# 27 � RESOLUTION
WxEREAS, the United States ��upreme Covrt and the Wisconsin
Sunreme Court have established neH constitutional constsuction
for obscenity ordinances, and
WHEREAS, materials, books, and movies are obscene under said
construction if, according to the average person applying contemporary
community standards, it appealed to the prurient interest, depicted
or described sexual conduct in a patently offensive way and has no
serious literary, artistic, poli�tical or scientific value, and
WHEREAS, the Common Council of the City of Oshkosh wishes to
know the desires of the electorate insofar as obscene materials,
motion pictures, and massage parlors and whether or not same should
be prohibited in the City of OshY.oe.h,
N0;�7, THERF.FORE, BE IT RESOI,VP,D by the Common Council oP the
City of Oshkosh that the City Gerk is hereby directed to place
the following three (3) questions on an advisory re£erendum, said
referendun to be held in conjunction with the spring election;
namely on April 1, 1°.75:
