BE IT RESOLVED by the Common Council o£ the City of
Oshkosh that the following easement from PAINE LUMBER COMPANY
to the CITY OF OSHROSH for water main purposes is hereby accepted:
20' WIUE PERMANENT EASEMENT:
A strip of land 20 feet wide in Lot 6, F.eplat o£
Winnebago, the centerline of �ohich is described as
follows: Beginning at a point on the southerly line
of said Lot 6(northerly right-of-way line of Congress
Avenue) that is 331 £eet west of the extended northerly
line of Summit Avenue, thence north at right angles
to said south line of Lot 6, 30 feet, all in the ].2th
Ward, City o£ Oshkosh, Winnebago County. Wisconsin.

THIS INDENTURE, made this �:7 day of ,/�Q��QvnLA�c�t/
1974, by PAINE LUMBER COMPANY, INC., of Oshkosh, Wisconsin,
hereinafter referred to as "Grantor", and the CITY OF OSHKOSH, a
municipal corporation located in Winnebago County, Wisconsin,
hereinafter reierred to as "Grantee",
FIITNF.SSETH:
IN CONSIDERATION of the sum of One Dollar (51.00) and
other good and valuable consideration paid by Grantee, the receipt
of which is hereby acknowledged, the Grantor does hereby give and
grant unto the Grantee, its successors and assigns, a permanent
easement in, under and over the land hereinafter described including
the right to enter upon said land for the purpose of constructing,
maintaining, repairing and operating thereon a water main, over
and through and upon the certain tract of land situated in the
Twelfth Ward, City of Oshkosh, Winnebago County, Wisconsin, and
described as follows:
20' WIDE PERMAN�NT EASEMENT
A strip of land 20 feet wide in Lot 6, Replat of
Winnebago, the centerline of which is described as
follows:
Beginning at a point on the southerly line
oi said Lot 6(northerly right-of-way line
of Congress Avenue) that is 331 feet west of
the extended northerly line of Summit Avenue,
thence north at right angles to said south
line of Lot 6 30 feet, all in the 12th Ward,
City of Oshkosh, Winnebago County, Wisconsin.
Upon exercising any of the rights herein granted,
Grantee shall cause the property, soil and grass to be repaired
and replaced in a condition similar to its condition immediately
prior thereto and Grantee obligates itself to pay to Grantor, its
successors and assigns, all actual damages caused by reason of
the installation, operation, repair or removal of said water main
or the installation and construction oi a subsequent water main
through said property.

IT IS FURTHER MOTUALLY AC;REED that no building, tree or
other substantial or permar.ent structure shall be placed upon
said property �y the Grantor.
The Grantee hereby releases the Grantor from all debts,
claims, demands, damages, actions and causes of action whatsoever
which may result from said easement heretofore granted by Grantors
and further agrees to hold the Grantcr free and harmless from any
claim for damages which may be made by reason of damages or
injury to person ar property connected therewith.
IN WITNESS WHEREOF, said Grantcr has hereunto set its
hand and seal the day and year first above written.
