WHEREAS, Section 66.293 0£ the Wisconsin Statutes provides
that it shall be the duty of every city which proposes the making
of a contract for any project of public works to determine the
rate of wage scale which shall be paid by the contractor to the
employees upon such project, and re£erence to such scale having
to be published in the notices issued for the purposes of securing
bids for any project,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of Oshkosh that the attached schedule marked "Exhibit A" and
made a part hereof as though fully set out at length herein is hereby
determined to be the rate o£ wage scale ior such public works; and
the City Clerk is directed to file same and to use same in connection
with and as directed by said statute, same being the rate of svage
scale published by the Builder and Construction Trades Council o£
Oshkosh and vicinity, and same shall remain in £ull £orce and effect;
and in the evAnt ±hat the preseet c�ntract= now ur.der ,-.eyotiat:.ons
are adopted resulting in an increase in the rate of wage scale over
and above these established in the sch=dule marked "Exhibit A', the
same wage scale adopted as the result of said negotiations- shall
automatically become the rate o£ wage scale f.or the City of Oshkosh
as required by Section 6G.293.

emp oyes working on the projec[, [he wage rates and hours determined by
the depar[ment or exempted municipality and the provisions of pars. (a)
and (e) shall be kept posted by the employer in a[ leas[ one conspicuous
and easily accessible place at the site of the project.
Failure �to a� prevailing rate. Any contractor� subcontractor or agent
thereo�, who iaTis to pay [he prevailing rate of wages determined by the
department under this subsection or pays less [han 1} times the hourly
basic ra[e of pay for hours worked on the project in excess of the pre-
vailing hours de[ermined under [his subsection� shall be liab)e to the
employes affected in the amount of [heir unpaid minimum wages or their
unpaid overtime compensation and an additional equal amount as liquidated
damages. Action Co recove� the liability may be maintained in any cou�t
of competent jurisdiction by any one or more employes for and in behalf
of himself and other employes similarly si[uated. No employe shall be a
party plaintiff to any such action unless he gives his consent in writing
to become such a party and the consent is filed in the court in which the
action is brought. The court shall, in addition to any judgment awarded
to the plaintiff, allow a reasonable attorney's fee and cos[s to be paid
6y the defendan[.
Payroll records required. Each contractor, subcontractor or agent thereof
participating in a project covered by this subsection shall keep full and�
accurate records clearly indicating the name and [rade or occupation of
every laborer, workman or mechanic employed by him in connection wi[h the
project and an accurate record of the number of hours worked by each
employe and the actual wages paid therefor.
