COMPLIANCE FEE

BE IT RESOLVED by the Common Council of the City of Oshkosh that the
attached Planning Services Fee Schedule is hereby approved, effective January 1,
2016.

RE: Approve Establishing Planning Services Fee Schedule for Site Plan Review and
Final Inspection Fee, Stormwater and Transportation Consultant Fee and Code
Compliance Fee
BACKGROUND
Site Plan Review is required for every commercial, industrial, institutional, and multi-family
project in the City prior to issuance of a building permit or commencement of development
activity. Site plan review is an administrative process that is typically held within 7-12 working
days after the completed plans and application are received. The goal is to reduce the review
period to 5 business days.
The City of Oshkosh Planning Services Division currently coordinates and administers the
site plan review process as part of a Site Plan Review Committee (SPRC). The SPRC is
comprised of various city staff representatives from Community Development, Engineering,
Transportation, Police, Fire, and other departments as needed depending on the type of
project. The SPRC meets twice monthly and may place various conditions of approval on
projects that must be addressed prior to permit approval or at project closeout.
For a number of years the City has been charging a graduated review fee based on the
square footage of a project as follows:
2015 SITE PLAN REVIEW FEES:

For 2016 the City is proposing two additional fees associated with this service provision. One
is a final inspection and occupancy permit compliance fee and the other is a Contracted
Services Fee.
The final inspection and occupancy pertnit compliance fee is a graduated scale fee proposed
at between $100-$175 depending on the level of the project. The intent of the fee is to
ensure that conditions of approval placed on projects have been implemented at project
occupancy or completion. The fee will offset the salary of planning staff that will inspect each
project and issue certificates of compliance.
The other new fee being proposed is a Contracted Services Fee + 2% administrative fee that
will be charged and paid to the City's contract consultant that will perform predominately
stormwater and site engineering design review as well as things like traffic engineering
reviews. The fee will be an actual cost as billed by the consultant and will include an
additional 2% administrative fee associated with administering the contract consultant. The
contract consultant will free up city engineering staff time working on private development
projects to work on public infrastructure projects.
ANALYSIS
The proposed fee schedule for 2016 is:
Contracted Service Fee to pay actual costs of the City's contract development services
contract + a 2% city administrative fee.
Zoning Code Enforcement Service Fee Recommendation
Similar to the fee being charged by the City of Oshkosh Inspection Services Division in
adding service fees to housing and property maintenance compliance inspections, Planning
is proposing a Zoning Code Enforcement Fee for zoning related infractions to offset staff time
associated with code administration. These infractions often take up hours of valuable staff
time to bring cases into compliance resulting in multiple notices and often times issuance of
municipal citations where the City only receives a very small fraction of the citation fee
issued.
The proposed fee would mirror that of the Inspection Services Fee as proposed below:

Charging a service fee to the property owner for violations to the City of Oshkosh Municipal
Code does three things:
1. It makes the owner take responsibility for the violation that is created on their property.
2. It gives the owner an incentive to get the violation corrected within a reasonable time
frame to avoid additional fees.
3. It makes the violators pay for the use of city resources that are required to enforce the
Zoning Ordinance.
Both fees are anticipated to generate an additional $24,000 in revenue and will offset the staff
costs associated with creating a full-time Zoning Code Enforcement Inspector position that is
currently a shared position between Planning and Inspections.
FISCAL IMPACT
The anticipated revenue of $24,000 will help offset salary costs of creating the full-time
Zoning Code Enforcement Inspector position in the Planning Services Division.
The contractor cost recovery fee will serve as a pass through of development review costs.
RECOMMENDATION
Staff recommends approving the fees as proposed.
