Dear Father Leannah:
Congregation

VICTOR A. MILLER
ATTORNEY GENERAL
We have your recent letter stating your organization is
contemplating obtaining a license for sale ef fermented malt beverages
at bingo events. You request information regarding obtaining such
a license.
The application would have to be made with the clerk of the
municipality in which your congregation is located. The congregation
or some bona fide club or lodge of your congregation could make the
application on the non-profit organization application. We assume
that you plan on holding regularly scheduled events and therefore it
would be necessary to apply for an annual Class "B" beer license.
The fee is determined by the local licensing authority but the
statutes provide that the fee for a Class "B" beer license cannot
exceed $100 annually. All licenses expire as of June 30 each year,
and it is entirely the decision of the local licensing authority as
to whether _or not-_the.__applct.ion shall be granted. If issued for
aeriod:of_more than six monthslthe full annual fee must be charged;
ifissued for a prio-af six months or less, three-fourths of the
annual fee must be charged.
All Class "B" beer licenses are subject to the same regulations,
whether issued to taverns or clubs, lodges, etc. It would be
necessary that either the approved agent of the organization, who
has operator's privileges, be on the premises during hours of sale,
or a licensed operator must be in charge. Other individuals who are
18 years of age or over may work under the immediate supervision of
the approved agent or a licensed operator without obtaining

bartendzr's (operator's) licenses. All officers and directors of
the organization must be at least 18 years of age, citizens of the
L?nited States, and of good moral character. The agent of the
organization must be approved locally and by this department.
ten aproved both locally and by this department, he is then
considered to have the privileges of a licensed operator,
We are sending you under separate cover two pamphlets which
will give you information in condensed form regarding requirements
under a Class "B" beer license and also a non-profit organization
aplication which may be used by your congregation or any organi-
zation canich may be designated to make the application and assume
responsibility for the operation. If you have any further questions,
?lease feel free to contact us.
Sincerely,
