Home My WebLink About27412 / 75-01--.� q 1 RESOLUTION JAN 161975 FINAL RESOLUTION VACATING PORTIONAND STATE STREET APPROVED BY PI,AN COMMISSION 6- 0 WHSxEAS, pursuant to Section 66.296 (2) of the Wisconsin Statutes £or 1971, the Common Council has heretofore initiated proceedings on December 5, 1974 at a regular meeting of the Common Council to vacate and discontinue the following described streets: COORT STREET - That portion that is west of a line sixty (60) feet west of the east line of Court Street and running parallel to that line from the south line of Ceape Avenue, south to the Fox River. � STATE STREET - That portion of State Street south of a line that is Two Hundred Twenty (220) feet south of the south line o£ Ceape Avenue and north of the Fox River. WHEREAS, a public hearing on the passage of such resolution has been set by the Common Council, which hearing was set for 7:00 in the Council Chambers of the City Hall, Oshkosh,�Wisconsin, on the 16th�day of January, 1975 and written notice of such meeting was duly served on the owners of all of the frontage of the lots and lands abutting upon that portion thereof sought to be discontinued as provided by law, and WHEREAS, a public hearing was duly held pursuant to said notice at the time ar.d place there£ore affir.ed aad all persons =o servad ar.d interested were then and there given an opportunity to be heard, and WHEREF�S, a proper notice of the pendency of said petition £or vacation and discontinuance and-map covering the proposed vacation was duly £iled in the o£fice of the Register of Deeds for Winnebago County as required by the Wisconsin StatUtes, and WHEREAS, the lots and land�abutting on said streets af£ected by this resolution are all in the 8th Wari3, City of Oshkosh and being described as £ollows: COURT STREET - That portion that is west of a line sixty (60) feet�West of the east line of Court Street and running parallel to that line from the south�line of Ceape Avenue, south to the Fox River. STATE STREET - That portion of State Street south of a line that is Two Hundred Twenty (220) feet south o£ the south line o£ Ceape Avenue and north o£ the Fox River. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City cY Oshkosh that it is hereby declared that since public interest requires it, the following described streets in the Bth Ward, City of Ochkosh, Winnebago County, Wisconsin, is hereby vacated and discontinued, reserving unto the City of Oshkosit the right to maintain, service, repair, add or replace all sanitary sewer, storm sewer, water and gas mains and fittings in said vacated streets: - 1 - STREET VACATIONS CON'T. The abstracter has shown in the abstract the vacating resolution which was recorded in the office of the Register of Deeds of Winnebago County on September 14, 1973 in Volume 154B; LP page 0; Document No. 441324. Such resolution recites that a proper notice of the pendency of said petition for vacation and discontinuance and map was filed in the office of the Regis- ter of Deeds. The abstracter, however, says that he found no record in such Register of Deeds' office of such notice of pendency of the petition. The filing of such notice is required by Section 66.296, Wis.
