WHEREAS, the City of Oshkosh has been negotiating with
r.epresentatives of the Oshkosh Police Captains Association, and
WAEitEAS, the conclusions of said negotiations have been
reduced to the attached agreement,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of
the City of Oshkosh that the proper City officials are hereby
authorized and directed to enter into the attached agreement with
the Oshkosh Police Captains Association for the 1975 calendar
year.

A G R E fi M E N T
THIS AGREEP�IENT IS entered into to be effective on
January 1, 1975 by and between the City of Oshkosh, Wisconsin,
party of the first part hereinafter referred to as the
Employer, and the Oshkosh Police Captains Association, party
of the second part hereinafter referred to as the Association.
WHEREAS IN ORDER TO INCREASE GENERAL EFFICIENCY, to maintain
the existing harmonious relations between the Employer�and its
employees, to promote the morale, well being and security of said
employees, to maintain an uniform minimum scale of wages, hours
and conditions of employment among the employees and to promote
orderly procedures for the processing of any grievance between
employees and/or employee and employer, and the declaration of
policies to insure proper and ethical conduct of business and
relations between the Employer and to that end have reached this
Agreement.
NOW, therefore, the parties hereto, each in consideration of
the Agreements herein contained of the other, hereby aqree as
follows.
ARTICLE I
WORK WEEK
� Police Captains are supervisory personnel and as SllCh are
in charge with the responsibility of controlling and directina
subordinate personnel in executing their specified police assianments.
Therefore, the duty week shall be determined by the department
hezd based upon departmental manpower requirements.

ARTICLE II
UNIFORM h7AINTENANCE
The Ea,ployer will provi�e uniform apparel to all personnel at
City expen�e. The items to be furnished by the City shall include;
coats, trousers, hats, ties, shirts, shoes, leather goods, and
other items of uniform apparel required by the City.
Uniform will be inspected periodically by the department head
or his agent and replaced as needed. Replacement orders shall be
processed by the City of Oshkosh Purchzsing Division.
Non-uniformed personnel shall continue to receive a uniform
allowance of $150.00 per year, payable on April 15th.
Cleaning and laundering services will be provided at City
exper.se. The cleaning firm and cleaning schedule shall be disig-
nated by the City.
ARTICLE III .
AUTHORIZED LEAVE
Sick Leave: Each regular full time employee shall accmulate
sick leave at the rate of one (1) working day for each month of
service. Such unused sick leave shall be allowed to accumulate
without limitation.
An employee may use sick leave with pay for arsence necessi-
tated by injury or illness. It is further recognized that the
serious injury or illness of the spouse or child of the employee
mag adveraely e£fect the ability of the employee to per£orm hi�
duties efficier.tly, and may neceasitate the use of sick leave.
However, no leave shall be granted under this subsection if the
spouse of the employee is employed and continues to work during
the absence of the officer.

To qualify for sick leave paymer.t an employee must do the �
followiny: � .
a. Report his absence prior to the start of each
work day to the department head or supervisor.
b. Keep his supervisor informed of the conditions
if the absence is more than three (3) working
days.
c. Upon request submit a doctors certificate for
such absence. The certificate mUSt state the
- nature of the illness or injury and whether the
employee ha� been incapacitated for the period
of his absence.
d. The employee upon returning to duty must sign
a change of statcs form requesting the sick
leave benefits. Such a signature shall be an
acknowledgement of full ccmpliance with all
regulations related to sick leave benefits as
set forth in this Contract.
In the event any employee has misused the provi�ions con-
tained herein or has requested.the use of sick leave when such
leave is not authorized by the terms of this contract, the em-
ployees aBSence shall be without�pay. The determination that an
employee has abused the benefits contained in this paragraph shall
not preclude the employee�from using accumulated sick leave when
authorized by the terms of this contract in the future nor shall
the accumulated sick leave credit to that employee be e£fected
thereSy.

Vacation Leave: All full time employees shall be granted the
following vacation benefits: After or.e (1) year of service - ten
(10) working days
(15) workinq days
(20) working days
After eight (8) years of service - fifteen
After fifteen (15) years of service - twenty
After twenth-three (23) years cf service -
twenty-five (25) working days.
Those employees reaching their eighth, fifteenth, and twenty-
third year of service shall earn their vacation for that year on a
pro-rated basis. In the event an employee.has not worked the full
calendar year prior to his vacation, such vacation shall be pro-
rated on the time actually worked. Vacation will not be carried
over from year to year.
Departmental seniority on shifts shall determine the choice
of vacations. In case of an employee splitting his vacation, the
employee's selection of additional vacation time shall be made
only after the entire shift has first selected their vacations.
The vacation schedule is subject to the staffing requirements of
the department as determined by the Police Chief. Vacation may be
chosen from January 1, throuqh December 31.
Holiday Leave: Each full time employee shall be granted
eight (B) paid hclidays: New Year'e Day, Memcrial Day, Indepen-
dence Day, Labor Day, Thanksgiving Day, Christmas Day, Goo�
Fridap afternoon, Cliristmas Ece afterncon, Washington Birthday.
Such holiday leave shall be granted an eight (8) days off in lieu
of. the calendar holidays. Such holiday leave shall be subject tc
the departmental work schedule and staffing requireRents as
detere�ined by the Police Chief. Employees may waive holidays off
time in favor of cash payment. Said cash payment shall be com-
puted in the follo��ing manner: the hourly rate in effect

