HomeMy WebLinkAbout27514 / 75-15k 15 RESOLUTION APR 3 1975 INITIAL RESOLUTION - GRADING :�i;D GRAVELING OF OAKLAWN AHea BE IT RESOLVED by�the Cemmon Council oY the City of OshkoSh as £ollows: L The Common Council hereby declares its intention to exercise its power under Section 66.60 of the Wisconsin Statutes to levy special assessments upon property within the followiny ciescribed areas for ber.e£its conferred upon such property by improving the £ollowing named streets, said public improvement to include the £ollowing: NORTH h1ASN STREET - from £.ast Murdock Avenue to Libbey Avenue VIOLA AVENUE - from �ackson Street to North Main Street i^IEST LINWOOD AVENUE - from Jackson Street to North ,Sain Street ALLEN AVENUE - from Jackson Street to North Main Street WEST SMITH AVENUE - from Jackson Street to North Main Street BACOV AVENUE - from Jackson Street to Geneva Street GENEVA STREET - from West Smith Avenuz to 572.25 feet north of West Smith Avenue COMET STREET - from S4est Smith Avenue to 572.25 feet north of West Snith Avenue 2. Said public improvement shall include the grading of the above named street to the grade hereafter established by special or3i.nance of the City oi Oshkosh, and the surfacing of said street with gravel and a dust preventative, 3• Before such improvements are made, the Board of Public Norks is directed to cause water and sewer service pipes to be laid in said streats from the mains to the curb line of each 1_ot fronting on the said streats a-�d 'co keep an z;:cnrate e.ccoc_it of th� e:c?ensz incurred in froet oP each lot and re�ort the sama to the Comptroller who �_11 cause the amount charged to each lot to be entered on the tax roll as a special tax against said road, provided,�however, that the Board of PuUlic Works shall not cause such laterals to be so laid for any particular lot, or parcei where, in the opinion of the Board o£ P�.;blic Ntorks, it would be impractical to do so. 4. The total amount assessed against such district shall not eXCeed the total cost of the improvements and the amcunt assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. 5. The assessments against any Farcel may be paid according to the provisions of Section 25-83 thru 25-89 of the Oshkosh Municipal Code. 6. The Hoard o£ Public WorY.s is directed to prepare a report consisting of: (a) Final olans and specificatioas for said improvements. (b) An estimate of the entire cost o£ the improvements and laterals. (c) An estimate as to each parcel of property within the assess- ment district of: (1) The assessment of benefits =''o be levied for each improvement. . l2) The damages to be araarded for property taken or danages by each ireprovement. (3�) Th_ net amour.t of benefits over damages or of damages wer benefits for each improvement. _�;_ GRADING & GRAVELING CON'T. Opon completion of such report, the Board of Public Works is directed to file a copy thereo£ in the City Clerk's Office for public inspection. 7. Upon receiving the report of the Board of Pvblic Works, the City Clerk is directed to give notice of a public hearing on such reports as specified�in Section 66.60 (7) of the Wisconsin Statutes, The hearing shall be held by the Board of Public [VOrks at the Council Chambers in the City Hall at a time set by the Clerk in accordance with Section 66.60 (7) of the Wisconsin Statutes. 8- The Wisconsin Public Service Corporation of Oshkosh, Wi.sconsin, is hereby required to install gas mains in said street and service laterals at such intervals as the Board of Public Works shall d9.rect, thedCi�GykClerkeshalllforward�arcezti£iedmcoovement o£ the said street, said corporation forthwith.
