PENCE� CITY ATTORNEY RE: RESOLUTIONS #29 and #30 Resolution #29 - Claim - Lee Ruehmling Equipment that was in the City main sewer hit the lateral and broke it causing repairs in the amount of $493.72. The City Attorney's office will institute action against the plumber whose equipment inadvertently got into our main. Resolution #30 - Claim - Richard Lambert The City in 1960 replaced an existing combination sewer in High Avenue with a new sanitary sewer. All the existing laterals were removed from the existing combination sewer and reconnected to the new sanitary sewer. The City inadvertently missed the aewer at 1144 High Avenue and as a result of the abandonment of the combination sewer, the lateral from 1144 High Avenue terminated right outside of the premises. The reason this is coming to our attention for the first time now is that the house was inhabited by a single man who had little use for the sanitary facilities and the ground was probably capable o£ absorbing the small flow. However, the individual died and the house was recently purchased by a man with a family. This individual complained of continuous sewer back up and upon investigation� the lateral problem was found. i therefore feel that the City should pay the above claims of repairing theae sewer lateiale.
