WHERHAS, IN ORDER TO INCREASE GENERAL EFFICIENCY, TO MAiNTAIN the existing t�armonious relations between the employer and its employees, to main— tain a uniform minimum scale of wages, hours and conditions o£ employment among ' the employees and to promote orderly procedures for the processing of any grievances between employees and employee and/or employee and employer, and the declaration of rules and regulations and the establishment of and declaration of policies�to insure a pxoper and ethical conduct of business and relations between the Employer and the Union, and to that end have reached this Agreement. . NOW, THERFORE, the parties heieto, each in consideration of the. agreement� herein contained of the other, hereby agree as follows. ARTICLE I PiANAGEMENT RIGHTS SECTLON 1. Except to the extent e�cpressly abridged by a specific provision of this agreement, the City reserves and retains, solely and exclusively, all of its Conmon Law, statutory, and inherent ri�hts to manage its oian affairs, as such rigFits ex'isted prior to the execu[ion of this or any other previous Agreement with the Association. . � ARTICLE II PAY YOSSCY SF,CTION 1. Compensa[ion. Employees shall be compensa[ed within tUe yay ranges s-t forth in th° classification and pay plan of the employer and in accordance �rith the rules for admi�istration included L}�ercirt. Ai[ached as an appendix to th:s agreemen[ are the job classif:icati.ons and pay scheclules. SfiCT10N 2 Classifica[ion. The enployer shall detcrmine [he number of employees 2nd [ypes of positioas or classifi.cations necessary to operate the facili[y. Should an employee feel he or she is errorneously classified, they may apply for a review of their classification by [he Personnel Director. ARTICLC III - RULES AND REGULATIONS � SECTION 1. The employer may adopt and publish rules and regulations concerning the operation of its faciliTy and conduct of employees. Such rules and regulations may be amended periodically, provided reasonahle notice is p,iven to affected employees. ARTICLE IV PROEATIO:VAP.Y PERIOD k Eh�LOYMENT STATOS SECTION 1. PermanenT Employee, is one who is hired to fi11 a pernanent full time position in the table of organiza[ion. A11 such employees shall serve a probationary period o4 six (6) consecutive months. During Che probationary petiod the employer may dismiss such employee at i[s discm[-.ion. S�CTION 2. Temporary Employee, is one who is hired on a ehort [ern basis not to exceed six .(6) consecutive months. Such eniployees shall not accrue any rights or benefits of this agreement. ARTICLE V '- TERPIINATION OP gCiPLO1TIENT SEC:ION 1. Lay-OFf. The employer may, in [he interes[ of �the City� lay-off any er,.ployee at any time. T{ie employer shall furnish the affectcd employee �:i[t: a written notice. S.'here qualifications oP posi[ion permit, the employee �aitn the leas[ seniority within the c].as�ification sha11 be laid off first. _7_ SCCTION 2` Dismissal. The employer may in the interes[ of thc City or for di.sciplinary purposes disdiarge any employee. 1'he employer shall fi�rni.sh the discharged employee �aith a written noiice of the action and Cl�e reason(s) for same. ARTICI,E VI WORf: HOURS SECTION I. The cuork day and work week eUall be as follows: 8:00 A.Pf. to 4:30 P.M., Monday through Friday. Exceptions to this Article shall be: the - custodians whose noimal work day shall consist of nor more [han 7 1/2 hours performed Sunday through Saturday, not to exceed 3Z 5 hours; the normal work week fox Courtesy Aides shall be Nonday through Saturday, no[ [o exceed 37.5 hours� the normal work week for [he museum employees sha11 be Sunday through Saturday. The normal work day shall 6e 7 1/2 hours. When Ttuseum employees aze required to work Saturday and Sunday they shall receive their two days off normally during the same pay period. Th2 emplcyer may diange the hours of tlie work day in the bes[ in[erest of the pablic, provided the number of hours per work day is not increased. � ARTICLE VII HOSPITALIZATION & LINE INSURAIdCE SECTION 1. The employer shall pay up to fifty-six dollars ($56.00) per month per employee towards the premium of [hc enployee's group policy, regazdless of marital status. � SSCTION 2. The employer shall pay up to eight dollar& ($8.00) per monttt per employee towards the premium of the group life insurance policy. AP.TICLF. VIII NOI.IDAYS SECTTON 1. Sucl� days may be scheduled and used in [he sar.ie manner as vacation days cvifh the approval of the Department Head. ABTICLE IX RETIREFIENT FUND - SECTION 1. In additian to the Statuto.y requiremeats, the employer shall pay to the retitement fund up to twenty-five dollars ($25.00) bi-caeekly of � the employee's mandatory contribution. ARTLCL� X SICK LEAVE � SECTION 1. All permanent full time employees shall accumulate sick leave with pay at the rate of one (1) work day tor each month of service. For purposes of this section, leave �aithout pay shzll not bc considered service. Unused sick leave credits shall accumulate to a m2ximua oi onc hundred ai�d thirty- two (132) days. SECTION 2. An employee may apply for sick leave with pay for absence necessitated by injury or illness. In order to qualiiy ior sick leave beneFits an employee mus[: