HomeMy WebLinkAbout08. 15-523DECEMBER 8, 2015 15-523 RESOLUTION (CARRIED__7-0_____LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: APPROVE ACCEPTING EASEMENT AT 2100 SOUTH KOELLER STREET INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to accept an easement from Aviation Restaurant Corporation for placement of a “Welcome to Oshkosh” sign near the intersection of South Koeller Street and West South Park Avenue, per the attached, and to execute any and all documents necessary for purposes of same. O � TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich � Director of Planning Services DATE: December 3, 2015 RE: Approve Accepting Easement at 2100 South Koeller Street (Plan Commission ' Recommends Approval) The subject site is an existing fast-food restaurant (Hardees) located at the northwest intersection of S. Koeller Street and W. South Park Avenue (State Highway 44). The areas surrounding the subjed site include commercial uses to the north, west and east and Wittman Regional Airport to the south. ANALYSIS The City and the Oshkosh Community Foundation have been working to identiTy locations to install "Welcome to Oshkosh" signs in the community. The Foundation is providing funding to construct and install the signs while the City is providing additional work in the form of technical assistance finding locations, installation, and landscaping around the signs. Several signs will be located within the City right-of-way however the sign at this location cannot be placed there as the property is within the control of the State of Wisconsin Department of Transportation. Due to the acquisition methods used to acquire right-of-way, the installation of the sign would be lengthy and may result in an expense to the City. Therefore, the Foundation approached the owner of the property at 2100 S. Koeller Street about granting an easement to the City and the owner is agreeable upon final location of the easement area. FISCAL IMPACT None anticipated. The Plan Commission approved of this request at its December 1, 2015 meeting. Approved, ��✓-�� City Manager ITEM: ACCEPT SIGN EASEMENT 2100 S. KOELLER STREET (IIARDEES) Plan Commission meeri�g of December 1, 2015 GENERAL INFORMATION Applicant City Administration Owner: Aviation Restaurant Corp. Actions Requested: The CiTy of Oshkosh is requesting acceptance of an easement from Aviation Restaurant Corp. for placement of a"Welcome to Oshkosh" sign neaz the intecsection of S. Koeller Street and W. South Park Avenue (State Highway 44). The following is the Pla� Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and suaounding area as well as the ]and use and zoning classifications in this azea. He reviewed the general location of the easement azea and explained the reason for the request which is [o place a"Welcome Oshkosh" sign at this location. He reviewed renderings of the proposed signage and a map depicting the easement azea. He discussed why the sign could not be placed in the pablic dgh[-o8way as it is within control of the State of Wisconsin Depar[ment of Transportation (DOT). He further explained the process to install it in the DOT's righbof-way which could be lengthy and more costly and that the Ciry was therefo�e requesting an easement from the property ownei [o allow the sign to be placed on their property instead. Mr. Hi�z questioned why it could not be located south of the Hazdees property in the azea of righU of-way. Mr. Nau responded that the right-of-way was under the contro] of [he DOT. Steve Gohde, Assistant Director of Public Works, added that the DOT has outdoor sign regulations and has con[rul of uffsite signs placed near highways. He further discussed [heu regula[ion of business sigas in the right-of-way near highways and that the DOT applies these regulations to this sign as in their opinion it is �o different than offsite signage for a business. Signage is allowed in this azea, however not in the right-of-way that they control, and [he City is still in the process of reseazching [he issue so if theie is a way to place the sign in the cight-of-way, it will be do�e in that manner. The easement is being requested in case this is no[ feasible. Mr. Gray questioned if the Ciry needs to comply with signage ordinance requirements. Mr. Nau responded affirmativety. Mr. Gray then questioned the sign design and its con[ent. rtrm-AmeprEmemem-dL00S Xoe!luSeree d Mr. Nau replied [hat the Plan Commission was reviewing [he request for acceptance of an easement at this location for the sign placement only and discussion on its content was not relevant. Mr. Gray suggested that the sign should say "Welcome to Oshkosh" rather than "Welcome OshkosN' as the renderings depicted. Allen Davis, Director of Community Development, stated that he would bring this suggesfion to the group tha[ is working on this project. As a result, the Foundation approached the owner of the pmperty at 2700 S Koeller St about granting an-easementto the City. The owner is agreeable to granting the easement upon reviewing the fnal location and easement document. Staff is working to fnalize the easement and location.