at the time of holiday accrLement times the number of holiday
hours. Employees electing the option paymer.t must notify the
department head in writing by October lst of the current budget
year for the following year.
Emergency Leave: Each employee shall be allowed paid leave
not to exceed three (3) working days for the funeral of such
employee's spouse, father, mother, father-in-law, mother-in-law,
son, daughter, step-child, brother and sister.
ARTICLE IV
PAY PERICDS
All payroll checks shall be paid Bi-keekly.
ARTICLE V
HOSPITAL & MEDICAL INSURANCE - LIFE INSURANCE
Hospital and Medical Insurance.
The Employer shall.pay up to Fifty-Six Dollars and Forty-
Nine Cents ($56.49) per month £or each employee towards the premium of
the employee's group hospital and medical policy irrespective of
the em.ployee's marital status.
The City will pay an amount equal to the cost of the current
individual group health insurance premium for coverage at the time
of retirement for retiring of`icers until such officers have �
attained the age of sixty-five (65) years, providing that such
officer� have not obtained health insurance coverage or is not
eligible for health i.nsurance coverage through other employmer.t or
any other source. Any retired employee whc has. health insurance
benefits or who is eligible for such benefits from any source
other than the City of Oshkosh shall be ineligible for the benefits
provi.ded herein. In the event, however, that the retired employee

exercises the option to retire be£ore age 60, such payment shall
then continue for a maximum period oE five (5) years from the date
of retirement. In the event the employee is retired mandatorily,
then such payments shall continue until age 65 as provided herein.
Life Insurance:
The employer shall pay up to Five Dollars ($5.00) per month
for each employee towards the employee's group life insurance
policy.
� ARTICLE VI
PENSION
In addition to the Statutory requirements, the employer shall
pay to the retirement fund up to 6% of the employees group earnings.
Ouring the month of retirement of employees under the ss:62.13
retirement system, the retirement contribution shall cease and the
amount transferred.to the employee's salary.
ARTICLE VII
WAIVER OF RI6HTS
Neither party to this agreement by such act at the time
hereo£ or subsequent hereto agrees to and does waive any rights
possessed by it or them under state and federal laws, regulations
or statutes. In the event any clause or portion of this agreement
is in conflict with Statutes of the State of Wisconsin Governing
municipalities or other statutes such clause or portions o£ the
Agreement shall be declared invali.d and negotiations shall be
instituted to adjust. the invalidated clause or portion thereof.
� ARTICLE VIII �
EDUCATION BENEFITS
Emoloyees in the position o£ Police Captain on December 31,
1974, shall receive education benefits as outlined below. This
Articie (VIII) shall not apply to any employees appointed Police
Captain after 7anuary l, 1975.

In consideration of the successful completicn of thirty-si.x
(36) credits from the curriculum of the Ur.iversity of Wisccnsin
Oshkosh, or the Fox Valley Technical Institute, defined as the
Police Administration Program; the folloFing schedule of benefits
and provieions apply:
EDOCATIONAL CREDITS
For every three (3) credits an�employee obtains in the afore-
said program of study, he shall receive bi-weekly payments as
listed below: - �

Salary adjustments as contained herein shall be made at the
beginning of the first pay period in February and the beginning of
the first pay pericd in July of each year upon presentation of
satisfactory evidence that the officer has completed the aforesaid
courses of instruction. Hereafter, employees shall not be paid
fcr "D's" unless his overall average is "C" or better.
All employees who have completed two (2) years of service are
eligible to participate in the educational program set forth
herein, an employee who has accumulated credits herein prior to
the cor..oletion of two (2) years of service will receive the
compansation as provided herein at such time as he has completeZ
two (2) years of service.

SENIORITY CREDIT
All officere with fifteen (15) years service as of the lst of
January, 1964, will receive for purpo�es of the pay schedule
eighteen (18) credits. These credits shall be given in addition
to whatever credits they may acquire under the program set £orth
herein.
Those employees who are employed prior to the lst day of
Janu4ry, 1969, who have not progrESSed in the educational program
set forth herein shall receive for pay purpo�es only an additional
ten dollars ($10.00) per mor.th Upon the completicn of ten (10)
years of service and an additional ten dollars ($10.00) per mor.th
upon the completion of twenty (20) years service.
This provision is not to be construed as credit equivalents,
nor�as additional benefits tc acquired credits. Those employees
who qualify for� benefits in the previous paragraph shall not be
eligible for the benefits contained in this paragraph.
The employer will furnish required 6uoks and tuition for
certified courses in the police administration program at City.
exper.se. All payments shall be at the undergraduate rate. If an
employee wishes to take a graduate course, he shall be responsible
for the di£ferer.ces between the graduate and undergraduate rate.
If the employee drops a class, the employee will be responsible
for the costs incurred by the City for that course including books
and tuition. If the reason for the employee drepping the course
is due to a shift change, the eR,ployee will not be denied reimbur-
sement. Student classroom and study hours shall not be construed
as work hours nor shall such time be subject to compensation.
No new employee hired after January 1, 1969, for pUrposes of
the aalary schedule shall be hired in other than the first step of
the salary schedule unless educational achievement is such as �

the City may choose to start him in a step not tc exceed step C of
the salary sche8ule. The salary schedule is set forth in Appendir.
A and incorporated herein by reference.
ARTICLE IX
RECGGNITION & UNIT OF REPRESE�TATION
The City hereby recoynizes the Association as the scle ar.d
exclusive bargaining agent with respect tc hours, wages and
conditions of emplcyment for the positions of Police Captains.
THIS AGREEMENT shall become effective as of the lst day of
January, 1975, and will remain in full force and effect to and
including the 31st day of Decea�er, 1975.