A. Report prior m t}�e start of each caork day to his supervisor for }�is/her absence. B. Keep hie/her supervisor infoemed of the condition and estimated day of return to work. C. AFTICLE XI CO?IPF.NSATORY TIMF. SF.CTION 1. Compensatory [ime shall be granted at the ra[e of 1 1/2 times for full time employees required to work over the normal work day or week. �Compensatory time will be recorded and may be used during the year upon reques[ of the employee and with the approval of the department head or at the direc[ion ` of the Depaxtment Head. Any unused balance of compensatory time will be paid on the first pay period of the following year. SECTION 2. Compensatory time on the books as of 12-31-65 will remain and may be taken off on a straight time ratio subject to the provisions for the granting of such leave outlined in Section 1. Any unused balance of such time will he p�id upon separation 6ased on the salary in effect as of 12-31-65. ARTICLE XII LONGEVITY SF:CTION 1. The employer agrees to the following longevity plan For all full time employees below ffie rank of Division Head and "nonaorking supervisor". A. $ 2J7 Bi-Weekly after 5 years oi continuous Service. B. $ 5.54 Ri-Weelcly after 10 years of continuous Service. C. $ 9.23 Ri-Weelcly after 15 years of continuous Service. P. $12.92 Bi-Neekly after 20 years of continuous Service. ARTICLE XIIi � REST PERIOD SF.CTION 1. All regular full [ime employces sl�all be Eranted vacation leave with pay based upon [he following schedule in each succeeding calendar year SECTION 2. Each fu11 time employee with less t}�an one fu11 calendar year of service shall Ue granted a vacation in the succeeding calendar year on a prorated basis in propot[ion to the length of time worked, based upon the follo�aing schedule: � SCHEDULE A. 1 year of mntinuous service = 2 weeks vacation. B. 8 years of continuous service = 3 weeks vacation. C. 15 years of continuous service = 4 weeks vacation. D. 20 years oE con[inuous service = 5 weeke vacation. ARTICLE XV Y.T4F,2GF,NCY LtiAVF. No employee may absent himself from dnty during working hours without the permission of the responsible department head. Any employee absenting himself without permiission shall be subject to disciplinary action. ARTICLE XVIII WAIVER OP RIGEITS SECTIOR 1. Each party to this Agreement ex.pressly retains all ri�hts and au[hori[y possessed by it or then onder Wisconsia or Federal Laws, regula- tions or statutes. In the even[ that any clause, provision, or portion oP this Agreement is held invalid or inoperative such invalidity or inoperativeness shall not affect other clauses, provisions, or por[ions of this Agreeaent. 'Lhe parties hereby declare Cheir intent that all clauses, provisions, and portions of this A�reewent are severable. - SECTION 2. If said invalid''tTy arises through conflict with a speciCic statute, [hen the statute shall govern that portion of the Agreement which is in conflict, and negotiations shall 6e institvted to adjust the invalidated clause. � ARTICLE XIX GRIEVANCE PROCEDURP SECTTON L. Both tUe union and the ci[y recognize that grievances should be settled promptly and at tlie earliest possible stage and that the grievance must be ini[iated within five (5) iaorking days of [he incident. A grievance is defined ae any violatiun, misinterpretation, or noncompltiance wi.th the provisioas of tUis contract. Any employee may process grievances as ou[-- ].ined, an3 -.ay be assisted by the Association at the op[ion of the enployee. Sten 1. The aggrieved emp].oyee may presen[ the gricvance orally to t�is managnent supervicor. The employee and supervisor shall attempt to resolve [he grievance. The supervisor ehall sta[e his position to the employee within three (3) consecutive caork days. Within three (3) con�ecutive work d2y& after ffie supervisor has statcd his position, the employee sUall advance his grievance to Step 2 or the matter shall be considered se[tled by all partie5. Step 2. The employee shall submit the grievance in writing to hic Department Director. The ➢epar[ment Director shall state his postiion in � wri[ing within three (3) wnsecu[ive work days after receipt of the Department Directors sta[ement, the employee shall advance his grievance to Step 3, ox [he matter shall be considered se[tled by all parties. Step 3. .The employee shall submit the grievance in wri[ing alon� with a copy of the Department Directors sta[ement to the CiTy Manager. The City Planager shall issue his sta[em=_nt in wri[ing to the employee and the Depattment Director within five (5) consecutive cuork days. The employee shall advance to Step 4, or the matter shall be considered settled by all parties. Step 4. If the employee does not consider [he grievance satisfactorily adjucted, he may request that the grievance be settled by arbitration. The employee shall give caritten no[ice of his request for azbitration within ten (30) days after the receipt of the City Manager's sta[emen[. Upon receipt of such notice, the employee and the employer shall endeacor to select an impartial axbitrator by mutual agreement. In the event the pac[ies are unable to agree upon an arbitrator,-they stiall each appoint an arbitrator and said ar6itrators shall choose a third arbitrator.
