negotiations shall
automatically become the rate of wage scale for the City of Osnkosh
as required by Section 66.293.

emp oyes working on the project, the wage rates and hours de�termined by
the depar[ment or�exempted municipali[y and the provisions of pars. (a)
and (e) shall be kept posted by the employer in at least one conspicuous .
and easily accessible place at the site of the "project.
Failure to ay prevailin rate. Any contractor� subcontractor or agent
thereo , w o fails to pay t e prevailing rate of wages determined by the
department under this subsection or pays less than.l} times the hourly
basic rate of pay for hours worked on the projec[ in excess of the pre-
vailinq hours determined under [his subsection� shall be liable to the
employes affec[ed in [he amount of their unpaid minimum wages or their
unpaid overtime compensation and an additional equal amount as liquida[ed
damages. Action Co recover the liability may be maintained in any court
of competent jurisdiction by any one or more employes for and in behalf
of himself and other employes similarly situated. No employe shall be a
party plaintiff to any such action unless he gives his consent in writing
to become such a party and the consent is filed in the court in which the
ac[ion is brought. The court shall� in addition to any judgment awarded
io the plain[iff, allow a reasonable attorney's fee and cos[s to be paid
by the defendant. �
Payroll records required, Each contractor, subcontractor or agent thereof
participating in a project covered by this su65ection shall keep full and�
accurate records clearly indica[ing the name and [rade or occupation of
every laborer� workman or mechanic employed hy him in connection with the
project and an accurate record of the number of hours worked by each
employe and the actual wages paid [herefor.
